SUBJECT: Joint Powers Agreement with S1. Paul
DATE: November 5th, 2007
INTRODUCTION:
The City Council is asked to approve a Joint Powers Agreement with the City of Saint
Paul, for the use of their fire training facility.
BACKGROUND:
The attached Joint Powers Agreement with S1. Paul Fire Departmentis to allow Shakopee
Fire Departmentmembers the ability to use the training facility without having to sign a
release every time Shakopee Fire Fighters attend the site for training.
The S1. Paul Fire Department is asking for authorization of the Joint Powers Agreement
to give the S1. Paul Fire Department a release of liability if something was to happen to a
Shakopee Fire Department member while training.
RECOMMENDATION:
The recommendation is to sign the agreement to allow Shakopee Fire Department the
Lability to use the S1. Paul facility to conduct the needed training.
RELATIONSHIP TO VISIONING:
This supports Goal D "Vibrant Visilient and Stable"
ACTION REOUESTED:
The action being requested is for the City to sign the Joint Powers Agreement between S1.
Paul Fire Department and the Shakopee Fire Department

JOINT POWERS AGREEMENT
THIS JOINT POWERS AGREEMENT is between the City of Shakopee, Minnesota
(hereinafter referred to as "Shakopee") and the City of Saint Paul, Minnesota (hereinafter
. referred to as "Saint Paul"), both political subdivisions within the State of Minnesota, which
are empowered to enter into joint powers agreements pursuant to Minn. Stat. S 471.59, subd.
10.
WHEREAS, Saint Paul Fire and the Shakopee Fire Department wish to detail the terms of
use of Saint Paul Fire's training facility at 1683 Energy Park Drive, Saint Paul, Minnesota by
the Shakopee Fire Department.
WHEREAS, the parties have hereinafter set forth the terms of said use by the Shakopee Fire
Department.
NOW, THEREFORE, it is hereby agreed by and between the parties as follows:
1. By prior arrangement with Saint Paul Fire Chief, the Shakopee Fire Department may
use the training facilities for fIrefighters located at Saint Paul's Fire Training Center
located at 1683 Energy Park Drive, Saint Paul, Minnesota.
2. Saint Paul Fire will make such training structures and devices available to the
Shakopee Fire Department during evening and weekend hours on the dates requested
by the Shakopee Fire Department subjectto Saint Paul Fire's own prior commitments.
3. The City of Shakopee will pay Saint Paul the amount of one hundred fifty dollars
($150) per one (1 ) hour of use or fraction thereof for the use of the training facilities.
The City of Shako pee will pay Saint Paul Fire the amount of fifty dollars ($50) per
one (1) hour session or fraction thereof for standby service of Saint Paul Fire safety
officer or instructor if required. Sessions will be determined by mutual agreement
between the parties and approved by Saint Paul Fire as to the precise dates and times.
If a training session is canceled less than ten (10) days prior to the session's scheduled
time, a cancellation fee of one hundred fifty dollars ($150) will be paid to Saint Paul
Fire.
4. Facilities designated for the Shakopee Fire Department use shall be the Drill Tower,
the Burn Simulation Building, the HazlMat Training Pads, the Pump Test Pits,
Training Props, and a Classroom.
The City of Shakopee agrees to defend and hold Saint Paul harmless from any claims
which may be made against Saint Paul Fire in any way resulting from the use of the
structures, devices,. and apparatus described above by the Shakopee Fire Department
except for any claims resulting from negligence on the part of Saint Paul Fire. The

disbursements incurred as a result of any claims brought from said use, except for any
claims resulting from negligence on the part of Saint Paul Fire.
6. This agreement will continue in full force and effect until such time as it is canceled
by either party by giving sixty (60) days written notice to the other party of
cancellation.
7. The Shakopee Fire Department will be responsible for any and all required cleanup
required as a result of this usage. The Shakopee Fire Department will clean the
training facilities to the satisfaction of Saint Paul Fire including the removal of all
debris.
