No. 6683 /3.c.L CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Accepting of Feasibility Report for Beckrich Park Estates and Kristal Estates Sanitary Sewer and Water Improvements, Project No.2007-1O DATE: November 7, 2007 INTRODUCTION: Attached is Resolution No. 6683, a resolution accepting the feasibility report and establishing a public hearing date for the December 4, 2007 for the Beckrich Park Estates and Kristal Estates Sanitary Sewer and Water Improvements. BACKGROUND: On May 15,2007 City Council adopted Resolution No. 6609, a resolution authorizing the preparation of a feasibility report for the extension of sanitary sewer and water into the Beckrich Park Estates and Kristal Estates Additions. Beckrich Park Estates was an approved rural subdivision in 1992 and has 34 lots with existing on-site septic systems and a central well for their water. Kristal Estates was recently approved with MUSA and is a six lot subdivision that needs extension of sanitary sewer and watennain to serve the site. The preparation of this report has been done by City staff, utilizing surveying work by WSB & Associates to prepare a preliminary alignment of sanitary sewer and watennain extension. Attached is the feasibility report outlining the projects costs, project funding and assessments for sanitary sewer and water to these subdivisions. Also included in the assessments are the trunk sanitary sewer, trunk watennain and water connection charges for Beckrich Park Estates lots only. Since Beckrich Park Estates has a common water system, and if this project is to move forward, this water system would be converted in its entirety over to Shakopee Public Utilities water system, thus the trunk water and water connection charges must be paid with that conversion. The residents of Beckrich Park Estates have asked staff to include these connection charges as part of the assessments, for property owners to pay over time. . , . In the feasibility report, the cost of the improvements are essentially assessed 100% to the benefiting property owners, except for the oversizing of the sanitary sewer and watermain Those costs would be paid out of the Trunk Sanitary Sewer Fund and the Shakopee Public Utilities Trunk Water Fund. Also attached to this memo is a sample waiver of assessment agreement for the lots in Beckrich Park Estates on this project. If this project proceeds to a public hearing, it is staff s intent to prepare agreements for all the lot owners in Beckrich Park Estates and to have an indication of support by the public hearing date. With this project staff does have a couple of items that need Council policy direction on the assessments and trunk sanitary sewer charge. The first item. would be if the City should participate in the reconstruction cost of Hampton Circle, due to the sanitary sewer line being extended on this roadway. In the feasibility report, staff did include this cost as 100% assessed to the Beckrich Park Estates lots. However, one could also argue that the road is 15 years old and has considerable wear and tear and the City should pay its share to reconstruct the road with the rationale being this City street is being constructed to new City standards. Also, the reason for this being a policy decision is to look at other future areas, such as Hilldale Drive and other rural residential areas. Hilldale Drive residents did submit a petition earlier this year for sewer and water. The installation of sanitary sewer and water would require the rebuilding of Hilldale Drive and the street is over 20 years old. Staff would propose to assess 30% of the street reconstruction in this case. The policy question is one of consistency when extending sewer and water to an existing rural subdivision. Staff would like to ask Council for direction in this assessment policy matter at the November 7th meeting. The other policy question would be in regard to the trunk sanitary sewer charge, which has a 2007 rate in the feasibility study and shown on the assessment appeal waiver. In 2008 staff will be proposing approximately a 2% increase due cost price increases. The policy question for Council would be if the waiver of assessment agreement is signed, should the 2007 rate be utilized even though the assessment hearing and final assessments would not occur until 2008, or to just use the sanitary sewer trunk rate at the time of the assessment hearing. Another factor in this project, which is an unknown, is the amount of Shakopee Public Utilities water connection charge increases. This has been an item of discussion by the Utilities Commission the last couple of months. The reason for this being an element of concern, is that the City would be assessing those connection charges and have to prove benefit if it exceeds the amount listed in the assessment agreement. ALTERNATIVES: 1. Adopt Resolution No. 6683, a resolution accepting the feasibility report and establishing the public hearing date for December 4, 2007 for the Beckrich Park Estates and Kristal Estates extension of sanitary sewer and water improvements, Project No. 2007-10. 2. Do not adopt Resolution No. 6683 at this time. 3. Provide staff direction on assessment questions in this memo. 4. Do not provide staff directions on assessment questions as this time, but wait until the December 4th public hearing. 5. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No.1 and No.3, in order to proceed with the project to a public hearing on December 4, 2007 and to provide answers to assessment policy questions raised in this memo. This would give the residents a much understanding as to the assessment costs, before signing a waiver of assessment agreement. ACTION REQUESTED: 1. Offer Resolution No. 6683, A Resolution Receiving a Report and Calling a Hearing for Beckrich Park Estates and Kristal Estates Sanitary Sewer and Water Improvements, Project No. 2007-10 and move its adoption. 2. Estates Addition Sanitary Sewer and Water Improvements, Project No. 2007-10 and this report was received by the Council on November 7, 2007. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The Council will consider the Beckrich Park Estates and Kristal Estates Addition Project and all appurtenant work in accordance with the report and the assessment of abutting and benefited property for all or a portion of the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an estimated total cost of the improvement for the Beckrich Estates and Kristal Estates Addition of$I,163,878.66. 2. A public hearing shall be held on such proposed improvements on the 4th day of December, 2007, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street, Shakopee, Minnesota, and the Clerk shall give mailed and published notice of such hearing and improvement as required by law. 3. EXECUTIVE SUMMARY The intent of this section is to highlight the important issues of this project. More detailed ! information is contained in the body of the report. I On May 15, 2007, the City of Shakopee adopted Resolution No. 6609, which ordered the preparation of a feasibility report to analyze the extension of sanitary sewer and water municipal utility lines to the following areas: I . Beclaich Park Estates I . Kristal Estates (Lot 1, Block 1 of Beckrich Park Estates) The proposed improvements consist of extending sanitary sewer and watermain utilities, I including sewer and water service lines and restoration of areas that are disturbed for the installation of utilities. Maintenance trails will be installed, as necessary, for proper access for utility maintenance personnel. ! The costs for the proposed improvements are $171.124.25 for watermain improvements and $721.721.61 for sanitary sewer improvements. The total project cost is $892.836.86. In I addition, at the request of the homeowners within the Beckrich Park Estates Addition, the Trunk Sanitary Sewer Charge, the Water Connection Charge and the Water Trunk and Connection Funds will be included in the assessments to those properties that sign a waiver of I assessment appeal for the project. The aforementioned charges/funds to be included in the assessments total up to $276.541.80. Finally, the Beckrich Park Estates homeowners have requested all assessments be evenly apportioned amongst the thirty-four (34) lots. INTRODUCTION On May 15,2007, the City of Shakopee adopted Resolution No. 6609, which ordered the preparation of a feasibility report to analyze the extension of sanitary sewer and watennain, including services to the following subdivisions: . Beckrich Park Estates . Krista1 Estates (Lot 1, Block 1 of Beckrich Park Estates) This project is included in the City's 2007 Capital Improvement Program. 2. SCOPE This report will detennine the feasibility and cost effectiveness of extending municipal sewer and water utilities to the above mentioned subdivisions. 3. BACKGROUND Beckrich Park Estates was approved as a rural service subdivision in 1992 and has 34 lots. The lots have individual sewage treatment systems (ISTS) and a common water system with two (2) wells, six (6) inch watennain and service lines. Shakopee Public Utilities Commission (SPUC) has reviewed the system and decided to accept the watennain pipe and make connections to their system. Krista! Estates is a parcel that received preliminary plat and final plat approval in 2006. This project was to extend sanitary sewer and watennain utilities to their site and within their site. 4. EXISTING CONDITIONS The existing conditions drawings show the Beckrich Park Estates Addition and the Kristal Estates Addition in its undeveloped state. The proposed improvements associated with this project and with the development of I Kristal Estates are identified in the drawings in the Appendix. 5.1 Watermain t The proposed watermain improvements are identified in the drawing in the f Appendix. The proposed watermain improvements consist of extending watermain from I Hillwood Drive along C.R. 79 to the existing watermain at the intersection of Barrington Drive and Hampton Circle. In addition, watermain will be extended from Patterson Drive within the ACC 2nd Addition to the existing watermain in I Barrington Drive. The site and ultimate alignment of watermain will be decided by SPUC. The proposed improvements also include tnmk oversizing, connecting to the Beckrich Park Estates' existing water system and ! disconnecting the system from the Beckrich Park Estate's two (2) wells. The total estimated project cost for the watermain improvements is ! $171.124.25. 5.2 Sanitary Sewer I The proposed sanitary sewer improvements are identified in the drawing in the I Appendix. I The proposed sanitary sewer improvements consist of extending three (3) eight (8) inch sewer main lines from the ACC 2nd Addition and extending an eight (8) inch sewer main line and a twelve (12) inch trunk sewer main line from the Valley Creek Crossing Addition. The proposed improvements also include the installation of services, maintenance trails and the restoration of all street cuts and disturbed turf areas. The total estimated project cost for the sanitary sewer improvements is $721.721.61. SPECIAL ASSESSMENTS I 6.1 Watermain Funding of the watermain improvements will be through assessments with I SPUC paying for trunk oversizing of pipes. 6.2 Sanitary Sewer I Funding of the sanitary sewer improvements will be through assessments with I the City of Shakopee paying for trunk oversizing of pipes. Actual Assessments will be based on the final project costs and apportionments. r In addition, at the request of the homeowners within the Beckrich Park Estates Addition, the Trunk Sanitary Sewer Charge, the Water Connection Charge and I the Water Trunk and Connection Funds will be included in the assessments to those properties that sign a waiver of assessment appeal for the project. I Per the request of the homeowners within the Beckrich Park Estates Addition, all assessable costs are to be evenly apportioned amongst the thirty-four (34) lots. I 7. ESTIMATED COSTS I An itemized cost estimate is included in the Appendix. The following costs were f prepared using 2007 construction costs and are subject to change, depending on the final design of the project, bids received, and actual work performed. Adams, Planning & Engineering Directo~ SUBJECT: TRUNK WATER and WATER CONNECTION CHARGES DATE: October 31,2007 The Shakopee Public Utilities Commission has detennined that it will be increasing the fees it charges for new developments and water service connections. These fees are called the Trun1( Water Charge (TWC) and Water Connection Charge (WCC), respectively. I The Twe is collected by Shakopee Public Utilities when water availability is provided, usually when an area is platted and public water main is extended throughout the plat. The TWe is an area charge used to pay for tnu1k water main over sizing, the practice of over sizing lateral water mains through an area to provide for a looped trunk network of distribution pipes. The TWC is currently $1,628 (2007 rate) per net acre. A net acre is total area less public right of way, public park land and wetland areas. The wee is collected by the Shakopee Public Utilities prior to the City of Shakopee issuing a building pennit. The WCC is used to pay for wells, pump houses, treatment and storage facilities. The WCC is currently $2,846 (2007 rate) per equivalent SAC unit. One housing unit equals one equivalent SAC unit. One SAC unit equals 276 gallons per day. In 2007, the Utilities Commission received reports from their water planning and fmancial consultants that advised them of the trunk water and water connection funds present balances, projected revenues and planned expenses that are necessary to continue to provide a safe, clean, reliable water supply as the city grows. Projections in the report indicate a cash flow shortfall, where expenses will exceed revenues, which is planned to be fmanced. With the added cost of financing debt, the TWC and WCC will be increasing between 20% and 30% for 2008. The exact amount of the increases will be detennined at the Commission's December 3rd meeting and will be adopted by Commission resolutions. The fee increases will be effective as of January 1,2008. All developments requesting water service availability from Shakopee Public Utilities and building pennits issued by the City of Shakopee after January 1,2008 that include new water, or increased water service will be charged the TWC and WCC at the new rates.
