No. 6677 1.8~ CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Assessment Hearing for the 2007 Bituminous Overlay, Project No. 2007-5 DATE: November 7,2007 INTRODUCTION: Attached is Resolution No. 6677, a resolution which adopts the assessment for the above referenced project. BACKGROUND: This project has essentially been completed and all project costs identified. The final project cost is $438,671.00, which consists of construction costs, financing costs and engineering/administration costs. A breakdown ofthe project costs are as follows: Description Amount City Costs (State Aid) $261,774.78 Assessments $176.896.22 TOTAL PROJECT COSTS $438,671.00 City policy is to assess 30% of the project costs to the benefiting properties. Assessments were based on a front footage. The assessment rate per foot is $10.59. Attached to this memo is a map of the project area and the assessment roll for Council consideration and adoption. A presentation of the final costs and assessments will be made at the Council meeting. ALTERNATIVES: 1. Adopt Resolution No. 6677. 2. Deny Resolution No. 6677. 3. Table Resolution No. 6677 for specific reasons. RECOMMENDATION: Staff recommends Alternative No.1. ACTION REOUESTED: Offer Resolution No. 6677, A Resolution Adopting Assessments for the 2007 Bituminous Overlay, Project No. 2007-5 and move it adoption. Cd4 VJ~ Jeff Weyandt Assistant City Engineer JW/pmp ENGRI2007PROJECT/20070VERLAYIWORDIMEM6677 RESOLUTION NO. 6677 A Resolution Adopting Assessments For The 2007 Bituminous Overlay Project No. 2007-5 WHEREAS, pursuant to proper notice du1y given as required by law, the City Council of the City of Shakopee met and heard and passed upon all objections to the proposed assessments of: 12th Avenue, from approximately 300 feet east of CSAH 83 to Valley Park Drive; and Valley Park Drive, from 12th Avenue to Industrial Blvd. North NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That such proposed assessment together with any amendments thereof, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named herein and each tract therein included is hereby found to be benefitted by the proposed improvements in the amount of the assessments levied against it. 2. Such assessments shall be payable over a period of one year, the fIrst installment to be payable on or before the first Monday in January, 2008, and shall bear interest at the rate of 8.00 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added the interest on the entire assessment from the date of this resolution until December 31, 2008. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within thirty (30) days from the adoption of this resolution; the owner may thereafter pay to the County Treasurer the installment and interest in process of collection on the current tax: list, and may pay the remaining principal balance of the assessment to the City Treasurer. 4. The Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify annually to the County Auditor on or before November 30th of each year the total amount of installments and interest on assessments on each parcel of land which are to become due in the following year. All objections to the assessments not received at the assessment hearing in the manner prescribed by this subdivision are waived, unless the failure to object at the assessment hearing is due to a reasonable cause. 429.081 APPEAL TO DISTRICT COURT Within 30 days after the adoption of the assessment, any person aggrieved, who is not precluded by failure to object prior to or at the assessment hearing, or whose failure to so object is due to a reasonable cause, may appeal to the district court by serving a notice upon the mayor or clerk of the municipality. The notice shall be filed with the court administrator of the district court within ten days after its service.
