SUBJECT: Authorize an Extension Agreement with WSB & Associates for
Preparation of a Storm Water Ordinance for the City of Shakopee

INTRODUCTION:
The City of Shakopee recently updated its Comprehensive Storm Water Management
Plan to incorporate changes in policies that evolved since the last update in 1998. The
new plan is referred to as the Comprehensive Water Resource Management Plan
(CWRMP) and is in conformance with requirements set forth by the Metropolitan
Surface Water Management Act and the Board of Water and Soil Resources Rules
Chapter 8410. As part of the process to comply with additional requirements set forth by
the Scott County Watershed Management Organization (Scott WMO), the Prior Lake -
Spring Lake Watershed District (PLSLWD) and our own CWRMP, a storm water
ordinance is to be developed in order to maintain City control of development review and
permit approval.
BACKGROUND:
A detailed outline of the proposed work plan, schedule and estimated fees for the
preparation of the storm water ordinance was prepared by the City of Shakopee's storm
water consultant, WSB & Associates. Please see the attached proposal. WSB &
Associates has the experience and expertise to complete the storm water ordinance prior
to the end of the year, the required timeline for its completion/adoption. Therefore, at
this time, staff recommends authorizing the appropriate City official to enter into an
extension agreement with WSB & Associates for the preparation of a storm water
ordinance for the City of Shakopee.
Upon authorization, the outlined work will proceed immediately and the completed
ordinance will be brought back in its entirety to the City Council for formal approval, in
their role as the Local Governing Unit (LGU).

Dear Mr. Loney:
This letter outlines a proposed work plan, schedule and estimated fees for WSB to prepare a
stormwater ordinance for the City of Shako pee in conformance with the requirements ofPLSLWD,
Scott WMO, and the recently adopted Shakopee Water Resource Management Plan. WSB also
proposes to assist the City with preparing a Memorandum of Understanding or similar document to
signify that the City's policies are approximately equivalent to the requirements of the Prior Lake -
Spring Lake Watershed District and the Scott WMO. This is required to maintain City control of
development review and permit approvals.
The following is a list of tasks that WSB will perform to complete the project:
Task 1: Review Existin2 Ordinances
As a part of this task, WSB will review the existing city ordinances and note sections that
contain rules relevant to stormwater issues.
Task 2: Determine New Ordinances Required
This task will identify ne\v ordinances necessary to enforce policies in the City's
Comprehensive Water Resources Management Plan and to satisfy the requirements of the
Scott WMO and PLSL WD.
Task 3: Complete Draft Ordinance
This task will take information found through completing Tasks 1 and 2, and compile the
existing and new ordinances into a draft stormwater ordinance. City ordinances will be
revised,when necessary to remove redundant information from other sections. Revisions to
existing o'iuinances will be presented in an underline/strikethrough format and the new
stormwater ordinance will be presented to City staff, City Attorney, and
Watershed Agencies for review and comment.

Task 4: Complete Final Ordinance
This task will incorporate the review comments of the City staff, City Attorney, and
Watershed Agencies into the draft ordinance to complete a final ordinance for the City to
adopt.
Task 5: Present Determination of Equivalencv to Watershed Agencies
After the final ordinance has been completed, WSB will send a letter to the watershed
agencies outlining the equivalency ofthe City ordinances relative to watershed policies.
WSB will coordinate with the watershed agencies to make certain that action is taken by
watershed boards addressing the equivalency of policies.
Task 6: Complete Memorandum of Understandine: Between Watershed Ae:encies and
City
WSB will assist City as needed to complete the Memorandum of Understanding to grant
permitting authority to the City. It is expected that this task would be completed primarily
by City staff, City Attorney, and watershed agencies. WSB will support, as necessary, the
coordination activities associated with this task.

Estimated Fees
WSB proposes to complete Task 1 to 5 as described above for a cost not to exceed $7,900. Task 6
will be performed as requested by the City on an hourly reimbursable basis with an estimated fee of
$1,200.
