CITY OF SHAKOPEE CONSENT Memorandum CASE NO.: 07 -065 TO: Mayor and City Council Mark McNeill, City Administrator FROM: Kyle Sobota, Planner I SUBJECT: Waiver of Subdivision Criteria: 1933, 1939 Shakopee Avenue East MEETING DATE: November 7, 2007 INTRODUCTION: William and Karen Lloyd have submitted a request for approval of a waiver of subdivision criteria for 1933 and 1939 Shakopee Avenue East. The parcel is zoned Urban Residential (R- IB). A twin home currently occupies on the subject property, the applicant wishes to sell both units separately, which will require a minor subdivision to create individual parcels for each dwelling unit. The applicant is requesting that the side yard setback be waived in order to allow a zero side yard setback for the lot line along the common boundary of the twin home unit. Recent requests for approval of a O-foot setback have been for properties zoned Old Shakopee Residential (Rl C), staff view this request as similar in nature to the requests previously. AL TERNA TIVES: 1) Approve the requested waiver of subdivision criteria for sideyard setback in the R-IB Zone to allow a zero foot side yard setback at PID 27-052048-0 located at 1933 and 1939 Shakopee A venue East. 2) Do not approve the waiver of subdivision criteria. 3) Table the matter for additional information.
