Acceptance of Countryside Parks in the Countryside Development
Introduction
This item is to request City Council's acceptance of the development of three
neighborhood parks by Tollefson Development Inc. The neighborhood parks in addition
to a cash contribution satisfy the developer's park dedication requirement for the
Countryside Development.
Backaround
The Countryside preliminary plat included the following conditions
· The developer provide a combination of land and cash to meet park dedication
requirements
· The developer design and construct the park areas as part of the development (with
review of the design by the Parks and Recreation Landscape Architect)
· That the costs for constructing the parks be credited toward their cash contribution.
The final calculations for the park acreage required for park dedication totaled 8.30
acres:

The remaining park dedication requirements will be met through cash contribution as
follows:
8.30 acres being provided/17.48 acres that could be required
· 47.5% of dedication met
· 52.5% of dedication remaining
Remaining cash contribution: 52.5% X $2,024,184 = $1,063,044 cash
Tollefson Development Inc. made a cash contribution on December 14,2005 to the City
in the amount of $433,044.00. A letter of credit in the amount of $630,000.00 was
submitted to the City for the park construction. The letter of credit was exchanged for a
performance and payment bond under the development agreement. The developer also
submitted a one-year maintenance bond to the City for maintenance of the improvement
to the Countryside Neighborhood parks.
The three parks known as Countryside SW, Countryside NW and Ambassador
Neighborhood Park are complete. The final cost breakdown for the park development is
illustrated below:

Amount payable to the City for remaining park dedication requirements
The developer will submit a cash payment in the amount of $14,504.68. Once submitted
the developer will have satisfied the total park dedication amount of $1,063,044.00 and
the performance and payment bond under the development agreement will be released
to the developer.

Reauested Action
If Council concurs, offer Resolution No. 6673, A Resolution Accepting the Park
Construction for the Countryside Development and Authorizing the Return of the
Payment and Performance Bond, and move its adoption.

A Resolution Accepting the Park Construction for the Countryside
Development and Authorizing the Return of the Payment and Performance Bond
Whereas, pursuant to park dedication requirements for the Countryside
Development, Tollefson Development, Inc. has satisfactorily completed Countryside NW,
Countryside SW and Ambassador Neighborhood Park pursuant to the requirements of
the final plat approval for Countryside.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA that the work completed for the development of the
parks in Countryside and guaranteed under the performance and payment bond under
the development agreement is hereby accepted and approved; and
BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized to release
and return the performance and payment bond under the development agreement upon
receiving the final park dedication amount required of $14,504.68 from the developer.
