DISCUSSION
Gonyea Land Company has submitted an application for final plat approval ofWestridge Lake Estates 3rd
Addition. The site is located north of CSAH 14 and east of CSAH 79 (please see Exhibit A). The plat, as
currently proposed, contemplates the creation of 14 single family homes and 2 outlots on approximately 29
acres (please see Exhibit B). The property has previously received Planned Unit Development (PUD),
preliminary plat, and final plat approval.
On October 16,2001, the City Council approved Resolution No. 5570, approving the Final Plat ofWestridge
Lake Estates 3rd Addition. A copy of this resolution is attached for the Council's reference (please see
Exhibit C). A condition of approval was that the developer work with Scott County Environmental Health
regarding the approval of the Individual Sewage Treatment Systems (ISTS) on each lot. Following City
Council approval of the final plat, the developer and Scott County were not able to reach an agreement with
respect to the ISTS plan. The developer then commenced litigation against the County regarding the review
and approval of the ISTS for this development. The City was also named as a nominal defendant in the
lawsuit. Recently, the County and the developer have reached an agreement regarding the ISTS
placement/design. In order to meet the terms of this agreement, the developer needs to make minor
reconfigurations to some of the lot lines. This final plat application is necessary in order to modify the lot
lines from their previously approved locations. The lots that are primarily affected are located at the end of
Peninsula Point Road. This final plat application proposes the creation of the same number of lots that were
created in 2001. The revised lot configurations continue to comply with the approved PUD, preliminary and
final plat requirements. Please see Exhibit D for the 2001 approved Final Plat drawing.
The City Attorney has advised staff that because the City has already approved a final plat for this project
and because the revisions are necessitated by the settlement of a lawsuit with Scott County, the City has little
authority to apply new conditions beyond those imposed with the 2001 approval. Therefore, for instance,
such things as park dedication fees will remain at $714.36 per lot and natural resource regulations adopted
since 2001 would not be applicable to this plat.
In addition, the applicant has requested (please see Exhibit E) that the side yard setbacks be reduced on Lots
1,5, and 6, Block 2 to 10 feet from the required 20 feet. This request is made in conjunction with the
proposed settlement of the lawsuit with Scott County regarding the ISTS design for the project.
Exhibit F is a communication from the applicant requesting that the 2001 city fees and platting fees be
applied to this application because the final plat was originally approved in 2001. In Exhibit F, the applicant
references direction provided by City Council as a basis for this request. However, the direction provided by

Council is in reference to whether or not the 1981 Scott County Sewage Treatment System Ordinance was
applicable to this plat. This direction did not in any way reference applicable fees. The Engineering Dept.
has provided information regarding the differences in 2001 and 2007 fees for this development in Exhibit G.
Please review this exhibit for a comparison of fees. The Engineering Department recommends that the
applicant be required to pay all fees in accordance with the most recent edition of the City of Shakopee Fee
Schedule, in compliance with City Code Section 12.39 and Section 3.43.
Staff received comments from City Engineering and other departments and agencies. These comments have been
incorporated into the recommended conditions of approval.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL
PLAT OF WESTRIDGE LAKE ESTATES 3RD ADDITION
WHEREAS, Gonyea Land, applicant and property owner, have made application for final plat
approval ofWestridge Lake Estates 3rd Addition; and
WHEREAS, the subject properties are legally described as:
Outlot C, Outlot D, Outlot E, Outlot F, Outlot G, Outlot H, Outlot 1, Outlot J, Outlot K, and Outlot P,
of Westridge Lake Estates First Addition, according to the recorded plat thereof on file in the office of
the County Recorder, Scott County, Minnesota AND Lot 1, Block 4, Westridge Lakes Estates Second
Addition, according to the recorded plat thereof, on file in the office of the County Recorder, Scott
County, Minnesota; and
WHEREAS, the Shakopee Planning Commission conducted public hearings on the
preliminary plat; and
WHEREAS, all required public notices regarding the public hearing were posted and sent;
WHEREAS, this resolution supercedes Resolution No. 5570; and
WHEREAS, the City Council reviewed the final plat request at its meeting on September 18,
2007.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA, THAT THE FINAL PLAT FOR WESTRIDGE LAKE
ESTATES 3RD ADDITION IS APPROVED SUBJECT TO THE FOLLOWING
CONDITIONS:
1. Satisfaction of the conditions placed on the site during the Preliminary Plat and Planned Unit
Development (PUD) approval process.
2. Approval of title opinion by the City Attorney.
3. The side yard setbacks on Lots 1,5, and 6, Block 2 shall be reduced to 10 feet.
4. Prior to release of the Final Plat for recording the following items shall be completed:
a) Execution of a Developer's Agreement which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
b) Payment of Trunk Storm Water Charges shall be made, as required by the most current
City of Shako pee Fee Schedule.
c) Provide electronic (AutoCAD) files of the Final Plat and all record drawings to the
engineering department.
d) Construction of streets in accordance with the requirements of the Design Criteria
and Standard Specifications of the City of Shako pee
e) Electrical system to be installed in accordance with the requirements of the Shakopee
Public Utilities Commission.
1) Water system to be installed in accordance with the requirements of Shakopee Public
Utilities Commission.

g) Cash payment in lieu of park dedication shall be required. (This amount would be
$714.36 per lot based on a 40% credit for open space). The park dedication payments
may be deferred to the time of the issuance of the Building Permit.
h) The applicant shall provide additional right-of-way leading into the proposed cul-de-
sac so as to be parallel to the concrete curb and gutter radii of fifty (50) feet.
i) The applicant shall provide access easements for Lot 1 of Block 4 and Lot 1 of Block
5.
j) Minimum drainage and utility easements for storm sewer less than five (5) feet deep
in non-paved areas shall be twenty (20) feet. The easements shall be centered along
the utility alignment.
k) Minimum drainage and utility easements for sanitary sewer and storm sewer deeper
than five (5) feet in non-paved areas shall be provided at a one (1) to one and a half
(1.5) ratio, depth versus width, plus one (1) foot. The easements shall be centered
along the utility alignment.
1) Easements shall be shown on the Final Plat as approved by the City Engineer. They
shall include, but not be limited to, the following:
i) For the proposed storm sewer between Lots 3 & 4 of Block 2, provide a
minimum of twenty-two (22) feet of drainage and utility easement, centered
on the utility alignment.
ii) Provide additional rear yard drainage and utility easements as necessary to
encompass existing wetlands.
iii) Provide adequate drainage and utility easements to encompass high water
levels of each storm water basin.
5. The following items shall be completed prior to approval of a grading permit and/or a
street/utility plan:
a) No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utilities Commission (SPUC) approves the Final Construction Plans and
Specifications.
b) The applicant shall obtain the necessary permission, right-of-way and/or easements
prior to any work offsite.
c) The applicant shall provide grading, drainage, and erosion control plans and street and
utility plans conforming to the City of Shakopee's most recent editions of the City of
Shakopee General Specifications and Standard Detail Plates for Street and Utility
Construction and the City of Shakopee Design Criteria.
d) The applicant shall provide concrete curb and gutter radii leading into the proposed cul-
de-sac fifty feet in dimension.
e) The applicant shall obtain a NPDES permit prior to any land disturbing activity. A
copy of this permit shall be provided to the City.
1) The County shall review grading plans before final approval of these plans by the City.
6. The homeowners association will be responsible for maintenance of the common facilities,
including Outlots A and B. The common water system must comply with the requirements
established by the Shakopee Public Utilities Commission. This water system can only serve
properties within the PUD.
7. The Final Plat of Westridge Lake Estates Third Addition shall not be recorded until such time
as Scott County Environmental Health has approved the ISTS plan for the development.
8. Residential fire sprinkler systems designed and installed in accordance with National Fire
Protection Standard 13D shall be located in all residential structures located on the islands.

9. Additional apparatus turn arounds shall be provided.
10. Fire apparatus roads shall be provided in accordance with Minnesota Uniform Fire Code
Section 902.
11. Emergency vehicle access to the site shall be provided during construction. Such access is to
be approved by Shakopee Fire Inspector.
12. The Final Plat shall comply with the requirements of Scott County regarding the ISTS within
the development as listed in the June 12, 2007 letter from Scott County Environmental Health.

A RESOLUTION OF THE CITY OF SBAKOPEE, MINNESOTA, APPROVING THE
FINAL PLAT OF WESTRlDGE LAKE ESTATES THIRD ADDmON
WHEREAS, Westridge Bay Company. applicant and property owner, has filed an
application dated and received May 25, 200 1 for final plat approval; and

WHEREAS, the property upon which the request is being made is legally descnDed as
follows: Out/at C, Outlot D, Outlot E, Outlot F, Outlot G, Outlot H, Outlot I, Outlot J, Outlot K
and Outlot P of Westridge Lake Estates First Addition, according to the recordedplat thereat
on file in the office of the county Recorder, Scott County, Minnesota and Lot J, Block 4,
Westridge Lake Estates Second Addition, according to the recordedplat thereat onfile in the
office of the County Recorder, Scott County. Minnesota; and
WHEREAS, all notices of the public hearing for the Preliminary Plat of West ridge Lake
Estates were duly sent and posted and all persons appearing at the hearing have been given an
opportunity to be heard thereon; and
WHEREAS, the City Council reviewed the final plat at its meeting of October '16,2001.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MlNNESOTA, as follows:
That the Final Plat of Westridge Lake Estates Third Addition is hereby approved subject to the
following conditions:
1. Satisfaction of the conditions placed on the site during the Preliminary Plat and Planned Unit
Development (PUD) approval process.
2. Approval of title opinion by the City Attorney.

a) Construction of streets in accordance with the requirements of the Design Criteria

Re: 20 ft side yard building setback
Dear Mr. Leek:
In accordance with our negotiated settlement with the Scott COWlty Environmental
Health Department, the side yard building setbacks on the lots in Westridge Lake Estates
3rd Addition, as shO'vvn on the approved plan, were 10 ft width. It appears that \ve could
accommodate all lots with a 20 ft side yard set back, except for lots 1, 5 and 6, Block 2
Westridge Lake Estates 3rd Addition.
Weare therefore requesting that the 20 ft side yard building setback be changed to 10ft
on Lots 1,5, and 6, Block 2, Westridge Lake Estates 3rd Addition. Please see the attached
exhibits from the ISTS Plan.

The application indicates a request for an amended Final Plat approval of a Rural Residential
(RR) development in the southern portion of the City. The plat is an extension of Peninsula
Point Road located off of Vista Ridge Lane, East of West ridge Drive.
Additionally the applicant is requesting all applicable fees and charges to be collected by the City
of Shakopee be calculated utilizing the Fee Schedule for 2001 rather than the Fee Schedule for
2007.
It should be noted there are differences in fees/charges that would be collected when comparing
engineering department related rates from 2001 to 2007. Please see the table below:

submittals. However, I offer the following comments at this time for the applicant and for the
planning department:
General Comments
The follow items shall be completed prior to release of the Final Plat for recording:

1. Execution of a Developer's Agreement, which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
2. Payment of Trunk Storm Water Charges shall be made, as required by the most current
City of Shakopee Fee Schedule.
3. Provide electronic (AutoCAD) files of the Final Plat and all record drawings to the
engineering department.
The following items shall be completed prior to approval of a grading permit and/or a
street/utility plan:
1. No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utilities Commission (SPUC) approves the Final Construction Plans and
Specifications.
2. The applicant shall obtain the necessary permission, right-of-way andlor easements prior
to any work offsite.
3. The applicant shall provide grading, drainage and erosion control plans and street and
utility plans conforming to the City of Shakopee's most recent editions of the City of
Shakopee General Specifications and Standard Detail Plats for Street & Utility
Construction and the City of Shakopee Design Criteria.
4. The applicant shall provide concrete curb and gutter radii leading into the proposed cul-
de-sac fifty (50) feet in dimension.
5. The applicant shall obtain a NPDES permit prior to any land disturbing activity. A copy
of this permit shall be provided to the City.
Final Plat
The following items shall be completed prior to release of the Final Plat for recording:
1. The applicant shall provide additional right-of-way leading into the proposed cul-de-sac
so as to be parallel to the concrete curb and gutter radii of fifty (50) feet.
2. The applicant shall provide access easements for Lot 1 of Block 4 and Lot 1 of Block 5.
3. Minimum drainage and utility easements for storm sewer less than five (5) feet deep in
non-paved areas shall be twenty (20) feet. The easements shall be centered along the
utility alignment.

4. Minimum drainage and utility easements for sanitary sewer and stonn sewer deeper than
five (5) feet in non-paved areas shall be provided at a one (1) to one and a half (1.5) ratio,
depth versus width, plus one (1) foot. The easements shall be centered along the utility
alignment.
5. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall
include, but not be limited to, the following:
. For the proposed storm sewer between Lots 3 & 4 of Block 2, provide a minimum of
twenty-two (22) feet of drainage and utility easement, centered on the utility
alignment.
. Provide additional rear yard drainage and utility easements as necessary to encompass
existing wetlands.
. Provide adequate drainage and utility easements to encompass high water levels of
each storm water basin.
Recommendation
Engineering staff recommends approval of the amended Final Plat subject to the conditions
above being addressed by the applicant prior to recording of the Final Plat.
Engineer staff recommends the applicant be required to pay all fees in accordance with the most
recent edition ofthe City of Shakopee Fee Schedule. This is in compliance with City Code,
Section 12.39 and Section 3.43 (Resolution 4505).

Dear Mr. Leek:
Scott County Environmental Health has reviewed the proposed septic systems for the final plat Westridge
Lake Estates Third Addition prepared by Halling Engineering, draft plan sheet dated May 31 2007. The
plans as submitted meet basic soils, slope, and setback conditions necessary to permit a standard primary
and alternate drainfield for each of the fourteen lots that will meet the intent of State and County rules and
ordinances. Our approval is based on the condition that the plans do not change beyond this most current
plan proposal. We recognize that the City of Shakopee still needs to review and approve road
construction, grading, and drainage plans that should be on one plan sheet to ensure coordination in the
field. We request an opportunity to review the final grading plans for any potential impacts to the design
and assumptions related to the on-site sewage treatment system locations proposed.
As shown on the plan sheet several of the lots (specifically 1,2,3,5 and 7) have limited space for any
modification of grade for building pads. The Developer has reduced each proposed lot to meet the
minimum of all County and State Individual Sewage Treatment System (ISTS) requirements. As a result,
limited and odd building pad locations have been proposed. Please be aware that any future alteration
from the plan. dated Mav 31. 2007. may not be accepted at time of buildine: permit application. The
ISTS locations, as currently proposed, have been placed within the best and only available areas for each
lot. In order to confirm that ISTS systems can be constructed on the fourteen lots as proposed, a grading
plan for the final plat should include:
. Field verified two foot contours shown on the grading plan.
. Grading limits for all street construction.
. Defined building pads for all lots including elevations.
. The ISTS locations per the May 31, 2007 submittal.
In order to put all parties including future lot owners on notice regarding these challenges, we suggest that
the Developers Agreement include these instructions and be recorded on all lots within the plat.
The following is also required for each building permit submittal:
1. Both sites shall be fenced with four (4') foot orange construction fence with steel posts placed no
further apart than eight (8') feet along the side(s) facing any proposed construction or grading.

2. As each individual lot is sold, the developer must inform each new property owner that:
a. no grading, filling or cutting may begin until a septic permit has been approved by this
office;
b. a drainfield construction plan must be submitted with a septic permit application; and
c. a grading plan must be submitted for each lot to demonstrate drainage will not adversely
impact the primary and alternate septic locations.
3. We are also suggesting, as a condition to final plat approval that the City of Shakopee require of
applicants for swimming pools and hot tubs, that no discharge into the septic system or flow overland
on to neighboring properties, open water bodies or areas where the discharge could adversely impact
the primary or alternate septic locations be permitted. Any permit application for a swimming pool
and/or hot tub shall be subject to review and approval by Scott County.
