Authorize Memo of Understanding between Scott Co. and the City on Hwy Jurisdictional Exchange 13. 8/ 1-" CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorize Memorandum of Understanding between Scott County and the City of Shakopee on Highway Jurisdictional Exchange on County Highways 16 & 77, and 17th Avenue. DATE: September 4, 2007 INTRODUCTION: Attached is an agreement between Scott County and the City of Shakopee on the Highway Jurisdictional Exchange associated with County Highways 16 & 77, and 17th A venue in the City of Shakopee. BACKGROUND: The City of Shakopee and Scott County have been working under a previous agreement to transfer jurisdiction of 17th Avenue to the County, and the County to transfer jurisdiction of County Highway 16 to the City. The previous agreement was entered into . in 2001 and is attached. With the completion of 17th A venue and CR 77 improvements by the new high school and annexation of this area in the City, CR77 is also proposed to be transferred to the City. County Road 77 is a low volume collector street and north of TH169; this road has been previously transferred to the City by the County. The County has provided the City additional funds for future pavement improvements on CR16 with the cooperative agreement of 17th A venue for Southern Meadows to CSAH 83. The County also has split the cost of the additional CenterPoint Energy gas main relocation recently as well. With this agreement, the County is providing the City an additional $30,000 for a CR77 future pavement seal coat. Staff is also working with County staff to provide additional safety measures to the stop signs at C.R. 77 and 17th Avenue, which may be in place by September 4,2007. AL TERNA TIVES: 1. Authorize the appropriate City officials to execute the Memorandum of Understanding between Scott County and the City of Shakopee for highway jurisdictional exchange of County Highway 16 & 77, and 17th A venue in the City of Shakopee and other documents necessary to implement the jurisdictional transfer.. 2. Do not authorize the appropriate City officials to execute this agreement at this time. 3. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No. 1. ACTION REQUESTED: Authorize the appropriate City officials to execute the Memorandum of Understanding between Scott County and the City of Shakopee for highway jurisdictional exchange of County Highway 16 & 77, and 17th Avenue in the City of Shakopee and other documents necessary to implement the jurisdictional transfer. ~rzi/ Public Works . ector BL/pmp ENGR/2007PROJECTS/2007COUNCIL/MOU-HWY.JURIS.EXCHANGE MEMORANDUM OF UNDERSTANDING HIGHWAY JURISDICTIONAL EXCHANGE Scott County and the City of Shakopee, in accordance with a Memorandum of Understanding dated June 19, 2001 and through this Memorandum of Understanding, pursuant to Minnesota Statute, sec. 163.11, agree to the following County Highway jurisdictional exchanges: . Transfer the jurisdiction of County Highway 16 (Eagle Creek Blvd.) from County State (2.1 miles) Aid Highway 17 to County State Aid Highway 83 from Scott County to the City of Shakopee. . Transfer the jurisdiction of County Highway 77 from the south City limits to TH 169 (0.6 miles) from Scott County to the City of Shakopee . Transfer the jurisdiction of 17tlJ. A venue from County State Aid Highway 15 to County (3.5 miles) State Aid Highway 83 from the City of Shakopee to Scott County. In consideration of the City of Shakopee assuming responsibility for the above described segment of County Highway 16 (Eagle Creek Blvd.), Scott County entered into a Construction Cooperative Agreement for construction of a segment of 17tlJ. Avenue from Southern Meadows to County State Aid Highway 83 (City Project 2006-1). Said Cooperative Agreement was approved by the Shakopee City Council on June 20, 2006, and approved by the Scott County Board ofComrnissioners on June 27,2006. In consideration of the City of Shakopee assuming responsibility for the above described segment of County Highway 77 being transferred with this agreement, Scott County will compensate the City of Shakopee a lump sum amount of Thirty thousand and no/OO ($30,000.00) for a future seal coat of County Highway 77. Scott County and the City of Shakopee agree to enter into an annual Maintenance Agreement for the remainder of County Highway 77, lying outside the City limits, until such time as the area surrounding it is annexed into the City of Shakopee, at which time the County and the City shall enter into a separate Turnback Agreement for the remainder of County Highway 77. WHE AS, the City has prepared a feasIbility study for CSAH 83/16 area, dated February 20,2001; and I WHEREAS, the feasibility study reviewed several alternatives for the realignment of CSAH 16 and 17th Avenue as it would intersect CSAH 83; and I WHEREAS, the City and County have had public meetings with the residents and property owners adjacent to CSAH 83 and CSAH 16; and I WHEREAS, the City and County have agreed that the alignment extending the new east-west minor arterial highway along 17th A venue alignment (north of Shakopee Gravel) would provide the best I . operational characteristics for CSAH 83 and the new minor arterial (CSAH 16/17rl1 A venue); and WHEREAS, the City and County have agreed that the construction ofCSAH 83, 16 and this east- I west minor arterial will be completed in phases. The first phase to include the upgrading of existing CSAR 83 and the realignment of existing CSAH 16 both east and west of CSAH 83. The next phases would be the extension of the east-west minor arterial (l7rl1 Avenue/CSAH 16) to CSAH 83, as shown on the attached drawing; and I WHEREAS, the City and County desire to document their respective understandings regarding certain aspects of the proposed alignment, proposed project, future jurisdictional changes and the timing I of these items. NOW, THEREFORE, IT IS HEREBY UNDERSTOOD THAT: 1. CSAR 83/16 Upgrade Project A. The City of Shakopee will be the lead agency in the development of all plans and specifications. The County will review and approve such plans and specifications. The Plans shall also be submitted for State Aid approval. B. The City of Shakopee will identify and describe in legal terms for easement purposes the required permanent and temporary right-of-way required. . The City wiII through its platting process acquire through dedications all permanent and temporary right-of-way from the Valley Green properties abutting this project. . The County in coordination with the City shall have the identified right-of-way needs appraised and acquire such through negotiations and/or eminent domain proceedings. . Upon completion of the project, that part of the CSAH 16 right-of-way from the existing alignment prior to said project which is determined by the County to be excess right-of- way will be vacated to the underlying fee/property owner subject to compliance with statutes and established procedures. However, the County/City will retain an easement for any public utility remaining in said right-of-way. - I , . I c. The County will enter into a Cooperative Agreement with the City prior to award of construction I contract that will specify the rules and responsibilities of each party for the construction project. . Such Cooperative Agreement will include a detailed cost estimate for the project and a I breakdown of the costs by responsible parties. . The County agrees to participate in the project based on the final construction costs attributed to the County. Preliminary estimates have the County share at $62,550 for I right-of-way acquisition and $997,108 for construction costs for a total County commitment of $1 ,059,658. D. The City shall have satisfied and received approval from the Minnesota Department of I Transportation. E. The City and County aclmowledge that, as the jurisdictional authority for CSAH 83 and CSAH I 16, the County retains the right to make any and all determinations on traffic control and access along these two highways. I F. The City as part of the Developer's Agreement with Valley Green will require a traffic analysis of CSAH 83 as a condition of each proposed stage of development in order to enforce maintenance of the Level-of-Service (LOS) for the access points of the overall development to a minimum I LOS ofD. This may include denial of specific development types due to the high traffic generating impacts to the site and access points. I Should the LOS exceed LOS D the City shall not approve the development unless the CitylDeveloper can through additional transportation improvements, reduction in development or by other means bring the LOS into compliance. I The City or its assigns shall be responsible for the cost of the traffic analysis and any measures needed to mitigate the LOS. Any proposed work within the County Highway R/W shall be I approved by the County following its procedures. 2. East-West Minor Arterial I A. The East-West Minor Arterial from approximately 1'4 mile east of CSAH 17 to CSAH 83 will be constructed at such time that one or more of the following occur: I . Development of the property east of CSAH 17 to the Shakopee Gravel property. . The City and County agree that traffic conditions indicate a safety problem exists or is I imminent at the CSAH 83 and CSAH 16 intersections, or adjoining segments. Such problems may be apparent through excessive delays to traffic on CSAH 16 and/or CSAH 83 or through crash problems in this area. I . Four years from the completion of the CSAH 83/16 project. I B. The City will be responsible for development of all plans and specifications for the east-west Minor Arterial road extension to CSAH 83. The County will review such plans and specifications. I c. Upon completion of 17th A venue to CSAH 83, the County will assume jurisdiction of 171h Avenue from CR 79 to C8AH 83.
