INTRODUCTION:
This agenda item is intended to request City Council approval to proceed with submittal
of projects for Federal Funding in the Safe, Accountable, Flexible, Efficient
Transportation Equity Act - Legacy for Users (SAFETEA-LU). City staff has identified
within the Capital Improvements Program, pedestrian bridges over T.R. 169 east of C.R.
83 by Dean Lake and at C.R. 77 (Fuller Street) for possible Federal funding. Also
attached is a proposal from WSB & Associates, Inc. to prepare the submittals for possible
federal funding of pedestrian bridge projects.
BACKGROUND:
The SAFETEA-LU bill has been approved by the Federal Government and Metropolitan
Council and MN/DOT are now receiving project submittals for possible funding within
this program. The SAFETEA-LU program has three areas primarily with funds allocated
to it and they are as follows:
. Surface Transportation Program (STP)
. Congestion, Mitigation/Air Quality Program (CMAQ)
. Transportation Enhancement Program (TEP)
Approximately $80 million dollars is anticipated to be available for STP projects for the
years 2011 through 2012. The TEP will have almost $15 million for the same period and
the CMAQ projects will may have as much as $50 million available. The maximum
award amount possible in the Bike/Walk category for the STP Program is $5.5 million
and is $1.0 million in the Transportation Enhancements Program.
As mentioned previously, the City has two projects that could potentially quality for
Federal Funds under the SAFETEA-LU as follows:
1. Pedestrian bridge crossing over T.R. 169 east ofC.R. 83, c.R. 77 and C.R. 15.
2. Pedestrian bridge crossing over T.H. 169 at C.R. 77 (Fuller Street).
Under the STP, projects can be submitted in one of three categories:
1. Non-freeway principal arterial highways
2. Projects on the "A" minor arterial highway system
3. Bicycle and pedestrian bridges
Under the TEP, projects will be grouped into three categories as well and they are as
follows:
1. Pedestrian and Bicycles
2. Historic and Archaelogical
3. Scenic and Environmental
The recommendation from WSB & Associates and from staff is to apply for STP
Program as the bridges will be over $1,000,000.00 each and possibly apply in the TEP
program for the CR 77 bridge as well which is a lower cost project.
The pedestrian bridge over T.H. 169 east of C.R. 83 could qualify and obtain the most
funding under the STP as pedestrian and bicycle improvements. The Dean Lake area
pedestrian bridge would be a major connection to the DNR trail, Valley Fair, Camas
Quarry Park, Dean Lake trail system Southbridge trail system and recreation trails south
of Dean Lake and along the Prior Lake Outlet Channel.
On C.R. 77, the current bridge is not wide enough for a pedestrian/bicycle crossing, per
MnJDOT standards, similar to C.R. 79 crossing. A trail in this area is essential to connect
residents to the new high school and community center.
Another pedestrian bridge identified in the 2007 CIP is the C.R. 15 bridge crossing over
T.H. 169. City and County staff have discussed future transportation improvements for
the area and one idea is to construct roundabouts at the ramp intersections. By installing
roundabouts, the width of the current bridge would be wide enough for
pedestrians/bicyclists to cross. If roundabouts are not justified and a four lane roadway is
needed, a pedestrian bridge may be needed. At this time, both County and City staff feel
an application for pedestrian crossing is premature at this location and at this time.
Under this program, the City could obtain 80% funding from the Federal Government in
order to construct separate pedestrian bridges, bridge approaches and connecting trails
across T.R. 169 to connect to each area of the Community on either side ofT.H. 169 with
the pedestrian/bicyc1e facility. The remaining 20% of construction cost and engineering
is a responsibility of the City and other funding sources. In the WSB proposal, additional
funding will be solicited from the DNR, Scott County and other sources.
Submittal deadline of these applications is July 20,2007. Also staff will need assistance
from WSB & Associates, Inc. to complete the application. Staff has previously submitted
applications in 2003 and 2005 for pedestrian bridges and was not successful. Staff
believes there are more items in place for an application that can rank higher than in
preVIOUS years. The ranking criteria has changed from 5 criteria to 12 and will require
more information and effort to complete the applications.
The action being requested is for Council to direct staff to proceed with submitting
projects for the SAFETEA-LU program for the pedestrian bridges as mentioned. Also to
authorize an extension agreement with WSB & Associates, Inc., in an amount not-to-
exceed $9,750.00, to provide engineering services for Federal Transportation Funding
Application (SAFETEA-LU). Sufficient funds exist in the Engineering Budget due to
position vacancies and professional services to fund the proposal.
ALTERNATIVES:
1. Approve a motion directing staff to proceed on submitting the T .H. 169 pedestrian
bridges east of C.R. 83 and C.R. 77 for SAFETEA-LU funding to the
Metropolitan Council and Mn!DOT.
2. Do not submit any projects for possible Federal funding.
3. Approve a motion authorizing the appropriate City Officials to execute an
extension agreement with WSB & Associates, Inc. for a not-to-exceed amount of
$9,750.00 for preparation ofthe Federal funding applications.
4. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1 and No.3, in order to receive Federal funding for
these projects, which staffbelieves is needed for the City of Shakopee's infrastructure and
for WSB & Associates, Inc. to complete the application on behalf ofthe City.
ACTION REOUESTED:
1. Approve a motion directing staff to proceed on submitting the T.R. 169 pedestrian
bridges east of C.R. 83 and C.R. 77 for SAFETEA-LU funding to the
Metropolitan Council and MnlDOT.
2. Approve a motion authorizing the appropriate City Officials to execute an
extension agreement with WSB & Associates, Inc. for a not-to-exceed amount of
$9,750.00 for preparation ofthe Federal funding applications.

Dear Mr. Loney:
According to our Agreement for Professional Services within the City of Shakopee and Section
I-C-2 (Major Projects), this extension agreement is written to provide you with an estimate of
cost for engineering services for the above-referenced project.
The proposed project includes the preparation of the Federal SAFETA-LU Transportation Funds
Applications for pedestrian bridges across TH 169. The bridges are located at CR 77 and the
Dean Lake Area bridge crossing to future Quarry Lake Park. The last Met Council Federal
Funding solicitation rated the project using five (5) prioritizing criteria. The solicitation
application has been revised and expanded to twelve (12) prioritization criteria requiring the
application to be significantly rewritten. The new format provides an opportunity to expand on
the benefits of the project to the area. Two separate funding applications will be applied for
through the Transportation Enhancement Program and the Surface Transportation Program
(STP), one for each bridge.
The work involved for this new round of federal funding solicitations will include:
1. Preparation of written responses to the qualifying and prioritizing criteria in the
application.
2. Data collection and analysis for preparing responses.
3. Preparation of exhibits to be included in the application.
4. Review and revisions of draft document.
5. Request for letters of support from other agencies.

In addition to the Federal Funding Application, WSB will also meet and discuss with Mn/DOT
future cooperative funding agreements for 2011 and 2012 along with exploring additional
funding opportunities with the Department of Natural Resources (DNR) and Scott County.
We propose to conduct the work on an hourly basis with an estimated fee of $9,750. We will not
exceed this amount without your prior approval. Formal funding solicitations and applications to
Mn/DOT, the DNR and/or Scott County are considered additional services.
It is proposed that all work under the contract would be considered complete after the
applications have been submitted to Met Council and Mn/DOT. The design and construction
phase would be initiated if funding is approved.
The City of Shakopee agrees to reimburse WSB & Associates for these services in accordance
with Section IV of the Agreement for Professional Services. If this agreement meets with your
approval, please sign below and return one copy to our office.

SCOPE OF WORK
Federal Transportation Funding Applications (SAFETEA-LU) for
Pedestrian Bridges Located CR 77 and Dean Lake Area over Hwy. 169
FEDERAL FUNDING SOLICITATION
WSB & Associates, Inc. (WSB) will attend one Met Council kick-off meeting along with
coordination with the Met Council, Mn/DOT, and the City of Shakopee during the funding
solicitation process. The previous application consisted of five (5) prioritizing criteria that were
used to evaluate the projects. The 2007 Federal Fund solicitation prioritizing criteria have been
revised and expanded to 12 prioritizing criteria. WSB's work on the federal funding solicitation
will include:
1. Preparation of written responses to the qualifying and prioritizing criteria in the
application.
2. Data collection and analysis for preparing responses.
3. Preparation of exhibits to be included in the application.
4. Review and revisions of draft document.
5. Request for letters of support from other agencies.
WSB assumes that two (2) additional meetings with City staffwill be necessary.
MnlDOT COOPERATIVE AGREEMENT FUNDING SUPPORT
WSB will meet and coordinate with Mn/DOT State Aid office to begin the process for building
support for future Mn/DOT cooperative agreement funding solicitation in 2010 for both bridges.
WSB will facilitate meetings, cost estimates, and supporting documents to justify future
Mn/DOT Cooperative Agreement funding for 2011- 2012 construction.
EXPLORING ADDITIONAL FUNDING SOURCES
The Dean Lake Bridge and trail project may be eligible for additional funding through the DNR
local Trail Connections Program. WSB will contact and meet with the DNR to discuss the
project and determine its probability for DNR eligibility funding. WSB will prepare trail exhibits
and meeting minutes. This scope of work does not include the costs for soliciting funding
application preparation of a DNR funding submittal.
The proposed pedestrian bridge along the east side of CR 77 may require some roadway and
embankment construction improvements to construct the trail that may be eligible for County
participation. WSB will explore funding opportunities with the County for the TH 77 trail
connections.

SOLICITATION PROCESS TO OBTAIN FEDERAL FUNDING FROM THE SURFACE
TRANSPORTATION PROGRAM, CONGESTION MITIGATION AIR QUALITY
IMPROVEMENT PROGRAM, TRANSPORTATION ENHANCEMENTS PROGRAM,
AND BRIDGE IMPROVEMENT AND REPLACEMENT PROGRAM
The purpose of this notice is to request the submittal of projects or programs to be funded by the
Surface Transportation Program (STP), the Congestion Mitigation/Air Quality Improvemenl
Program (CMAQ), the Transportation Enhancements Program (TEP) and Bridge Improvement
and Replacement Program of Title I of the SAFETEA-LU.
The Transportation Advisory Board and Metropolitan Council will award approximately $80
million from the STP-Urban Guarantee program, $50 million from the CMAQ program and $15
million from the TEP to projects and programs in the seven-county metropolitan area. The local
Bridge Improvement or Replacement program will award approximately $9 million. These
funds will be allocated to the region in 2011 and 2012. The amount of funds available in these
programs is based on the funding levels established by SAFETEA-LU. Prior to selecting
projects, the funding level will be reviewed to ensure fiscal balance of the Transportation
Improvement Program.
The selected projects and programs will be programmed for construction or implementation in
2011 and 2012 as part of the region's Transportation Improvement Program (TIP) for 2009-
2012. The 2009-'2012 TIP will be drafted in March 2008 and adopted by the TAB in September
2008. Notification of applicants "to proceed" is anticipated to occur in November or December
of2008.
The solicitation packages describe projects and programs that are eligible for funding under the
four federal programs. To view and download the 2007 Regional Solicitation and appendices,
visit the Metropolitan Council's Regional Solicitation webpage:

available through the Council Data Center (651-602-1140). Project applications must be
received or postmarked by 5:00 p.m. on July 20,2007, and should be mailed or delivered to
Kevin Roggenbuck, Transportation Advisory Board Coordinator, 390 Robert Street North, St.
Paul, MN 55101-1805. The project information sheet must also be submitted electronically by
the same time.
Under the STP, projects can be submitted in one of three major categories:
1) non-freeway, principal arterial highways;
2) projects on the "A" Minor Arterial Highway System;
3) bicycle and pedestrian projects.
Under the CMAQ category, there are two subcategories: 1) transit expansion, and 2)
transportation system management. The program emphasizes the air quality benefit of the
project or program. The TAB will determine if any CMAQ projects will be funded with STP
funds at the conclusion ofthe solicitation process.
Under the TEP, there are twelve qualifying eligible activities. For this solicitation those twelve
activities have been grouped into three subcategories: 1) scenic and environmental, 2) bicycle
and pedestrian, and 3) historic and archaeological. Projects must be submitted in one of those
three subcategories.
Only highway bridges are eligible under the bridge improvement and replacement program.
Metropolitan Council and TAB staffwill host an information forum open to the public and to
potential applicants at 8:30 a.m. on June 22, 2007 in the Council Offices. Staffwill give an
overview of the program policies and qualifying and prioritizing criteria, and will respond to any
questions from potential applicants. More details on this workshop will be available on the
Council's solicitation webpage.
Also for your information, the Minnesota Department of Transportation (MnDOT), Metropolitan
Division has recently requested submittals for Rail Crossing Safety projects and Highway Safety
Improvement Program (HSIP) which replaces the Hazard Elimination Safety project solicitation.
MnDOT mailed information on these processes to all potential applicants. These projects will
also be included in the 2009-2012 TIP.
