2007 River District Sewer Improvements, Project No. 2007-1

INTRODUCTION:
Attached is Resolution No. 6624 which accepts the bids and awards a contract for the 2007 River
District Sewer Improvements, Project No. 2007-1.
BACKGROUND:
On May 15, 2007, City Council adopted Resolution No. 6611, which approved the plans and
specifications and authorized staff to advertise for bids for the 2007 River District Sewer
Improvements, Project No. 2007-1.
On June 12, 2007, a bid opening was held for the 2007 River District Sewer Improvements, in
which there were (2) bids opened for this improvement project. The bids are summarized in the
attached resolution. From the bid opening, the low bidder is S.M. Hentges & Sons, Inc. with a
total bid of $967,797.89. The Engineer's estimate for this project is $1,480,000.00.
The feasibility study for the 2007 River District Sewer Improvements contained a construction
cost estimate of approximately $1,713,000.00 and a project cost estimate of approximately
$2,141,000.00. Adding a 5% contingency and 25% project costs to the actual low bid the
projected project cost is approximately $1,270,234.73, which is below the estimated project cost
in the feasibility study for the 2007 River District Sewer Improvements.
Project costs will be paid out of the Sanitary Sewer Enterprise Fund.
ALTERNATIVES:
1. Accept the low bid of S.M. Hentges & Sons, Inc. and adopt Resolution No. 6624.
2. Reject the low bidder and award to another bidder.
3. Reject all bids and rebid.
4. Approve a 5% contingency amount on this project for use by the City Engineer in
authorizing change orders or quantity adjustments on this project.
5. Authorize the appropriate City officials to execute an extension agreement with
Bonestroo, Inc. to perform construction services on the 2007 River District Sewer
Improvements.
6. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1, No.4 and No.5 in order for this project to be constructed in
2007.
ACTION REOUESTED:
1. Offer Resolution No. 6624, A Resolution Accepting Bids on the 2007 River District
Sewer Improvements, Project No. 2007-1 and move its adoption.
2. Approve a 5% contingency amount on this project for use by the City Engineer in
authorizing change orders or quantity adjustments on this project.
3. Authorize the appropriate City officials to execute an extension agreement with
Bonestroo, Inc. to perform construction services on the 2007 River District Sewer
Improvements.

WHEREAS, it appears that S.M. Hentges & Sons, Inc., P.O. Box 69, Jordan, MN 55352 is
the lowest responsible bidder for the 2007 River District Sewer Improvements
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEUU(OPEE,NUNNESOTA:
1. The appropriate City officials are hereby authorized and directed to enter into a
contract with S.M. Hentges & Sons, Inc. in the name of the City of Shakopee for the 2007 River
District Sewer Improvements Project according to the plans and specifications therefore approved
by the City Council and on file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all bidders
the deposits made with their bids, except that the deposits of the successful bidder and the next
lowest bidder shall be retained until a contract has been signed.

AGREEMENT EXTENSION NO. ~
This Agreement Extension No.8, effective on May 22 , 2007 extends an Agreement effective on
January 2, 2007 ("Prime Agreement") between the City of Shakopee, MN ("City") and Bonestroo, Inc, (as
successor to Bonestroo, Rosene, Anderlik & Associates, Inc.) ("Consultant") to include professional services in
connection with the City's River District sewer improvements ("Project"). Bids for the Project are scheduled to
be received on June 12, 2007. City and Consultant agree as follows.
1. Consultant will assist City with construction phase services as outlined in Exhibit A.
2. For completion of Exhibit A Basic Services for the Project, City will pay Consultant on an hourly basis plus
Reimbursable Expenses. The cost is estimated at $75,000 - $85,000, which includes estimated mileage
expenses.
3. For Additional Services (defined as services authorized by the City and performed by the Consultant, which
are not included in Basic Services), the City will pay the Consultant on an hourly basis in accordance with
Exhibit B plus expenses.
Except as modified herein, all terms of the Prime Agreement remain unchanged.

Scope of Consultant's Basic Services
2007 River District Sewer Improvements
City of Shakopee Project No. 2007-1
Construction Administration/Engineering -This task includes phone calls with the City on an as-needed
basis to provide technical consultation on aspects of the Project during construction and
attendance at up to five progress meetings. Site visits (other than for survey staking) requested
by the City will be provided and billed as Additional Services.
The City, and not Consultant, is responsible for project management of the construction
Project, Project scheduling, construction observationlinspection, and coordination and
submittal of pay requests.
Construction Staking - Consultant will provide a survey crew to perform construction staking for this
Project including sanitary sewer, sewer services, storm sewer, and trails. The crew will
coordinate with the on-site City inspector, endeavoring to provide construction staking in a
timely and efficient manner. Staking will be performed as detailed in the Project Management
and Coordination section of the Project Manual.
Record Drawings - Upon completion of the project, Consultant will prepare the final record drawings,
based on the field information provided by the City inspector. Prior to submitting paper and
electronic files, photocopies of the drawings will be submitted to the City for review and
approval.
