Request of Insituform Technoligies for Extending Work Hours 7. c.1 J CITY OF SHAKOPEE CONSEr~T Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Jeff Weyandt, Assistant City Engineer SUBJECT: Request of Insituform Technologies for Extending Work Hours DATE: June 19,2007 INTRODUCTION: Insituform Technologies, Inc., the contractor for the MCES Interceptor Lining Project, has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, be suspended for certain work hours. BACKGROUND: The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays. Insituform Technologies, Inc. is requesting a suspension on the hours to allow for work 24 hours a day, 7 days a week for a period of 7 weeks starting June 18,2007 and ending August 3, 2007. This request is being made because the lining process requires an over-night cure time so the crew will install the liner during normal working hours and the line will cure out at night. Some minor digging will also take place after normal working hours when traffic is lower. The cleaning process will require some weekend hours to allow for cleaning during lower flows. The work will take place in an industrial area south of C.R. 101 and east of CSAH 83. Due to the nature of this proj ect, additional requests for the extension of working hours may be made by the contractor. Taking into consideration that the work is being performed in an industrial area, staff is requesting that Council grant the appropriate City officials the authority to process additional working hour requests. Staff would recommend that if the suspension of hours is granted, that the approval is subject to the following conditions: 1. Approval is contingent upon minimizing noise exposure. 2. If property owner complaints are received by the City, the suspension can be revoked at the discretion of the City Engineer. If Council approves the suspension, a public notice to meet the City Code requirements and notice such as a news release would be placed in the Shakopee Valley News. ALTERNATIVES: 1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. 2. Grant the Public Works Director the authority to process additional working hour requests for this project, if necessary. 3. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, for some other period of time as determined appropriate by the City Council, and direct staff to publish notice of the suspension terms. 4. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D. RECOMMENDATION: Staff recommends Alternative's No.1 and No.2. ACTION REOUESTED: 1. Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo, and direct staff to publish notice of the suspension terms with the conditions as recommended by staff. 2.
