SUBJECT: Staff Determination Regarding Additional Sidewalk at Best Buy

INTRODUCTION
City staff, in their review of the Best Buy building permit, listed as one of the conditions of approval that the
applicant shall provide a sidewalk from Old Carriage Court North to the applicant's proposed walk leading
to the front entrance of the Best Buy building, utilizing the 10 foot wide island centered off the front
entrance, and that this plan shall be submitted prior to installation of the parking lot/curbing, and
landscaping.
Mr. Steven Soltau, representative of Shakopee Crossings Limited Partnership, property owner, disagrees
with this condition, stating that they do not believe staff's position regarding the sidewalk request is
supported by code, due process, or good planning. Mr. Soltau requested that this item be placed on the City
Council agenda of the June 5th meeting.
DISCUSSION
It was staffs position that this sidewalk connection (approximately 100 feet of additional walk) would
provide a safe pedestrian access to the front entrance of the Best Buy building from the existing sidewalk
along Old Carriage Court North. This is a condition that has been increasingly required of major
developments, most recently the Dean Lakes development. This is an issue that has also been a topic of
discussion at the Planning Commission and City Council meetings, specifically regarding pedestrian
accesses into Crossroad Center (Cub Foods, etc.) and into Vierling Estates 1 st Addition Plat (Vierling Street,
adjacent to the Fire Station), with the belief that there should be safe pedestrian accesses provided into these
developments.
ALTERNATIVES
1. Support staff's building permit condition for providing a sidewalk connection from Old Carriage
Court North to the applicant's proposed walk leading to the front entrance of the Best Buy
building, thus retaining said condition in the building permit approval memorandum.
2. Do not support staff s building permit condition for providing a sidewalk connection from Old
Carriage Court North to the applicant's proposed walk leading to the front entrance of the Best
Buy building, and direct staff to remove said condition from the building permit approval
memorandum.
ACTION REQUESTED
Offer a motion to support staffs building permit condition for providing a sidewalk connection from Old
Carriage Court North to the applicant's proposed walk leading to the front entrance of the Best Buy
building, thus retaining said condition in the building permit approval memorandum.
