I, CITY OF SHAKOPEE MEMORANDUM To: Mayor and City Council Mark McNeill, City Administrator From: Mark Themig, Parks, Recreation, and Facilities Director Meeting Date: June 5, 2007 Subject: Draft Huber Park Rental and Use Policy INTRODUCTION This agenda item seeks feedback and direction from City Council on draft rental and use policies for Huber Park. The intent of this agenda item is to take the feedback and direction, make modifications, and bring back a final use policy along with the fee schedule amendment at the June 19 City Council meeting. BACKGROUND AND DISCUSSION Attached are draft Huber Park rental and use policies for Council to review and provide feedback and direction. Although we had inquiries on both small rentals and large, all- day music festivals for this summer, due to our workload and trying to complete our ongoing projects, it was our intent to defer any rentals until after the grand opening and our -20 city-sponsored concerts this season. After these activities, we would take our experience we gained on how the park functioned and proceed with developing rental policies for rentals that would begin in 2008. However, Clr. Lehman has requested that we prepare an interim "limited use" rental policy that would accommodate smaller rentals for this summer, giving us additional experience for finalizing policies and establishing special use permits for larger events scheduled for 2008. As a result, we have gathered information from other organizations, consulted with the City Attorney on the content that we can and can not restrict, and prepared the attached draft policies. If adopted, the intent would be to monitor and revise the rental policies later this year after we gain more experience from this summer. The following is a general overview of some of the considerations that went into the draft policies, with more comments for discussion included with select policies on the attached sheets. I do want to note that due to our existing work load involved in the completion of the projects underway (some of which have considerable issues with delays) and activity involved with the start of summer programs, our time available to work on these policies was very limited and they are in very rough draft form. Q. What type of rentals to de we anticipate? A. So far this year, we have had inquiries about: . Single event music rentals, including associated picnics. . A ~ day Christian rock festival that was held last year in Memorial Park (Livingston). . A full-day musical benefit for abuse victims (Rage Against Abuse), with concessions and other vendors. . A picnic on the performance stage by a local bank. The one type of request that we anticipate getting in the future as the park nears completion is for weddings and receptions. Outdoor weddings are fairly popular and are frequently held at Murphy's Landing and the gazebo in downtown Chaska are popular locations. Huber Park could be an ideal site for weddings. In addition, we anticipate future rentals for other kinds of music, theater, and performance arts. Q. How would we accommodate picnics/receptions since the picnic shelter was cut from the project? A. We have proposed a solution for your consideration that would involve a tent, table, and chair rental package that would be available through the City by working with Total Rental. This would provide a sheltered seating area, but on a temporary basis. All costs for rental would be the responsibility of the renter. We don't believe that picnics should be held on the performance stage, and the storage room in the support building is designed for storage and performer preparation area, not occupancy by groups for picnics. If Council was interested in accommodating picnics/receptions, we would need to confirm pricing and packages with Total Rental. Q. What did we use for the basis of the draft policies? A. Wigington Pavilion on Harriet Island is located across the Mississippi River from downtown Saint Paul. It is a beautiful 5,000 square foot historic building that is used as a private rental facility. The spectacular view of downtown and the paddleboats creates and exceptional location for weddings, company picnics, large corporate holiday parties and is the home of many music festivals throughout the summer. Harriet Island is a great location for events of 50 to 50,000 guests. The pavilion is an accessible building, offers limited free parking, and is heated making it a year-round rental facility. Before choosing the Clarence W. Wigington Pavilion for your event, please consider the following: Reservations are made on a first-come first-serve basis, however in person reservations are honored before phone reservations for same day requests. Non-residents may apply the first day of the month, 12 months in advance. City of Saint Paul residents may apply the first business day of the month, 13 months in advance of their desired date: . RENTAL RATES Below are the rental rates for events held in 2007. All events are subject to Park Staff review and Park Staff will determine what tier your event is in by the impact to the park, number of guests, the length of event, space/facilities required, and activities. Rental rates are guaranteed for the year your event is held only; this permit does not specify the correct rate for events beyond 2007. TIER 1 $50.00/hour Monday - Thursday Includes: use of picnic tables and bathrooms, does NOT include access to pavilion. Please note that setup time mayor may not be included in length of event above. No event may end later than 12:00am with a one hour cleanup until 1:00am. During clean up/teardown no liquor may be served and no music may be played. Cleanup must be completed and the facility vacated by end of specified cleanup/teardown time. Evening weekend rentals may begin set-up at 11:00am, this will be discussed during the final meeting. A building attendant will be on site during setup and until cleanup is finished Revised: December 4, 2006 Security A St. Paul Police officer will be required for all private events, regardless if liquor is served or not. The rate is $40.00 per hour (*subject to increase) with a minimum of four hours. An officer must be on site the entire duration of your event, beginning when your guests arrive to when they leave. At least one officer is required for every 250 people. Additional security may be required depending on the nature of the event and number of bar locations. Park staff will arrange coverage with off duty officers; you may not use family or friends for this position. At the final meeting a check is collected for the officer, payable directly to the officer. Serving Alcoholic Beverages · No liquor may be brought in by the client or guests. · Liquor may be hosted (open bar) or a cash bar may be used. A St. Paul licensed bartender or beverage service must be hired. A list of licensed providers can be obtained from Parks Staff. · No alcoholic beverages may be served before or after event hours. Failure to comply may result in the organization's security deposit being withheld and the use or future use of the facility being denied. 1. The Amphitheater is not available for the following purposes: . Commercial uses. . Fundraising activities. . Individual political candidates or partisan political activities. . Businesses needing to hold private stockholder type meetings. . Club meetings or installation ceremonies that have secret rituals. . Religious services or other religious purposes, except for weddings. . Classes or demonstrations involving the use of hazardous materials and/or weapons. . The Village does not supply space for groups needing a place to store their supplies or equipment. 5. Adult sponsors/chaperones, who shall be held responsible for compliance with this Policy, must attend events or programs where individuals under 18 years of age will be present. One (1) adult for every five (5) persons under the age of 18 is required. These adult sponsors/chaperones also assume responsibility for the group and its activities. 11. No physical changes are permitted to be made to the Amphitheater and its surroundings. 12. No furniture or equipment other than that already available in the immediate area will be provided. 13. No additional furniture or equipment may be used without prior approval of the Village Administrator or his/her designee. 14. Nails, tacks, tape, etc. and the hanging, tacking, and/or posting of flyers, signs, and/or posters on the Amphitheater, trees, etc. are prohibited. 15. All activities taking place in the Amphitheater must be open to the public and all citizens, regardless of age, sex, race, religion, national origin, or disability. Groups using the space must comply with the Americans with Disabilities Act and it is the responsibility of the group to provide any and all reasonable accommodations for persons with disabilities in accordance with the Americans with Disabilities Act. 16. Groups are responsible for set up and cleanup of the Amphitheater, surrounding area, and other areas utilized by the group. 17. Children must be supervised at all times and no user may use the Amphitheater solely for babysitting purposes. 18. Groups are permitted to utilize the Amphitheater a maximum of two (2) times per month. 19. Groups wishing to post directional signage for events or programs may display the necessary signage on easels. Groups that wish to post directional signage must provide the signage and easels. 20. Animals (i.e. petting zoos, caged animals, etc.) are not permitted except for dogs assisting the disabled. Dogs being walked through the park must comply with all applicable Village ordinances. 21. No admission charge, collections (except for regular club dues or to cover expenses for materials used at the event or program) or other money raising activities may be attached to events and programs conducted in the Amphitheater, unless all proceeds go to the Village. 22. Groups using the Amphitheater are prohibited from selling food and beverages. 23. Groups are prohibited from bringing and using grills and other cooking appliances in the Amphitheater and the surrounding area. 24. Groups using the Amphitheater are entitled to exclusive use of the Amphitheater only. Groups cannot prohibit others from using the Park during the time reserved. 25. The Amphitheater must be left clean and in good condition. All refuse must be disposed of properly in the containers provided. Failure to leave the facility in proper order will result in the forfeiture of the group's security deposit and/or denial of future requests to use the Amphitheater. 26. Each organization/group, using the Amphitheater, is responsible for reimbursing the Village for any and all damage done or presumed to have been done to Village owned furniture, equipment, and/or the 8/5/2003 facility. The Village reserves the right to limit or prohibit future use of the Amphitheater by groups that have caused damage to the facility or that have caused a disturbance and/or failed to comply with the rules established by the Village. 27. Groups shall abide by all local and state fire and health regulations, when using the Amphitheater. 28. The Village Administrator or his/her designee is the person empowered to make decisions regarding the availability, use, and approval of Amphitheater Applications. Requests for exceptions to the above rules, regulations, and policies must be submitted in writing to the Village Administrator or his/her designee. Reservations The Amphitheater is available for reservations from April 1 through November 1, seven (7) days a week, from 12:00-10:00 p.m. 1. Reservations are required for the Amphitheater. 2. All reservations are subject to Amphitheater and park availability, on a first come, first serve basis. 3. Groups interested in applying for a reservation are encouraged to acquaint themselves with the Amphitheater and the rules of use prior to completing a reservation application form. 4. Groups wishing to reserve the Amphitheater must complete the required application. 5. Applications for reservations are accepted up to six (6) months in advance of the event or program date. 6. The Amphitheater must be requested for a minimum of two hours. 7. Reservation times must reflect the group's set up and cleanup time. 8. Applications must be submitted to the Village of Plainfield's Management Services Department. 9. The proper certificate of insurance and fees (rental fee and security deposit) must be submitted at the time of application. Fees may be paid in the form of cash or check made payable to the Village of Plainfield. All fees will be returned for reservations that are denied. 10. Reservations must be applied for at least ten (10) days in advance of the potential event or program. 11. Application does not guarantee approval of Amphitheater requests. 12. Once an application has been submitted, the Village will then approve or deny the application. Groups will be notified of approval or denial by fax or e-mail within three (3) business days. 13. Reservations must be applied for by a member of the interested organization, who is 21 years of age or older. This individual will be the only person authorized to make changes to the reservation and will also serve as the primary contact for the Village. 14. Groups must vacate the Amphitheater by the time specified on the application. 15. Groups may not assign their reservation to another group. 16. Groups who would like to cancel their reservation must notify the Village's Management Services Department as soon as possible. Cancellation notices shall be in writing and may not be rescinded later. Telephone cancellations will be accepted in cases of last minute emergencies. If a cancellation is made within ten (10) days of the scheduled event, the group will forfeit 50% of their rental fee. If the Amphitheater is not used and a cancellation notice is not given to the Village, the group may forfeit 100% ofthe rental fee and/or future use of the Amphitheater may be suspended. 17. All approved events will require a permit. Permits will be issued via fax or in person, once the event is approved and all required fees and the certificate of insurance are received. 18. The Village reserves the right to preempt or cancel events or programs, if an emergency arises. If this occurs, reasonable effort will be made to promptly contact the group (via phone, fax, or e-mail) and reschedule the reservation. If this is not possible, the group will be notified and the fees refunded. 19. Amphitheater reservations give the reservation holder exclusive use of the Amphitheater only. All other Settlers' Park facilities are open to the public. 20. Groups that violate policies, fail to properly clean up their site, cause damage to facilities, are larger than arranged for, or are misleading in their application are subject to the loss of their security deposit and/or future rental privileges. 8/5/2003 21.
