A. ~, POLICE DEPARTMENT CONSEtiT Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Captain Jeff Tate$- SUBJECT: Animal Control Contract DATE: May 24, 2007 INTRODUCTION: The current animal control contract for the City expired on March 31, 2007. The police department has continued to use the services of 4 PAWS Animal Control/LLC during this time. The police department is asking council to enter into a two-year agreement with 4 PAWS Animal Control/LLC, to continue as the City's animal control service provider. BACKGROUND: The police department recently received two proposals for our animal control services. Minnesota Critter Getters and 4 PAWS submitted proposals, which were reviewed by department staff. It is the recommendation of the police department to continue with 4 PAWS for the City's animal control services. 4 PAWS maintains an office much closer for Shakopee residents to retrieve their animals than Minnesota Critter Getters. Along with convenience, the police department feels that the level of service received from 4 PAWS has been satisfactory. 4 Paws will charge the City $2,600.00 per month for their services during the two-year contract. Minnesota Critter Getters' proposal was $2,500.00 per month. Residents would have to drive to Jordan, and in the future, possibly New Prague to retrieve their animal from Minnesota Critter Getters. The City's attorney, along with Scott Hutnik of 4 PAWS, has reviewed the proposed contract. The contract and proposals are attached. BUDGET IMPACT: The proposal from 4 PAWS of $2,600.00 per month is $445.00 per month and $5,340.00 per year less than what the department had budgeted for in 2007 for animal control. Under this agreement, the City would also budget $2,600.00 a month for the remainder of contract. VISIONING RELATIONSHIP: This action supports: Goal B - High Quality of life. Strategy 6: Provide high quality services RECOMMENDATION: Staff recommends the City enter into a two-year agreement with 4 PAWS Animal Control/LLC for the City's animal control services at a rate of $2,600.00 per month. ACTION REQUESTED: The City Council, if they concur, should by motion enter into a two-year agreement with 4 PAWS Animal Control/LLC for the City's Animal Control Services. Attachments 1) Agreement For Animal Control Services 2) ProposallBid From 4 PAWS Animal Control/LLC AGREEMENT FOR ANIMAL CONTROL SERVICES This Agreement for animal control services ("Agreement") is made on the 5th day of June, 2007 between the City of Shakopee, Minnesota, a Minnesota municipal corporation (hereinafter "City"), whose address is 129 S, Holmes Street, Shakopee, MN 55379 and 4 Paws Animal Control, LLC, a Minnesota limited liability company (hereinafter "4 Paws") whose address is 520 Harold Drive, Burnsville, MN 55337. PRELIMINARY 5T A TEMENT The City has adopted a policy regarding the selection and hiring of consultants to provide a variety of services for City projects. That policy requires that persons, firms or corporations providing such services enter into written agreements with the City. The purpose of this agreement is to set forth the terms and conditions under which 4 Paws will provide animal control services and act as the Animal Control Officer for the City, hereinafter referred to as the "Work." RECITALS WHEREAS, the City requires the services of an animal control officer for public safety reasons; and WHEREAS, the City's Agreement with its current animal control officer will terminate on March 31, 2007; and WHEREAS, the City issued a letter requesting quotations for animal control services to two vendors; and WHEREAS, the two vendors submitted proposals and were interviewed by the City: Minnesota Critter Getters, and 4 Paws; and WHEREAS, the City reviewed both proposals and recommended that 4 Paws be selected to serve as the animal control officer; and NOW, THEREFORE, based on the mutual promises and consideration provided for herein, the sufficiency of which is not disputed, the parties agree as follows: 1. Contract Documents. The "Contract Documents" consist of this Agreement and 4 Paws' Proposal/Bid for Providing Animal Control Service (which is attached as Exhibit A to this Agreement). These documents form the Agreement and all are as fully a part of the Agreement as if attached to this Agreement or repeated herein. If anything in the Contract Documents is inconsistent with this Agreement, this Agreement shall govern. 2. Scope of Work. 4 Paws shall perform all the work as set forth in and required by the Contract Documents (the "Work") all in strict accordance with the Contract Documents, including the following: a. Provide a dedicated phone line for animal control service requests. 4 Paws must answer the animal control phone line 24 hours a day, 365 days a year. 4 Paws agrees that it will return any missed calls immediately. b. Operate an animal impound facility. The facility shall be open to the public from 3:00 p.m. - 7:00 p.m. on weekdays and from 11 :00 a.m. - 12:00 p.m. on weekends. 4 Paws shall also allow animal owners and the City to schedule appointments outside of these times to drop off or retrieve an animal from the facility. 4 Paws shall also provide impound facilities for large animals (Le. horses, cows), which may be off-site from its animal impound facility. 4 Paws may charge the animal's owner for impounding an animal. c. Transport animals in need of medical treatment or euthanasia to the veterinarian. d. Pay for any veterinarian services that are incurred by the animal during the impound period (including euthanasia). 4 Paws may require the animal's owner to reimburse it for these services. However, under no circumstances shall the City be responsible for payment of these services. e. Send or give notification to animal's owner that his or her animal has been brought in or picked up (when the owner is known). Notification shall be within 24 hours of receipt of the animal by 4 Paws. f. Pick up and dispose of dead animals on City roads and property. 4 Paws shall be responsible for any disposal costs, g. Provide the City with at least 8 additional hours per month of animal control patrol services. h. Respond to all emergencies within the City involving animals, I. Quarantine animals in the impound facility when required by the City. 4 Paws may charge the animal's owner for these services. j. Provide the City with a monthly report of all animal control enforcement activities that occurred during that month, including: incident information, animal owner information, final disposition of the animal and any fees collected. k. Pick up sick or injured wild animals. I. Collect any license or other fees on behalf of the City from owners. These fees shall be remitted by 4 Paws to the City on a monthly basis, no later than the last day of the month. m. Transport unclaimed animals to a shelter or to a veterinarian for euthanasia. n. Pick up nuisance domestic animals that are in violation of the City's ordinances. 3. City's Responsibilities. The City agrees to the following: a. Access to Property. Depending on the nature of the Work, 4 Paws may from time to time require access to public or private property. The City shall obtain access to and make all provisions for 4 Paws to enter upon the property as required for 4 Paws to perform such services necessary to complete the Work. b. Consideration of the Work. The City shall give thorough consideration to all reports and other documents presented by 4 Paws, and shall inform 4 Paws of all decisions required of City within a reasonable time so as not to delay the work of 4 Paws. c. City's Representative. The Police Chief, or his or her designee, shall be responsible for communicating with 4 Paws with respect to the Work to be performed under this Agreement. The Police Chief or his or her designee, shall have the complete authority to transmit instructions, receive information, interpret, and define the City's policy and decisions with respect to the Work. 4. Term. The term of this Agreement is from June 5, 2007 to March 31,2009. 5. Compensation for Services. The City agrees to pay 4 Paws $2,600/month for the period June 5, 2007, to March 31, 2009. This amount shall include all services set forth above and in the Contract Documents. 4 Paws shall invoice the City on a monthly basis for the preceding month's compensation. The invoice will be paid by th~ City within thirty days of receipt. Any work to be performed by 4 Paws that exceeds the scope of Work as described in this Agreement and defined in the Contract Document shall be requested by 4 Paws in writing and shall require prior written approval by the City. The City will not pay 4 Paws additional compensation for additional work that does not have prior written authorization. 6. Audit Disclosure. 4 Paws shall allow the City or its duly authorized agents reasonable access to such of 4 Paws' books and records as are pertinent to all services provided under this Agreement. Any reports, information, data, etc. given to, or prepared or assembled by 4 Paws pursuant to this Agreement which the City requests to be kept confidential shall not be made available to any individual or organization without the City's prior written approval. All finished or unfinished documents, data, photographs, and reports prepared by 4 Paws shall become the property of the City upon termination of this Agreement, but 4 Paws may retain copies of such documents as records of the services provided. 7. Termination. This Agreement may be terminated by either party by thirty days written notice delivered to the other party at the address written above. Upon termination under this provision, if there is no breach of any of the terms of this Agreement by 4 Paws, the City shall pay 4 Paws a prorated amount of its monthly service charge up until the date of termination. If however, the City terminates the Agreement because, in the City's opinion, 4 Paws has failed to perform in accordance with the terms of this Agreement, no further payment to 4 Paws shall be required. 8. Subcontractors. 4 Paws shall not enter into subcontracts for services provided under this Agreement except as noted in the Contract Documents, without the express written consent of the City. 4 Paws shall pay any subcontractor involved in the performance of this Agreement within ten days of 4 Paws' receipt of payment by the City for undisputed services provided by the subcontractor. 9. Independent Contractor. At all times and for all purposes herein, 4 Paws is an independent contractor and none of its employees shall be considered employees of the City. The City shall not assume any liability and shall not be responsible for the direct payment of any of salary, wage, workers' compensation, income tax withholding and health insurance or any other type of compensation to any 4 Paws employee. 10. Non-Discrimination. During the performance of this Agreement, 4 Paws shall not discriminate against any employee or applicant for employment because of race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance, disability, or age. 4 Paws shall post in places available to employees and applicants for employment, notices setting forth the provision of this non- discrimination clause and stating that all qualified applicants will receive consideration for employment. 11. Assianment. Neither party shall assign this Agreement, or any interest arising herein, without the written consent of the other party. 12. Compliance with Laws and Reaulations. In providing services hereunder, 4 Paws shall abide by all statutes, ordinances, rules and regulations pertaining to the provisions of services to be provided. 4 Paws represents that its impound facility is properly licensed by the State of Minnesota and is maintained in compliance with all federal, state and local laws. 4 Paws and City, together with their respective agents and employees, specifically agree to abide by the provisions of the Minnesota Data Practices Act, Minnesota Statutes Chapter 13, as amended, and the Minnesota Rules promulgated pursuant to Chapter 13. Any violation of statutes, ordinances, rules and regulations pertaining to the Work by 4 Paws shall constitute a material breach of this Agreement and entitle the City to be able to immediately terminate this Agreement. 13. Waiver. Any waiver by either party of a breach of any provisions of this Agreement shall not affect, in any respect, the validity of the remainder of this Agreement. 14. Indemnification. 4 Paws agrees to defend, indemnify and hold the City, its officials, agents and employees harmless from any claims brought or actions filed against the City for property damage, bodily injury or death arising out of or relating to the 4 Paws' work pursuant to this Agreement, including from and against all losses incurred by the City by reason ofthe failure of 4 Paws to fully to perform, in any respect, any of its obligations pursuant to this Agreement. 15. Insurance. A. General Liabilitv. During the term of this Agreement, 4 Paws shall maintain a commercial general liability insurance policy with a limit of not less than $1,000,000 each occurrence. The policy shall cover liability arising from premises, operations, independent contractors, personal injury and contractually-assumed liability. The City shall be named as an additional insured under the policy. B. Worker's Compensation. 4 Paws shall provide a certificate of insurance showing evidence of workers' compensation coverage or provide evidence of qualification as a se1f-insurer of workers' compensation. C. Automobile Liabilitv. Throughout the term of this Agreement, 4 Paws shall maintain automobile liability insurance, and if necessary, umbrella liability insurance with a limit of not less than $1,000,000 each accident. The insurance shall cover liability arising out of 4 Paws' patrol vehicles, and any other auto, including owned, hired, and non-owned autos. Certificates of insurance for all insurance policies required above shall be filed with the City prior to the commencement of the Work. The certificates and the required insurance policies shall contain provisions that the coverage will not be canceled or allowed to expire until at least 30 days' prior written notice has been given to the City. 16. Entire AQreement. The entire agreement of the parties is contained herein. This Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter hereof as well as any previous agreements presently in effect between the parties relating to the subject matter hereof. Any alterations, amendments, deletions, or waivers of the provisions of this Agreement shall be valid only when expressed in writing and duly signed by the parties, unless otherwise provided herein. 17. Governina Law. This Agreement shall be controlled by the laws of the State of Minnesota. 18. Severabilitv . The provisions of this Agreement are severable. If any portion hereof is, for any reason, held by a court of competent jurisdiction to be contrary to law, such decision shall not affect the remaining provisions of this Agreement. We do use a dedicated phone line for animal control for the Scott County area. We also use several cell phones to provide back-up service for our land lines. CaUs are automatically forwarded to cell phones whenever we leave the pound orof- fice. We want to make sure that we are available to answer every can for the conve- nienceof callers and to facilitate a rapid response. 2. Wi/lthe phone number be answetedby a human between 7 a. m. and 6 p.m. Mtmdaythrough Friday, and 10 s,Im. - 4 p.m. Saturday and Sunday? Our phones are answered by a real-liVe person, 24 houtS per day, 365 days a year. That way, after getting all pertinent information from the caUer, we can re.. spond immediately -while some of the other animal control guYs are still waiting for one of their people to listen to their messages. For us, that delay is unacceptable. we also believe that catters are friJstrated when they are not able to talk to a human. We take the time to assure the caller that we understand the problem and that we are responding right away. 3. How is telephone se/Vice provided for the following: a. after hours? When it comes to animal probl.ems there aren't any "after hours." That's why we work 24 hours per day, every day. And that's why our phones are answered at all hours. We respond in person to every call at all times. b. holidays? Animal problems occur every day, even holidays. In fact more calls are ex- pected on hOlidays because more owners are home and more complainants are home. An animal will act like an animal every day, even holidays. We answer our phones and respond in person 24 hours per day, every day of the year, even holidays. c. when the pbone isbusyP We have several phone company "features" to enhance our phone service to make sure we get our calls. We have call waiting to let us know when another call is coming in and we ate on the line. Whenever possible we politely bring our first call to an end or ask to put the first caller on hold to check on the nature of the second call. If it isn't a call that requires immediate attention we return to the first caller and com- plete that call. When we leave the office our calls are automatically forwarded to a cell phone and just to be sure we also forward our calls to another cell phone. That way the first call rings to the first cell phone and if we are already on the line and we can't break away for the call waiting signalr the call will go to the second cell phone number. If we just can't break away from the first call for the second call then we do have voice messaging on all phones just in case. 4. Will callbacks be made within 30 minutes of the initial call after houn or in the event of a busy signal? Ifwe do miss a call it is because we were not able to break away from our origi- nal caller in a polite manner. In that case voice messaging immediately notifies us that there is a message (w.e would be aware of the message because of the call waiting no- tification as well). If a caller leaves a numbet or if the number is on caller id, we will return calls immediately. 5. Where will animals be btJarded forpickup by DwneT$? ' We do operate 001" Own impound facility. Our pound is a dean and safe place for lost pets to wait for their owners to come looking for them and bring them home. Many of our Visiting owners comment on how clean our facility is- and how relieved they are, after having had dealings with the County's previous animal service. Several owners have caned back later and asked if our pound was available for boarding for their pets. The Chief of Police in Jordan has boarded hiS dog at our pound a couple of times. 6. Describe the boarding facility, its capacity, amenities ant/location. When is tile facility open /br pick up? Our Scott County pound is located at 12848 Chestnut Blvd., just off the HWV , 169 and County Road 41/78 intersection. . Our pound is open from 3pm until 7pm on weekdays and until noon on week- ends. In addition we are always Willing, within reason, to schedule a time to meet ani- mal owners after or before hours to release an animal. Our facility and 001' procedures are designed to proVide our animals with a pleasant experience .during their time at the dog pound. All of our dog kennels are at least 25 square feet in size and we do have areas for the dogs to get in some exercise indoQrs- as well asa playpen area for guests (we are talking about the four-legged ones, of course). 7wWill you provide in()Culationfmedical services? Please describe. Animals requiring medical services are transported to an area vet for treatment. In most cases animals are stabilized only- until an owner is located and can authorize additional treatment by the vet. In case of an after hours emergency pets would be transported to an emergency vet- jf the injuries were life threatening. We pay for all vet costs unless an owner is identified. All vet service costs would then be recovered from the animal owner. We do not give inoculations when animals arrive at the pound. In 2 years of operation we have never had any outbreaks of health problerns at the pound because we keep our facility clean and sanitized. Animals need to be seen by a vet for inocula- tionsand other health problems. We do not encourage owners to avoid visiting their local vet. Unclaimed animals, which we give to Last Hope, and the Carver/Scott County Humane Society, or any of the other shelters we work with, are given all inocu- lations and routine medical care- prior to adoption or placement in a foster home. 8. Will you provide euthanasia and disposal se/Vices? Describe your policy for infol'll1ing owners, including timelines. We use a vet for all euthanasia services. We encourage owners to bring their animals to their Owtl vet for euthanaSia and also disposal. We will transport animals to the vet for owners but we do charge owners for that service. We will provide these services for owners who just can't deal with the situation, but again, we do charge for our services as well as for the cost of the vet service. Fortunately, almost all of our unclaimed animals are given to Last Hope, the CarverlScott County Humane SOciety, or one of several shelters we work with for adoption, so our euthanasia needs are minimal. We do make use of vets for our pet disposal needs. We always try to notify owners immediately in every situation where an owner is identifiable. g~ Will YOII pick up dead al1imals of all kinds Bnd sizes (domestic, farm, wild or exotic) in the right of way Dr public property? In most cities we do pick up dead animals on on all city roads and private prop- erty under the contracts we have in use currently. Several cities did request that that service not be included. The County has a contract with a private company to remove dead animals from County roads and the state removes animals from it's roads. State regulations mandate that the "road authority" is responsible for animal pick up and re- moval. We give the road authority every opportunity to clean up dead animals on their roadways- but if they do not respond in a reasonable time and/or the animal is in a lo- cation which generates nuisance calls to dispatch at the animal is located in a high traffic area, we will remove it and dispose of it- no matter what road it is on. We Pick upsll domestic dead animals no matter where they are lo- cated. When an owner of a dead domestic animal is identified, we would make every effort to reCOver disposal costs from the owner. Farm animals would be removed if the owner cannot be identified within a rea- sonable time and depending on the location of the animal. Again we would make ev- ery effort to identify the owner so that the person ultimately responsible for the animal does pay fat the pick up and disposal costs. J.f!I. Will you provide patrol services? Can individual units of government se- lea the amount of patrol houlS desired per month? We are always willing to work with any city to set up any type of extra patrol system the city wants. Patrol and visibility are very important deterrents to would be violators and so we do encourage patrol hours in every City- but we do whatever the city asks us to do! We would be more than willing to increase our patrol hours beyond the current levels ifreque5ted to do so. 11. Wi/loWtlel'S be charged for boarding, pick up, disposal and quarantine? Absolutely! Charging these fees to owners means that we can charge the city less forthe remainder of our services. The people who use a setvice should be the ones to pay for its costs. 12. Will you provide response for public safety emergencies as identified by thecitieslcounty? Response to an emergencies involving animals would be included in our pro- posal. We respond to accidents, arrests, fires, bites, search warrants, and any other possible emergency. We also respond to remove injured and sick wild animals when there is a possibility that the animal will come into contact with humans and not run from them~ asa healthy wild animal would do. We just hope you won't cry wolf!. We have a variety of wild animals ev- erywhere around here. Healthy wild animals interact with humans in many ways and that interaction is not a public safety emergency. people who have Wild animal prob- lems need to deal with those problems on their own and within legal limits (most fur- bearing animals are protected by the State). Weare happy to !;live advice and make referrals- but we do not assist with removal of healthy wild animals. If people choose to live in Scott COllnty they will need to learn to live with the many varieties of Wild animals we are lucky enough to have Jiving here with us. Within reason and good taste, we will try to recover fees from owners whenever an owner is identifiable. 1.3. What is your procedure for dog baesindlldi/lg time/ine and /lotifica~ tiORS? A quick response in bite cases is absolutely essential. In almost every city we currently provide setvice for, the pOlice respond to bites to take an initial report be- cause they can usually respond the quickest. In most cases, the bite involves an ani- mal which is already held and our response wouJd be to pick up animals which are not current on vaccinations and hold them for quarantine for from 10 to 14 days depend- ing on theordinal'lce. If an animal is .still at large -then the police notify us and we im- mediately begin searching for the animal. If necessary, live traps would be set up. If so requested, we would respond and take reports on animal bites before be!;linning our search or impounding an animal already held for quarantine. Depending on the ordinance- quarantines are 10 to 14 days in duration. If an animal is atthe stage where he can transmit the rabies virus then it would develop symptoms within that timespan. When animals are in our pound for quarantine we watch them closely for symptoms, and we would report any symptoms to victims Im- mediately so that they could begin the shots, or so we can get the animal tested by the State Health [)epartrnent. We are authorized to submit animals for testing atthe University of Minnesota Vet Diagnostic Lab. Wild animals involved in bites, which are kI'lown as possible rabies carriers, are euthanizeclimmediately and tested for rabies. There is no effective quarantine period for wild animals. If the dog or cat passes quarantine without exhibiting any symptoms of rabies, then we would notify the pOlice department and the victim of the results at that time. Quarantines for animals with owners are at the expense of the owner and fees would be recovered. Unclaimed animals would be euthanized and disposed of by our vet. We do not give animals with bite histories to shelters for adoption. Under the terms of our proposal,. cities would not be charged anything addi~ tional for any quarantine services. Animals with Current rabies vacCinations are usually quarantined at home under strict rules. If required, we would make mid- and post quarantine inspections of the animal and report our findings immediately to the police and the victim. Quarantined animals which do not have current vaccinations and which pass quarantine will be re.- quired to be transported to a vet immediately upon release and be vaccinated for ra- bies. This would in- clude nuisance animals that may pose a threat to public safety and/or in- dude s/ckor injured wild animals that mat have access to the public. Catching nuisance domestic animals is what animal control is all about. That's why we proudly call ourselves "dogcatchers". We respond to pick up all nuisance do- mestic animals which are in violation of city codes and ordinances. But if you don't have an ordinance prohibiting an animal- say a eat- from running loose, then we can- not pick that animal up- unless it has clearly been abandoned, or is sick or .injured, or that animal poses. a clear threat to people and pets. That may be inconvenient at times- but ordinances, or the lack of an ordinance, reflects the clear wishes of the pop- ulaceand their choices must be observed. We also respond to calls to remove injured and sick wild animals when there is a possibility that the animal Will come into contact with the public and that the animal no longer has the instinct or ability to flee from people and pets, as a healthy wild ani- mal would. There is a great difference between nuisance wild animals and wild animals' which pose a threat to public safety. We do not remove healthy wild animals from an area just because they are nui- sances. A nuisance wild animal does not pose a threat to public safety. In most cases State law prohibits the removal of those animals. We have a variety of wild animals in this area and healthy wild animals interact with humans in many ways. Weare happy to give advice and make referrals but we do not assist with the removal of healthy wild animals. If you live in an area that has trees, water, open spaces, fields, swamps, or good hiding places then you have wild animals and you need to learn how to live with them. One person's nuisance wild animal is another's prized visitOr to a backyard feeder. 21. Will you provide boarding Dflarge animals such as horses, cowssnd sheep? During the last:: 10. years in Savage and now the rest of Scott County, we have been called upon to respond to "horses at large" on more than twenty occasions. We have pick:ed up, transported, and boarded more thana dozen horses. We have COr- ralled and held another dozen or two for owners to . retrieve. We contract with several farms throughout the County to keep and board horses. We have also caught and boarded .a number of goats and sheep over the years- most recently we boarded the famous Belle Plaine painted sheep last year. We have picked up a couple of dead calves on the roads over the years but we have never had to board a cow before. On ,one occasion in Prior Lake we did respond to a callef 50 to 60 cows On the loose in someones front yard. We were able to con- tain the cows and we were able to trace their path to herd them back home. Cattle herding is not an easy task when you are on foot and dealing with several dozen cows. Still it's probably alot easier than herding cats! If necessary, we do have agreements in place to board cattfeat several farms. 22. Any additional inlbnnatioR you believe is relevant to this RFP.
