CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Authorize Feasibility Report for Beckrich Park Estates and Krystal Estates Sanitary Sewer and Water Improvements DATE: May 15, 2007 INTRODUCTION: Attached is Resolution No. 6609, a resolution authorizing the preparation of a feasibility report for the extension of sanitary sewer and water to the Beckrich Park Estates and also the Krystal Estates approved subdivision. BACKGROUND: Staff has been working with Beckrich Park Estates residents for the extension of public sanitary sewer and water lines to provide municipal utility services to Beckrich Park Estates. Numerous meetings have occurred over the past few months and included with this memo is a letter from Beckrich Park Estates representatives, a petition and map showing the area to be served with sanitary and water improvements. Beckrich Park Estates residents have met on the extension of utilities in this area and there is significant support for the extension of services in this area. Extending sewer and water lines will also provide service to Krystal Estates and the developer of that subdivision would be interested in this project. Since there was not 100% unanimous support to proceed, the City will need to do a feasibility report and ultimately hold a public hearing to order the project. It would be staffs intention to have the residents who support the project, if and when the project is ordered, to sign a waiver of assessment appeal for those assessments, once those amounts are known. The petition that has been submitted by Beckrich Park Estates is to give the Council an indication of the support for this project. Per City Attorney, Jim Thomson, a sewer and water petition does not grant the property owners any advantage by submitting a petition, since the State Statute would still required a super majority vote of the Council to order the project. It is staff's understanding that the member vote of the association of Beckrich Park Estates did have 33 out of34 residents supporting the project. The action for City Council would be to consider the petition request by Beckrich Park Estates Homeowner's Association and to consider authorizing the feasibility report for the extension of sanitary sewer and water to this subdivision. It is anticipated that City staff would be able to prepare the feasibility report on this project. ALTERNATIVES: 1. Offer Resolution No. 6609, a resolution authorizing the preparation of a feasibility report for Beckrich Park Estates and Krystal Estates extension of sanitary sewer and water service and move its adoption. 2. Do not approve Resolution No. 6609. 3. Table for additional information. RECOMMENDATION: Staff would recommend Alternative No.1, to prepare a feasibility report since there was such high resident support for the project and extension of utilities would be done for Krystal Estates, as well. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the proposed improvement be referred to Bruce Loney, Public Works Director, for study and that he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.
