738 1 st Avenue East
MEETING DATE: May 15, 2007
INTRODUCTION
Fendler Patterson Construction, on behalf of Minnesota Corn Growers Association, has
requested a vacation of a portion of a public right-of-way (alley) located at 738 1 st Avenue
East (Block 7, East Shakopee plat). There presently is a 16 foot by 300 foot alley that runs
east/west thru this block, of which, the applicant requests to vacate the easterly 180 feet.
DISCUSSION
The attached resolution sets a public hearing for Tuesday, June 19, 2007. On that date,
comments from staff members and utilities, as well as a recommendation from the Planning
Commission, will be presented to the City Council for consideration. The Planning
Commission will consider the request at its June 7, 2007 meeting.
ACTION REQUESTED
Approve Resolution No. 6613, a resolution setting the public hearing date to consider the
vacation of the easterly 180 feet of the alley/public right-of-way in Block 7 of the East
Shakopee Plat. (located adjacent to 738 1st Avenue East).

RESOLUTION NO. 6613
A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE
VACATION OF THE EASTERLY 180 FEET OF THE ALLEY/PUBLIC RIGHT-
OF-WAY IN BLOCK 7 OF THE EAST SHAKOPEE PLAT, LOCATED
ADJACENT TO 738 1 ST AVENUE EAST
WHEREAS, it has been made to appear to the Shakopee City Council that the
easterly 180 feet of the alley/public right-of-way in Block 7 of the East Shakopee Plat serves
no public use or interest; and
WHEREAS, a public hearing must be held before an action to vacate can be taken
and two weeks published and posted notice thereof must be given.
WHEREAS, two weeks published notice will be given in the SHAKOPEE
V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin
board on the main floor ofthe Scott County Courthouse, the bulletin board at the U.S. Post
Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the
Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council
Chambers on the 19th day of June, 2007, at 7:00 P.M. or thereafter, on the matter of
vacating the easterly 180 feet of the alley/public right-of-way in Block 7 of the East
Shakopee Plat. (located adjacent to 738 1 st Avenue East).
Adopted in the Regular session of the City Council of the City of Shakopee,
Minnesota held the 15th day of May, 2007.
