SUBJECT: Waiver of Subdivision Criteria: 539 and 549 Market Street South

INTRODUCTION:
Mark Gergen has submitted a request for approval of a waiver of subdivision criteria for 539
and 549 Market Street South. The parcel is zoned Old Shakopee Residential (R-IC). A twin
home currently occupies on the subject property, the applicant wishes to sell both units
separately, which will require a minor subdivision to create individual parcels for each
dwelling unit. The applicant is requesting that the side yard setback be waived in order to
allow a zero side yard setback for the lot line along the common boundary of the twin home
unit.
The applicant states that the structure was built to the standards of a twin home. All other
setbacks to adjacent properties meet the current standards ofthe Rl C Zoning District.
AL TERNATIVES:
1) Approve the requested waiver of subdivision criteria for sideyard setback in the R-IC
Zone to allow a zero foot side yard setback at PID 27-282001-0 located at 539 and 549
Market Street South.
2) Do not approve the waiver of subdivision criteria.
3) Table the matter for additional information.
ACTION REQUESTED:

Dear Kyle,
The purpose of this letter is to request a waiver of Sub Division Criteria for the interior
wall for my twin home located at 539 and 549 Market Street (Parcel ID No:
R272820010). I am the owner of this property. This unit was built several years ago with
the intent to be two individual legal properties. When the home was constructed, it was
built to code to be twin homes applying al~ proper building practices and standards, i.e.
proper air spaces and wall separations. Construction plans are available for your review
and will be submitted when the formal application is submitted. I appreciate you
forwarding this request to the members of the City Council.
It is our interest to sell the two units separately in the near future, so we appreciate your
careful consideration of this request. I look forward to my audience at thc City Council
meeting on May 1, 2007.
