SUBJECT: Text Amendment Regarding Message Board Signs
MEETING DATE: April 1 7, 2007
INTRODUCTION:
After hearing the appeal of Independent School District 720 (ISD 720) of a Board of
Adjustment and Appeals denial of their request for a variance to have an electronic,
changeable message board sign at the site of the new high school, the Council directed
staff to prepare and process a text amendment that would permit the type of sign sought
by ISD 720 for school or other public uses. On March 22nd, the Planning Commission
took testimony regarding, and discussed, the proposed text amendment. At the
conclusion of the discussion, the Commission recommended the proposed text
amendment with minor revisions as shown on the attached draft ordinance.

1. Offer and adopt Ordinance No. 778, an ordinance amending City Code Sec. l1.70 as
presented.
2. Offer and adopt Ordinance No. 778, an ordinance amending City Code Sec. 11.70 with
reVISIons.
3. Do not adopt the proposed ordinance
4. Table the item for additional information.

ORDINANCE NO. 778, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE CHAPTER 11,
SECTIONS 11.02 AND 11.70 RELATING TO SIGNS
THE CITY COUNCIL OF THE CITY OF SHAKOPEE MINNESOTA ORDAINS:
Section 1. City Code Chapter 11, Section 11.02 is amended to modify the following
definition:
137. "Sign, Public Information" - A sign design3ting time, temperature or
simil3r non advertising public inform3tion. A sion convevino information
of oeneral interest to the public, such as time, temperature, date,
atmospheric conditions, or upcomino civic, community, cultural. social or
athletic events.
Section 2. City Code Chapter 11, Section 11.70, Subdivision 8, is amended to add
the following new paragraph:
E. Public Information Sians. Public information sians shall be permitted
subiect to the followino provisions:
~ Such sions are permitted onlv in coniunction with the followino
uses: public buildinos, public or private schools, churches and
other places of worship, and public recreational facilities;
2. The sion shall be set back a minimum of ten (10) feet from any
rioht-of-wav line, and shall be located outside any sioht trianole as
determined bv the City Enoineer;
3. The sion shall not exceed eioht (8) feet in heioht;
4. The sion shall not exceed one (1) sion per entrance to the
structure, UP to a maximum of two (2) sions per structure: and
5. The sian shall not exceed thirty (30) square feet in area.
6. The messaoe on the sion may chanoe periodicallv, but shall not
chanoe any more frequentlv than once per 30 seconds.
Section 3. Effective Date. This ordinance becomes effective from and after its
passage and publication.

INTRODUCTION:

5. The sign shall not exceed thirty (30) square feet in area.
6. The message on the sign may change periodically, but shall not
change any more frequently than once per minute.
Section 3. Effective Date. This ordinance becomes effective from and after its
passage and publication.
