INTRODUCTION & DISCUSSION
The City has received a request from Westridge Bay Company to extend the approval of the
Final Plat of Westridge Lake Estates 3rd Addition (please see attached exhibits for site
location and correspondence).
Section 12.10, Subd. 2 of the City Code states that "upon request by the developer, the City
Council may extend the approval period for a preliminary or final plat, subject to all
applicable performance conditions and requirements. A request for an extension must be
filed on or before the expiration date of the preliminary or final plat."
The final plat was originally approved in 2001. In 2003 and 2005, the City Council granted
extensions of approval. The current extension is set to expire on October 16, 2007. The
applicant is requesting a two year extension be granted from that time. The applicant has not
proposed any changes to the approved plat.
ALTERNATIVES
1. Extend the approval period for the final plat of Westridge Lake Estates 3rd Addition to
October 16,2009.
2. Extend the approval period for the final plat of West ridge Lake Estates 3rd Addition by
another amount oftime.
3. Do not extend the approval period for the final plat of West ridge Lake Estates 3rd
Addition.
4. Table a decision and request additional information from staff and/or the developer.
STAFF RECOMMENDATION
Staff recommends the extension of the approval period of the final plat for Westridge Lake
Estates 3rd Addition to October 16,2009 (Alternative No. I).
ACTION REQUESTED
Offer a motion to extend the approval period ofthe final plat of West ridge Lake Estates 3rd
Addition to October 16,2009, and move its adoption.

Re: October 16,2001 Approval of the Pinal Plat, Westridge Lake Estates 3rd Addition
Dear Council Members,
Resolution 5570 Approving the Pinal Plat of West ridge Lake Estates 3rd Addition contained a list
of conditions that had to be fulfilled prior to recording of the Pinal Plat.
Section 12.10, Subd. 1 ofthe Shakopee City Code states the following: "City Council's approval
of a final plat shall remain in effect for a period of two (2) years from the date of approval. Prior
to recording of a plat, in which case City Council's approval of the plat is void."
Westridge Bay Company hereby requests a two (2) year extension for the City Council's
approval of the Pinal Plat and the conditions, which are due to expire on October 16, 2007.
