Introduction
In 2006, the City undertook a review of its non-union pay plan, using data from the League of
Minnesota Cities salary survey and the professional expertise of Rod Kelsey, of Riley, Dettmann
and Kelsey, LLC. When finalizing the City's 2007 operating budget last fall, the Council
allocated $50,000 for the mid-year implementation of the revised pay plan. The following
provides additional background and detail on the revised pay plan being proposed.
Background
On May 2, 2006, the City Council authorized staff to proceed with a pay plan update, and
directed that the City benchmark its salaries against those paid by ten comparison cities. The ten
comparison cities authorized by the Council were:
1. Andover 6. Inver Grove Heights
2. Apple Valley 7. Lakeville
3. Chanhassen 8. Prior Lake
4. Chaska 9. Savage
5. Cottage Grove 10. Woodbury
These ten cities were selected based on their population, geographic location and current stage of
development. Of the ten, five are larger than Shakopee and five are smaller than Shakopee in
terms of population, and four are our immediate neighbors.
At the time the Council authorized proceeding with the pay plan update using these ten
comparison cities, it also set a target of paying Shakopee employees at the 60th percentile of this
comparison group. However, following an initial analysis of what it would cost to bring salaries
up to the 60th percentile, staff is now recommending that the City's Pay Plan be brought to the
50th percentile of this comparison group instead.
PROCESS
The process of establishing a good pay plan for the City requires balancing two main factors -
what is necessary to keep the City competitive with the marketplace, so that we can attract and
retain qualified employees, and what is necessary to maintain a pay structure that is fair and
equitable when comparing one City position to another. This internal equity is important to
employee moral and retention and to ensure compliance with the state's Pay Equity laws.
Using data collected from the League of Minnesota Cities' 2006 Salary Survey and the
assistance of Mr. Kelsey, the top pay step for each position on the City's pay plan was compared
to the top step for that position in the ten comparison cities.
Because not all comparison cities have every position that we have, in many cases the
comparisons were conducted based on data from the seven or eight cities in our comparison
group that didreport a salary for that particular position. Additionally, there were a few
positions that we could not find any comparison data for - such as Park & Landscape Designer
and Police Records Specialist. In those cases, we double checked that the positions were a good
internal match with the other positions in their pay grade and then adjusted the salaries based on
the data we had for that pay grade overall.
Once we had a salary amount for each position that reflected the "market rate" for that position
(adjusted from 2006 to 2007 dollars), the next step was to review our internal structure and
grouping of positions into grades. For example, the market rate for a few positions came out to
be higher than what we were paying individuals holding that position here in Shakopee.
However, upon further review of job descriptions, in many cases we found that there was a
difference in the way different cities define different positions that accounted for the difference
in pay. For example, in Shakopee we may require less formal preparation and experience to
qualify for that position or the position here may not include supervisory responsibilities while
the same title in another city does.
While we did not conduct formal reviews and revisions for each and every job description on the
pay plan, in cases where the market data and our internal comparisons were yielding different
results, the appropriate department head was asked to review the current job description for that
position and make any necessary updates or changes. These revised job descriptions were then
sent to Mr. Kelsey for his review and scoring. This has resulted in the recommendation that a
few positions be moved to a different grade on the City's pay plan.
RESULTS
Using the 50th percentile ofthe ten comparison cities to establish a "market rate," we found that
the City's non-union pay plan had fallen below the market in almost every pay grade. In general,
the further up our pay plan you look, the further away from the market our pay rates become. As
a result, we are recommending a revised pay plan (see Attachment A) that increases the pay in
every grade except Grade 8. The positions in Grade 8 were found to be at market already. The
recommended increases range from 1.62 to 8.51 percent.
In addition to adjusting the wages associated with each pay grade, our analysis also suggests the
following changes:
1. Adoption of new job descriptions for the positions of City Clerk and Assistant City
Administrator and placement of those positions at Grade 9 of the pay plan. (They are
currently in Grade 8).
2. A change in title from Public Works Supervisor to Public Works Superintendent,
adoption of a new job description for the position of Public Works Superintendent
and a corresponding move of the position from Grade 8 to Grade 9.
3. A change in title from Natural Resources Specialist to Natural Resources
Coordinator, adoption of a revised job description for the position, a corresponding
move of the position from Grade 6 to Grade 7 and classification ofthe position as
exempt for the purposes ofthe federal Fair Labor Standards Act (FLSA), and
resulting overtime obligations.
4. A change is FLSA status from non-exempt to exempt for the Project Engineer. This
position meets the criteria for being classified as exempt and is currently the only
position in Grade 8 that is non-exempt.
IMPLEMENTATION
It is recommended that the City Council authorize the attached pay plan effective July 9,2007.
This date was selected because it is the first day of a new pay period, which makes
implementation much easier from an administrative standpoint. Additionally, the cost estimate
for implementing the pay plan on July 1 was slightly over the $50,000 budget. Delaying
implementation until July 9 will address this problem.
As has been the City's practice in the past when a new or updated pay plan was adopted,
employees will be placed at the first step of the new pay plan that will provide them with a wage
increase. This will result in some employees who are currently at the top step of their pay grade
being placed one step down from the top, although they will still be receiving an increase in
dollar terms. Employees would then move upward through any remaining steps in their pay
grade on the anniversary date of their placement in their current position.
After the City Council has discussed and provided feedback on the proposed pay plan, City
Administrator McNeill and I will meet with employees and union representatives to outline the
process and explain the results of the pay plan update, prior to the Council being asked to take
formal action.
UNION CONTRACTS
The research and analysis that has gone into the proposed new pay plan focused primarily on our
non-union employees. However, we did complete a market analysis for the five City positions
that are the subject of collective bargaining agreements (Sergeant, Police Office, Maintenance
Operator, Mechanic and Mechanic's Apprentice). Approximately half of the City's employees
fall into one ofthese five positions.
The collective bargaining agreement with the Sergeants union, which was just signed earlier this
year, already takes into consideration the 50th percentile wage of the City's ten comparison cities.
However, the contracts with the Public Works union and the Patrol Officers union, which were
signed in 2006, simply contain language stating that in the event a general wage study conducted
by the City suggests an increase in pay for positions covered by those contracts, the City will
agree to re-open the wages section of those contracts.
Our market analysis showed that our wages for both police officers and maintenance operators
are very close to market rate for those positions, suggesting that the collective bargaining process
has worked well. However, since they are technically under market (0.14% for Maintenance
Operators and 0.29% for Police Officers), we have included the cost of bringing them exactly to
the 50th percentile of our comparison group in our cost estimate for adopting the new pay plan.
Wages for the position of Mechanic are already slightly higher than the market so there is no
need for a change there and we were unable to find comparison data for the position of
Mechanic's Apprentice.
Budget Impact
As mentioned above, the Council included $50,000 in the City's 2007 operating budget to fund
mid-year implementation of an updated pay plan. The estimated costs for implementing the
suggested pay plan are as follows:

The above estimated costs were calculated based on a July 1 effective date. Weare, however,
recommending a July 9 effective date, to coincide with the start of a new payroll cycle and to
bring the total cost under $50,000.
Adopting the recommended pay plan will have three additional budgetary impacts that we are
unable to put an exact dollar amount on. First, the long-term disability insurance that the City
provides for all benefits-eligible employees is based on the dollar amount of our payroll.
Therefore, the monthly cost of providing this benefit will increase slightly. Secondly, overtime
worked in the second half of the year will be paid at time and one half of the new, higher wages.
Lastly, pay-out of any accrued vacation, comp time and sick leave will be based on the higher
wages for anyone leaving employment with the City after July 9. These costs can be
accommodated within each department's existing budget.
Relationship to Vision
A competitive pay plan allows the City to attract and retain qualified individuals and contributes
to Goal D, a vibrant, resilient and stable City.
Requested Action: The Council is asked to discuss and offer feedback on the proposed pay plan
update. After incorporating any necessary changes and meeting' with employees, this item will
be brought back to a future Council meeting for formal action.

SUMMARY
Carries out the statutory functions of the Office of City Clerk and serves as Clerk to the City
Council. Responsible for elections, municipal licensing, and official recordkeeping. Provides
essential administrative support to City Administrator and direction to individual City
Departments on tasks requiring detailed knowledge, experience and professional judgment.
ESSENTIAL DUTIES AND RESPONSIBILITIES include the following. Other duties may
be assigned.
Serves as Clerk to the City Council and Secretary to the Economic Development Authority
(EDA); coordinates the recording of all meetings and official proceedings; supervises the
preparation of minutes and other official documents of the City Council and EDA. Along with
the Mayor and City Administrator, signs deeds, agreements and other official documents on
behalf ofthe City.
Oversees the preparation and distribution of City Council agendas and agenda packets. Attends
all City Council meetings and/or workshops.
Directs and manages official recordkeeping and notification requirements for the City, ensuring
that all notices, ordinances, resolutions, and other documents are posted, recorded, and published
in conformance with existing federal, state and/or local laws, policies and procedures.
Executes deeds, contracts and agreements after ensuring they are accurate and recordable and
meet the intentions of the City Council.
Develops and administers a comprehensive records management system so that City records are
effectively and efficiently maintained in compliance with State law.
Organizes and directs the election process; hires and supervises election judges; arranges for
polling places, coordinates testing and set-up of voting equipment, receives candidate filings;
organizes absentee voting, and certifies results of municipal elections to the County.
Oversees the municipal licensing process, including the processing of applications and renewals,
collection of fees and review of violations. Recommends changes to licensing ordinances, as
appropriate.
Coordinates/ensures completion of conditions placed on new subdivisions prior to recording of
plat with the County; prepares developer's agreements to insure completion of public
improvements, obtains acceptable security, releases developer's agreements when improvements
are complete and renews, reduces, or releases security as appropriate.
Ensures collection and retention of all required evidence of insurance for contracts and licenses.
Oversees the recruitment and appointment of citizens to the City's advisory Boards and
Commissions.
Participates as an active member of the City's management team.
Prepares, recommends and manages division budget.
Provides information and assistance to the public, City Council and City staff on issues regarding
records management, data practices, elections, licensing and the City Code.
Monitors legislative issues and actions affecting elections, licensing, data practices and records
management, and implements any necessary changes to City practices.

SUMMARY
Assists the City Administrator in the overall administration of municipal operations; taking primary
responsibility for the delivery of administrative support services such as Human Resources, Information
Technology, Communications and Telecommunications, and Government Facilities. Coordinates and
carries-out Human Resource functions, including managing recruitment and hiring process, supervising
payroll processing and benefits administration, conducting new employee orientations, coordinating

Coordinates urban woodland management efforts within the city, including administering the
Woodland and Tree Management Ordinance, Shade Tree Disease Control and Prevention
Ordinance, hazardous tree inspection and control, and reviewing and assisting with landscaping,
reforestation, and planting plans.
Coordinates noxious weed inspection and control in compliance with the Minnesota Noxious
Weed Law and Rules.
Participates in the review of subdivision proposals and developments for consistency with city
environmental regulations, policies, standards, and best management practices.
Reviews development plans, including examination of grading, landscape, and planting plans,
and unique site preparations related to natural resource issues.
Reviews and administers conservation easements, including installation and inspection of
