SHAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Joe Swentek, Engineer DATE: 04/15/2014 SUBJECT: Approve the Purchase of Outlot B, Valley Creek Crossing 2nd Addition (E) Action Sought Approve the Purchase of Outlot B, Valley Creek Crossing 2nd Addition with the City being responsible for the property tax liability of $182.00 to be paid out of the Storm Drainage Fund. Background Attached is a letter from Lee Hennen, president of Associated Capital Corporation (ACC). ACC is the owner /developer of Valley Creek Crossing 2nd Addition, which is a residential subdivision located southwest of the intersection between County Road 17 (Marschall Road) and County Road 78. In his letter, Mr. Hennen expresses interest to transfer ownership of Outlot B to the City of Shakopee for the property tax amount of $182.00. Also attached please find the 2014 Scott County property tax statement detailing the amount due and a plat drawing for reference. Valley Creek Crossing 2nd Addition contains two (2) outlots. Outlot A was deeded to the City of Shakopee at the time of platting as it encompasses the majority of a large wetland complex. Outlot B was not deeded to the City of Shakopee at the time of platting, but a drainage and utility easement was dedicated over the entire area as it contains a small portion of the aforementioned wetland complex and a storm water basin collecting runoff from public rights -of -way. In order to provide consistency it does make sense to assume ownership of Outlot B. Please note as the City of Shakopee is already responsible to clean and maintain the operation of the storm water basin, any additional obligations are negligible as this area requires minimum yearly maintenance. Recommendation Staff recommends approving the Purchase of Outlot B, Valley Creek Crossing 2nd Addition with the City being responsible for the property tax liability of $182.00 to be paid out of the Storm Drainage Fund. Budget Impact Purchase of this parcel with the tax liability of $182.00 which affects the Storm Drainage fund and the additional maintenance is minimal. Relationship to Vision This supports Goal E: Deliver effective and efficient public services by a staff of well- trained, caring, and professional employees. Requested Action Approve the Purchase of Outlot B, Valley Creek Crossing 2nd Addition with the City being responsible for the property tax liability of $182.00 to be paid out of the Storm Drainage Fund.
