SUBJECT: Approval of a General Reimbursement Agreement with the City of Shakopee and
Shakopee Public Utilities for Certain Engineering Projects. (D,E) (Public Works &
Engineering)
Action Sought
Authorize appropriate City officials to sign a General Reimbursement Agreement between the
City of Shakopee and Shakopee Public Utilities.
Background
City and Shakopee Public Utility staff worked together to prepare a general reimbursement
agreement in an effort to make the process more efficient. This agreement will work well with
street reconstruction projects and this agreement will be utilized for the upcoming 2014 street
reconstruction project.
It is proposed to have the 2014 street reconstruction project and this agreement to be considered
by the SPUC at its next meeting to keep the project on schedule. For this reason, action is
requested to be taken by the City Council at its March 4th meeting.
Recommendation
Authorize appropriate City officials to sign a General Reimbursement Agreement between the
City of Shakopee and Shakopee Public Utilities.
Budget Impact
No impact to the budget.

Requested Action

City of Shakopee and Shakopee Public Utilities.

REIMBURSEMENT AGREEMENT
THIS AGREEMENT, by and between the Shakopee Public Utilities Commission, a municipal utility
commission organized under laws of the State of Minnesota, hereinafter referred to as "SPUC" and the
City of Shakopee, a body politic and corporate under the laws of the State of Minnesota, hereinafter
referred to as the "City".
RECITALS:
A. On occasion the City prepares construction plans that include improvements to the City's
municipal water distribution system that is subject to SPUC's authority.
B. The City and SPUC desire to enter into this agreement to set forth the terms under which SPUC
will reimburse the City for the watermain portion of the projects.
NOW, THEREFORE, IT IS HEREBY AGREED:
On projects that will not be assessed and that do not require easement acquisition for watermain:
1. SPUC will reimburse the City for 100% of the construction costs associated with the
watermain improvements including mobilization and traffic control. Apportionment for
mobilization and traffic control will be determined by Shakopee Engineering staff and
SPUC staff.
SPUC will be responsible for 100% of the costs associated with plan review and
inspection of the watermain improvements.
SPUC will reimburse the City for cost associated with design, surveying and contract
administration.
For projects with watermain construction costs over $150,000:
Design costs will be 10% of the watermain construction costs.
Survey costs will be 4% of the watermain construction costs.
Contract administration will be 3% of the watermain construction costs.
5. For projects with watermain construction costs less than $150,000; the design, survey and
contract administration will be 20% of the watermain construction costs.
On projects that will be assessed or include easement acquisition for watermain improvements:
Shakopee Engineering staff and SPUC staff will determine how project costs will be
apportioned.
