SHAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director DATE: 03/18/2014 SUBJECT: Request of MnDOT for Extending Work Hours on the TH 101 Southwest Reconnection Project (D,E) Action Sought Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restriction on Certain Operations, D, per this memo and attachment, and direct staff to publish notice of the suspension terms. Background The above named section of the City Code restricts the hours of operation from 7:00 A.M. to 10:00 P.M. on weekdays, and from 9:00 AM to 9:00 P.M. on weekends and holidays. Attached is the request from MnDOT requesting a suspension on the hours to allow for work to continue during night construction as defined in the request. "Night construction" is defined as construction between 10 pm and 6 am on Monday through Friday, between 7:00 pm to 7:00 am on Saturdays, and anytime on Sundays. Only certain construction activities will be allowed to occur during "night construction ". Activities such as pile driving, concrete pavement demolition, sawing for pavement removal, crushing operations, and jack - hammering will not be allowed in the Night Construction time. MNDOT is asking for extended hour to meet an aggressive schedule. The duration of the suspension would last for the duration of the project which is expected to go until Fall, 2015. If Council approves the suspension, a public notice to meet the City Code requirements such as a news release would be placed in the Shakopee Valley News. Recommendation Staff recommends to approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo and attachment, and direct staff to publish notice of the suspension terms. Budget Impact No impact. Attachments: MNDOT REQUEST Location Map MINNESOTA DEPARTMENT OF TRANSPORTATION REQUEST: To: Bruce Loney, Public Works Director City of Shakopee From: Ken Slama, Project Engineer, PE, Minnesota Department of Transportation, Date: February 19, 2014 Subject: RE: noise ordinance for S.P . 1009 -24 Night Construction shall be defined as construction between 10pm and 6am on Monday through Friday, between 7:OOpm to 7:OOam on Saturdays and anytime on Sundays. For Night Construction, the Contractor shall be prohibited from performing the following activities: pile driving /removal, concrete pavement demolition, sawing for pavement removal, crushing operations, and jack- hammering. Any deviation from the hours that these activities are prohibited from occurring must be approved by the Engineer. The Contractor shall have a supervisor on site during Night Construction that has completed the "MnDOT Noise Mitigation for Night Construction" training in the five years prior to the start date of this Contract and shall be on file as having completed the training with the Department. This training is free of charge, approximately 30 minutes in length, and can be found online at http: / /www. dot. state. mn. us /onlinelearning /construction /noisemitigation. The nighttime supervisor's name and a copy of his /her certification shall be furnished to the Engineer prior to Night Construction. For Night Construction, the following shall be required of the Contractor: • Notify all sensitive areas of the proposed Night Construction. Notification of the type, location, and duration of the work shall be made in writing no later than five calendar days prior to beginning the work. Provide a copy of the notification to the Engineer and the City. • Provide a contact person who is on site to ensure that any issues related to Night Construction are immediately addressed. • Equipment shall have OSHA approved ambient sound - sensing backup alarms or, as an alternative, an observer may be utilized in accordance with OSHA standards. • Allow for equipment to turn - around in lieu of backing -up (this includes equipment entering /exiting the project). • Construct temporary noise mitigation enclosures or curtains around stationary equipment (e.g., generators, compressors) . • Tailgates on trucks shall not be slammed. Truck drivers that are unable to control the tailgates from slamming shall be removed from the project. • All engines and engine driven equipment used for hauling or construction shall be equipped with an adequate muffler in constant operation and properly maintained to prevent excessive or unusual noise. If the Engineer determines that the Contractor is not in compliance with the Night Construction requirements, the Engineer will suspend Night Construction until the non - compliant issues are addressed or the Engineer accepts an action plan from the Contractor that satisfactorily addresses any non - compliant issues noted.
