SUBJECT: Dual Position Firefighter Designation for PERA Puposes -- Resolution No. 7437 (F)
Action Sought
The Council is asked to adopt Resolution No. 7437, a resolution declaring the Fire Marshal a dual
position firefighter, and move its adoption.
Several recent changes to the processes and procedures of the Fire Department, including the
hiring of four full -time firefighters, have lead to changes in the job responsibilities of incumbent
Fire Department staff such as the Fire Marshal. This was recognized last fall with the adoption of
an updated job description for the Fire Marshal, which was expected to make the position eligible
for a pension under the PERA Police & Fire Fund. (See attached memo dated October 2013).
Working with staff at PERA, we have been advised that in order to finalize this pension change,
the governing body must adopt the attached Resolution.
Budget Impact
As noted in the October 2013 memo, the anticipated net cost of this pension change is $1,342 for
2014.

RESOLUTION No. 7437
A RESOLUTION DECLARING THE FIRE MARSHAL A DUAL POSITION FIREFIGHTER
WHEREAS, the policy of the State of Minnesota as declared in Minn. Stat. Section 353.63 is to
give special consideration to firefighters who are required to perform hazardous work and who devote
their time and skills to protecting the property and personal safety of others; and
WHEREAS, Minnesota Statutes Chapter 353 permits the governing body of a governmental
subdivision to request coverage in the Public Employees Police and Fire Plan for all services rendered by
an employee holding a fire service position that requires fire fighting on a primary basis and related non -
fire firefighting duties on a secondary basis; provided further, that none of the firefighting services
rendered by the employee are earning credits in a relief association that operates under
Chapter 424A.
WHEREAS, for the governing body to declare to the Public Employees Retirement Association
that a fire department position with dual roles is that of a firefighter who is eligible to participate in the
Police and Fire Plan, the duties and training qualifications of the position and employee must meet the
following minimum requirements:
1. The position requires and the employee holds a Firefighter I or Firefighter II state certification or
meets equivalent training standards established by the fire department; and
2. The primary services of the position are fire fighting. Primary is understood to mean the highest
priority task and a job requirement that the employee respond on a regular basis to the fire calls
(and medical emergencies if applicable) that are received at the fire station to which the
employee is assigned during the employee's established work hours.
BE IT RESOLVED that the City Council of the City of Shakopee hereby declares that the position
titled Fire Marshal currently held by Thomas Pitschneider is for primary services that of a firefighter who
qualifies for membership in the Police and Fire Plan.
BE IT FURTHER RESOLVED that this governing body hereby requests that the employee holding
this position be accepted as a member of the Police and Fire Plan effective the date of this employee's
initial Police and Fire Plan salary deduction by the governmental subdivision.
Adopted in adjourned regular session of the City Council of the City of Shakopee, Minnesota,
held this 18 day of March, 2014.

Approval of Revised Position Description for Fire Marshal (E)
Action Sought
The Council is asked to approve a revised position description for the Fire Marshal.
Background
For the past five years, the full -time staff of the Fire Department has consisted of the Fire Chief,
Fire Marshal / Inspector and an Office Service Worker. As a result of the addition of four full -time
firefighters this fall, there is a need to adjust practices in numerous areas. One of the most
significant adjustment is that the Department will no longer be paging out paid -on -call firefighters
for minor or routine calls during the workday, as these will be handled by the full -time crew.
Another significant change is that for the first time the Department has firefighters eligible for paid
sick leave and vacation days, which creates a need to back -fill for those employees when they are
gone during a regular workday. Given the staffing and structure of the Department, this
responsibility will fall first to the Fire Marshal. Previously, there was no requirement in the Fire
Marshal's job description that he or she be a licensed firefighter or respond to emergency calls
during the workday. We now need to require that. Therefore the position description has been
revised to include emergency response duties and require firefighter qualifications, in addition to the
existing duties of the position. Secondly it is recommended that the job title be simplified to just
"Fire Marshal" rather than "Fire Marshal / Inspector."
Budget Impact
The revised position description will not alter the pay grade of the Fire Marshal position. However
it will transfer the position from the Coordinated plan of our pension to the Police & Fire plan,
which carries slightly higher costs for the City. The estimated cost of this move for the remainder
of 2013 is $135 and the estimated cost for 2014 is $1,342.
