No 7429 (E) Action Sought Adopt Resolution No.7429, a resolution which accepts the bid from Heselton Construction Inc., for the East Shakopee Industrial Sewer Improvements Project No. 2013 -4 and approves a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project. Also to pass a motion approving Change Order No. 1 for the project. Background On September 3, 2013, City Council adopted Resolution No. 7344, which rejected all bids for the East Shakopee Industrial Sewer Improvements and called for plans to be revised and the project rebid. On February 12, 2014, a bid opening was held for the Project, in which there were four bids opened for this improvement project. The bids are summarized in the attached resolution. From the bid opening, the low bidder is Heselton Construction, Inc. with a bid of $392,487.50. The engineers estimate for this project is $440,000.00 Prior to the rebid, Union Pacific Railroad indicated a plastic casing pipe under the railroad would be permitted. After bidding the project, the railroad changed this requirement to a steel casing pipe. The project was bid with a plastic casing pipe. If Council awards the project, a motion approving change order No. 1 will also be required. Change Order No. 1 will add $68,670.00 to the original bid. This new amount would be $461,157.50 which compares to the previous low bid on August 16, 2013 of $508,658.61, which was rejected. If Council awards the contract, staff is also requesting a contingency amount equal to 5% of the contract to cover minor change orders and quantity adjustments that may occur on the project. Also a motion approving change order No. 1 is being requested as well. Recommendation Staff recommends approving Resolution No.7429, a resolution which accepts the bid from Heselton Construction, Inc. for the East Shakopee Industrial Sewer Improvements Project No. 2013 -4 for a cost of $392,487.50; approve a 5% contingency amount on this project for use by the City Engineer in authorizing change orders or quantity adjustments on this project and pass a motion approving Change Order No. 1. Budget Impact This project will be funded by assessments and the sanitary sewer fund. Relationship to Vision This supports Goal E: Deliver effective and efficient public services by a staff of well - trained, caring, and professional employees. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The appropriate City officials are hereby authorized and directed to enter into a contract with Haselton Construction, Inc. in the name of the City of Shakopee for the East Shakopee Industrial Sewer Improvements Project according to the plans and specifications therefore approved by the City Council and on file in the office of the City Clerk. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed.
