Action Sought
Approve the Final Plat of Southbridge Crossings East 3rd Addition with an over - length
cul -de -sac variance and a shared driveway determination.
Background
Angie Knodel of Van-Man Architects and Builders, representing River Valley Church has
proposed the Final Plat of Southbridge Crossings East 3rd Addition, an over - length cul -de -sac
variance, and a shared driveway determination to allow for the proposed site design and lot
configuration for the final plat of Southbridge Crossings East 3rd Addition for River Valley
Church.
River Valley Church currently owns 13 acres that is a portion of two outlots in Southbridge
Crossings East 2nd Addition that was purchased in late 2013 from Shakopee Crossings by the
drafting of a deed. This type of land subdivision is allowed by Chapter 12 (Subdivisions) of City
Code for transactions involving commercially zoned properties greater than 5 acres in size.
In order to develop the site, River Valley Church is requesting Final Plat approval, which creates
a platted lot for the church (Lot 1, Block 1), Outlot A to the east of the church site, and Outlot B
to the south of the church site (see plat exhibit). The future uses for Outlots A and B are not
known at this time. All property in the plat is zoned B -1 Highway Business and guided for
commercial use.
At the February 6, 2014 Board of Adjustment and Appeals meeting, the Board approved the
Conditional Use Permit requests for both a church and an over - height structure. The proposed
over - height structure is a 43' tall metal cross located near the front entrance of the church.
Final Plat discussion:
The final plat proposes the creation of one buildable lot for the church with access from a
cul -de -sac, which is an extension of Crossings Blvd of approximately 148'. The creation of a
cul -de -sac allows for a vehicle turn around and provides public street access to Outlot A in the
future. The request has been reviewed by other city departments and outside agencies. The
comments received by planning staff are attached as exhibits. Most of the comments received
regarding the plat involve current and revisions proposed drainage and utility easements as well
as utilities.
Over - length cul -de -sac discussion:
At this time Crossings Blvd ends at the western access to the Southbridge Transit
Station. Crossings Blvd currently extends 858' north of Hansen Avenue. With the proposed 148'
extension as part of this plat, the total length is approximately 1,006'. The Engineering Design
Criteria permits up to a 750' cul -de -sac for an urban service area, which requires a variance of
256' for this final plat. Depending on future development it is possible that a public street would
be extended from the proposed cul -de -sac of Crossings Blvd to the intersection of 13th Avenue
and Stagecoach Road in the future. Staff would prefer that the option for a future public street
extension remain available.
The adjacent properties are guided for commercial development and specific future uses are
unknown at this time. The Planning Commission reviewed the variance request and
recommended that the City Council approve the variance request as part of the Final Plat. Staff
supports varying from City Code and allowing a cul -de -sac because the development of the site
east of the church and the necessity for a public street or a future alignment is unknown at this
time.
Shared driveway discussion:
The shared driveway determination was reviewed by the Planning Commission at the February
6th meeting. The Planning Commission recommended that the City Council approve the proposed
shared driveway for both accesses to the church site. The current proposal contemplates an exit
from the church parking lot to a shared private driveway adjacent to the south lot line. It is
anticipated that when Outlot B develops, access from Crossings Blvd would be via the shared
driveway. Engineering staff are recommending that the southern shared driveway be revised to
meet Crossings Blvd at a perpendicular and be aligned with the access to the Southbridge Transit
Station.
At the time of the preparing this report, the applicant is requesting that the Planning Commission's
recommendation regarding a northerly shared driveway not be followed because the church does
not want temporary barricades and the end of the shared driveway, or a left hand turn to enter
their site. Engineering staff has stated that barricades would not be required by the City of
Shakopee for a dead end on a private drive. The applicant has stated that they would like to revert
to their original plan of access from the cul -de -sac that limits the possibility for a proper access to
Outlot A from the church site. Outlot A is zoned and guided for commercial use and it is possible
that restaurants and retails establishments will be developed on Outlot A, which would
generate traffic between the two sites.
The original proposed driveway also limits the possibility for a public street to extend to the north
to serve Outlot A. The design recommended by staff and the Planning Commission results in a
left turn into the church parking lot from a short shared driveway off the cul -de -sac. The property
owner of Outlot A has agreed to the design recommended by the Planning Commission and staff.
The applicant has provided a drawing that shows a 5- legged intersection west of the northern
access, which as attached as an exhibit. Staff is recommending that the intersection be reduced to
a 4- legged intersection of a design approved by the City Engineer. A rough sketch of a possible
design is attached.
City Code Section 11.62 Subdivision 2D relates to shared driveways and states:
"A property owner's association or maintenance agreement for the driveway must be executed
designating the party responsible for maintaining the driveway, and granting the party right to
assess all properties benefiting from the driveway for the cost of maintenance. The agreement
shall also grant the City the right to enter and maintain the driveway when it deems necessary to
maintain safe access, and to charge the cost of such maintenance back to the property owners."
The current southern driveway configuration follows the existing lot line. The driveway
is proposed as slightly off of a perpendicular at the intersection of Crossings Blvd. Consistent
with the Engineering Department's recommendation, planning staff fully supports 28' wide shared
driveways, provided the alignment of the southern driveway is altered to meet the access to
Crossings Blvd at a perpendicular and aligned with the access to Southbridge Transit Station. To
comply with Engineering Design Criteria the lot line between the church lot and Outlot A
should be revised to extend radially from the cul -de -sac, unless the City Engineer and the City
Council determines a lot line adjustment is not necessary and a 28' driveway can be
accommodated.
Recommendation
Staff recommends the approval of the Final Plat of Southbridge Crossings East 3rd Addition with
the Planning Commission recommendation that the 256' over - length cul -de -sac variance be
granted, the shared driveway determination, and subject to the conditions of Resolution No. 7416.
Budget Impact
River Valley Church currently owns the commercially zoned 13 acre parcel that is under review.
As a church, the property is no longer subject to payment of property taxes, which is a reduction
in the amount of revenue the City will receive.

Offer a motion to approve Resolution No. 7416, a resolution approving the Final Plat of
Southbridge Crossings East 3rd Addition, with an over - length cul -de -sac variance, and shared

Description of Property Surveyed
That part of Outlot A, SOUTHBRIDGE CROSSINGS EAST FIRST ADDITION, according to the
recorded plat thereof, Scott County, Minnesota, described as follows:
Beginning at the northwest corner of said Outlot A; thence easterly on an assumed
bearing of South 88 degrees 53 minutes 26 seconds East, along the north line of said
Outlot A, a distance of 403.00 feet; thence South 00 Degrees 01 Minutes 19 Seconds
East a distance of 977.78 feet to the northwest corner of Parcel 16, SCOTT COUNTY
RIGHT -OF -WAY PLAT NO. 39, Document No 748574, Scott County, Minnesota; thence
South 11 degrees 43 minutes 38 seconds East, along the westerly line of said Parcel 113,
a distance of 16.31 feet; thence South 89 degrees 58 minutes 41 seconds West a
distance of 609.64 feet to the westerly line of said Outlot A; thence northerly, along the
westerly line of said Outlot A, a distance of 1047.61 feet to the point of beginning.
The address of the surveyed property is unassigned; the underlying PIN is 27- 3610020.
The site is currently zoned as B -1, Highway Business.
The property is 13.0 acres.
C. HISTORY NARRATIVE:
River Valley Church started in 1995 in Apple Valley, Minnesota. Through many periods
of growth, River Valley has added campuses in Faribault, Minnetrista, Edina and Savage.
River Valley Church plans to build a new facility in Shakopee to accommodate the
growing church and plan for future growth.
D. PROPOSED USES:
The proposed plan for River Valley Church of Shakopee consists of a new 35,000 sf
facility. The new building would include a lobby space as you enter the building, a 1,000
seat worship auditorium, a 228 seat Family Auditorium, 8 classrooms, administrative
offices, as well as toilets, storage and utility spaces.
A new parking lot will be constructed with adequate parking spaces to accommodate
the new facility. Please note the Family Auditorium is for Children only and will not
require additional parking spaces.
The building would be used primarily on Sunday Mornings, from 8 am, when the
volunteers arrive, to 1 pm, when the volunteers leave. The building would also be used
on Sunday nights, during youth services, from 5 pm to 9 pm. Office hours would be kept
during the week Monday thru Friday from 8 am to 5 pm.
E. HEALTH SAFETY AND WELFARE:
The final building and use would pose no risk of noise, glare, odor, electrical
interference, vibration, dust, fire, or safety hazards for the area.
The parking lot lighting will meet the City of Shakopee's Lighting requirement as follows:
The maximum amount of spillover light is 1 foot - candle at all property lines.
F. NEIGHBORING PROPERTIES:
Despite being a multi -site church, River Valley Church has continually pressed home to
its attendees the importance of making local connections — having the benefits of a
large church with the community of a small church. This has remained true in the
Savage campus, which will undoubtedly continue in the new location.
The sanctuary, the highest part of the building, would be constructed of pre -cast
concrete panels. The remainder of the building would be clad in brick, manufactured
stone, and fiber cement siding. A cross will be installed on the building to identify the
church. The top of the cross is shown at 43' -0" which extends above the 35' -0" building
height requirement. A variance for this item is described below in Item K.
G. PUBLIC SERVICES:
Access to the church would be from an over length cul -de -sac from Crossings Boulevard.
A variance for this item is described below in Item K. The parking lot would be located
on the site to meet the City of Shakopee's parking requirements. A traffic study of the
area has been submitted with this package.
The impact on the sewer system and water facilities would be minor, with new toilets
and sinks added, but these would be used relatively close to once a week. The plan
would preserve and protect existing environmental features that the residents of
Shakopee hold dear and appreciate while including materials in the project that echo
these sentiments.
H. CONSTRUCTION SCHEDULE:
River Valley Church anticipates that they will start construction in the spring of 2014.
I. FINAL PLAT
Public Improvements as defined in the Developers Agreement.
River Valley Church of Apple Valley has agreed with Shakopee Crossings Limited Partnership that
River Valley Church will be solely responsible for the construction of the cul -de -sac shown on the
proposed plot, and that Shakopee Crossings Limited Partnership will not bear any of the costs or
responsibility for the cul -de -sac.
J. CONDITIONAL USE PERMIT
The design and development of this property is consistent with the requirements
established in the Conditional Use Permit.
1. The use of this building will not be injurious to the use and enjoyment of other
property in the immediate vicinity for the purposes already permitted, nor
substantially diminish and impair property values within the immediate vicinity.
2. The establishment of the conditional use will not impede the normal and orderly
development and improvement of surrounding vacant property for uses allowed
in the area.
3. Adequate utilities, access roads, and drainage and other necessary facilities have
been provided as shown in the attached drawings.
4. The use is consistent with the purposes of the B -1 Zoning.
5. The use is not in conflict with the City of Shakopee's Comprehensive Plan.
Shakopee's mission is to provide the opportunity to live, work and play in a community
with a proud past, promising future, and small -town atmosphere within a metropolitan
setting. River Valley Church has a strong commitment and focus on community,
building relationships and the youth at all their campuses. The attendance every
Sunday morning will bring a large number of people to this area of Shakopee who will
likely stay in the area to eat or shop after services.

Cross Elevation

The engineering department offers the following comments at this time for the applicant and
for the planning department:
General Conditions
The following items will be addressed prior to release of the Final Plat for recording:
1. Execution of a Developer's Agreement, which will include provisions for adequate
security and engineering review and inspection fees for all public improvements
associated with the Final Plat.
2. Payment of Trunk Sanitary Sewer Charge needs to be made, as required by the most
current City of Shakopee Fee Schedule and Trunk Sanitary Sewer Charge Policy.
3. Payments of Trunk Storm Water Charge and Trunk Storm Water Storage and Treatment
Charge need to be made, as required by the most current City of Shakopee Fee Schedule
and Trunk Storm Water Charge Justification Report.
4. Payment of all storm water management plan review charges /fees need to be made, as
required by the most current City of Shakopee Fee Schedule.

5. The applicant will update the submitted traffic study as necessary to reflect the current
project location. The submitted traffic study analyzes a previously considered project
location to the south.
6. The applicant will be responsible for all additional traffic control measures required to
manage their traffic.
7. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be
recorded with datum on the Scott County coordinate system.
The following items will be addressed prior to approval of a grading permit, a building
permit and /or a street and utility plan:
1. The applicant will obtain the necessary MNDoT and Scott County permits /approvals.
Copies of these permits /approvals will be provided to the City of Shakopee.
2. The applicant will obtain a National Pollutant Discharge Elimination System (NPDES)
construction site permit prior to any land disturbing activity. A copy of this permit will
be provided to the City of Shakopee.
3. The applicant will grade the entire site, as proposed on the approved plans, in one
phase within one (1) year from the date of approval of the grading permit application.
Grading is defined as bringing the site to the proposed finished grade with materials
deemed acceptable by the City of Shakopee engineering department, providing topsoil
per City requirements and applying seed, mulch and /or sod per City requirements and
potentially providing an as -built record grading plan per Section 2.5 of the City of
Shakopee Design Criteria.
4. The applicant will provide pretreatment of runoff prior to entering the proposed
infiltration basin /areas per requirements set forth in Section IV, Subdivision A8 of the
City Shakopee Comprehensive Water Resource Management Plan.
5. The applicant will incorporate adequately established and protected emergency
overflow routes for all storm water basins into the design.
6. The applicant will provide plans for all public improvements as set forth in Section 11 of
the City of Shakopee Design Criteria.
7. The applicant will raise the elevations of the proposed Crossings Boulevard cul -de -sac in
order to route the storm sewer from CBS and CB6 to an existing storm sewer structure
in Crossings Boulevard to the south. This will be a public system. The remaining storm

sewer proposed to accommodate the site will be private and will be routed in a separate
system through Outlot B.
8. The applicant will move the proposed driveway located in the northwest portion of the
cul -de -sac to the west. The driveway needs to be offset from the property line a
minimum of five (5) feet per Section 11.62, Subdivision 3F of the City Code.
9. The centerline of the proposed common driveway located south of the cul -de -sac will be
aligned with the centerline of the existing access to the transit site.
10. The proposed common driveway located south of the cul -de -sac will intersect Crossings
Boulevard at a ninety (90) degree angle.
11. The applicant will submit design calculations for the proposed six (6) inch sanitary sewer
service to the site and for one to Outlot A.
12. An adequately sized sanitary sewer service will be added to MH2 to serve Outlot A. The
angle of service connections to MH2 will be such to limit the diameter of the structure
to forty -eight (48) inches.
13. Record plans will be provided per the City of Shakopee Design Criteria, Section 2.5 and
Section 11.2 (A -L). The record plans will be submitted to the engineering department.
Final Plat Drawin¢
The following items will be addressed prior to release of the Final Plat for recording:
1. The property lines between Lot 1 and Outlot A and Lot 1 and Outlot B will be revised so
as to be at right angles and /or radial to Crossings Boulevard per requirements set forth
in Section 10, Subdivision 3B of the City of Shakopee Design Criteria.
2. Easements need to be shown on the Final Plat as approved by the City Engineer. They
will include, but are not be limited to, the following:
• Minimum drainage and utility easements for all sanitary sewer and storm sewer
deemed public by the City Engineer will be dedicated per Section 10.1 (A -D) of the
City of Shakopee Design Criteria. The easements will be centered along the public
utility alignments.
• Provide a minimum of ten (10) feet of drainage and utility easement adjacent to the
north property line of Outlot B.
• Additional drainage and utility easements will be required as the proposed sanitary
sewer and storm sewer systems are revised to comply with comments above. These
easements will be shown on the Final Plat for recording.

2. No more than 1/3 of the landscaping trees may be any one species.
3. 193 landscaping units are required per Sec. 11.60 Subd. 8. of City Code for this site.
4. Final grading requires the placement of a minimum 6 inches of topsoil meeting
requirements set in MnDOT's "SELECT TOPSOIL BORROW" (spec. 3877.2 B,
Table 3877 -2).
5. Trees shall be planted according to the following conditions:
1. Trees shall be planted a minimum of 4 feet from impervious surfaces.
2. Trees shall be planted a minimum of ten feet from property lines.
3. Trees shall not be planted in easements containing utilities.
4. Trees shall not be planted in City owned right -of -way.
5. Trees shall not be planted below overhead utilities.
6. Trees shall not be planted below high water levels (HWL) in existing or
created ponds or wetlands.
6. 'The City of Shakopee, MN Tree Planting Detail' or planting detail displaying the
same specifications shall be placed on the landscaping plan. If the installed trees do
not meet these specifications or trees are determined unhealthy by City of Shakopee
staff they will be removed and replaced at the expense of the applicant.
7. The warranty period will not begin until installed plants are inspected by City staff
and determined acceptable. Call the Shakopee Natural Resources Dept. to schedule
inspection, 952 - 233 -9511.
8. Soil compaction for all non - structural landscaped areas (including landscaping
islands) shall be between 75 % -80% of Standard Proctor (maximum dry density) for a
minimum of the top 18" of soil. Compaction samples are to be taken after final
grading of the site is complete. Results of the compaction tests are to be approved
by the Natural Resource Department before installation of landscaping begins.

and landscaping sheet)
9. Soil compaction testing fee for landscaped areas shall be paid to the City.
10. Significant Trees will likely need to be removed due to installation of the proposed
drainage systems, tree replacement per City Code See. 11.60 Subd. 9 is required.
11. The proposed storm sewer running along Crossing Boulevard (labeled Stagecoach
Road on plans dated December 26"', 2013) draining to regional pond EC -913 would
require the removal of 6 bur oak trees ranging from 12 -16 diameter inches in size. If
City Engineering requirements permit, this storm sewer shall be moved to the west
property line. This site is within a Natural Resources Corridor and requires no
feasible or prudent alternative to removing significant trees within.
12. Tree protection fencing shall be installed between existing trees and proposed storm
sewer. The fencing shall be no closer than 1.5 feet x inches of DBH for preserved
oak trees or the dripline for all other tree species. Please contact Jacob Busiahn at

We have reviewed the conditional use permit application and offer the following comments:
♦ The submitted Traffic Study should be revised to show the current site plan and property.
♦ Sheet C 1.2 was included in the CUP package. Is the church intending to develop the parcel shown
on Sheet C1.2? Hansen Avenue was permitted to connect to CH 18 with the County's
understanding no direct access to Hansen Avenue will be provided for the northern parcel. Sheet
C1.2 shows commercial access to Hansen Avenue. This exhibit should remove direct access to
Hansen Avenue.
♦ The resulting traffic conditions at the CH 18 at Crossings Boulevard intersection presents a safety
concern if queued vehicles in the eastbound left turn bay extend into the through lane. Traffic
actuated signal timing can be adjusted, however this may not entirely alleviate the problem in the
existing condition of protected -only left turn signal operations. The County agrees with the traffic
study report that implementing the use of flashing yellow arrows would improve traffic operations
of the signal system. We recommend an agreement (developer /City /County) on the cost sharing of
this signal system improvement be a condition of approval.

2. The watermain easement along the northern portion of Outlot A shall
include an area 40 ft in width immediately adjacent to the south side of the
Williams Bros. pipeline easement from Stagecoach Rd to the point of
deflection on the western end. The approved watermain construction plans
show the centerline of the watermain to Jay 20 ft south of the south edge of
the Williams Bros. pipeline easement.
3. There shall be an additional watermain easement shown on the plat or
created by separate document for the proposed public watermain loop
around the church building on Lot 1 Block 1.
4. The City of Shakopee should require a general 10 ft wide drainage and
utilities easement adjacent to and along the south edge of the Williams Bros.

I have completed the review of the River Valley Church stormwater management plan (Dec. 20, 2013) received
from Dave Rey at AJA. The review stormwater management plan is being conducted to determine if the site is in
conformance with the City polices. Based on my review of the stormwater plan and submitted documents I will
require some additional information to finish my review and determine if the site is in full conformance with the
City policies. I have sent an email to Dave Rey to request some additional information.
I have reviewed the stormwater management documents that were provided and offer the following:
The Rate Control requirements for the southern portion of the site are in conformance with the City policies
for a single 100 year (TP 40) rainfall event. The analysis of the proposed basin on the northern end of the site
evaluated the 10- Day runoff event and back to back 100 -year return (TP 40) rainfall event. The analysis assumes
that all of the available storage is available in Pond 8 at the onset of the events. The 10 -Day runoff results indicate
that the basin HWL will reach elevation 742.4 at the north property boundary, and the 100 year (TP 40) back to
back event HWL of 743.2 will inundate a small area north of the property boundary. These HWL elevations are
conservative and do not assume any infiltration is occurring during the events. I would recommend that Pond 8 be
considered to be in conformance with the City policies. The new Atlas 14 rainfall events were not analyzed by
the applicant. It is recommended that the analysis performed by the developer's engineer be considered to be in
conformance with the rate control requirements for the City.
• The water quality treatment provided by the in place Pond EC-9 and the proposed Basin 8 (North Pond) are in
conformance with the NURP requirements. Please be advised that the north pond is considered an infiltration
pond, which typically requires pretreatment of storm water prior to inflow to the infiltration area. It is

recommended that the pretreatment of stormwater be incorporated into the infiltration system design to improve
the service life of the system, reduce clogging of the bottom of the system, and reduce the area requiring frequent
sediment removal.
• The infiltration design for the site appears to be in conformance with the NPDES (1.0 ") of volume control from
the new impervious surface created by the site. The time to infiltrate the 100 -year 24 hour (TP 40) events was not
included for the site as outlined in the Chapter 16 of the City code. It is requested that the calculations for
drawdown for Pond 8 be provided. The City may want to consider increasing the infiltration capacity of the
southern system as outlined in in Chapter 16.
• The low building opening freeboard requirement is being met.
The low floor freeboard requirement could not be determined. The low floor elevation should be added to the
plans.
• The emergency overflow to the north appears to be offsite at elevation 743.4 based on the topographic survey
data. This would indicate that overflow would occur well below the first floor elevation. The low floor elevation
should be shown on the grading plan. The building plans were not provided to determine if 2' of freeboard to the
low floor is being provided. If the building has a basement /lower level the low floor may not be 2' below the 10-day
HWL of 742.4, and the 100 -year event back to back HWL of 743.2. It is requested that the building plans be
provided to determine if the low floor is in conformance with the City requirements.
The emergency overflow from the southern infiltration areas at elevation 744.1 is to the west into the
CSAH 21 ditch. The depth of water in the cul-de -sac at the entrance may reach 0.8' prior to overflow. The
construction of a defined overflow section with adequate erosion control protection should be provided to
the CSAH 21 ditch. The EOF typical section should be added to the plan details.
• It is recommended that a maintenance plan for the infiltration basin and systems be provided to the City for
the site. The maintenance of these facilities is a significant part of the stormwater management plan.
Plan Review Comments

• Add the precipitation event to the HWL data shown on the grading plans and utility plans. Indicate if the HWL
is the TP 40 event, 10 -Day runoff, or the 100 year back to back. The HWL should represent critical (highest)
surface water elevation fort the fully developed conditions for the site.
• Add the low floor elevation to the grading plan.

Add the EOF flow path and elevation to the all grading plans for all phases of the site. Include overflow
elevations and paths from all parking lot low points and streets. The future north parking lot overflow elevation
should be shown on the plans.
Add all data and elements to the grading plans that are outlined in the City of Shakopee Design Criteria.
Recommend adding an access road to the storm sewer outfall to Basin 8. The City usually

Add drainage and utility easements to the storm sewer system from MH 103 to FES 1. The right of way
shown along the west side of the pipe does not appear to meet the City requirements for width. The pipe appears
to be over 10' in depth and will require additional easement to be in conformance with the City requirements.
Will the sidewalk on the west side of Stagecoach Road be impacted by the proposed 36" storm sewer? Will
temporary easements be needed for construction the storm sewer?
The erosion control plans and restoration plans for the site were not evaluated as part of this review.
This completes my review of the River Valley Church stormwater management plan. If you have any questions or

Based on a review of the application materials provided to staff, staff has the following
conditions of approval based on the plan set provided dated 12126/13 and not the

Given the location of the development, cash in lieu of land is recommended.
2. Park dedication fees in the amount required by the City Code and adopted City
fee schedule shall be paid at the time of recording of the final plat.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE FINAL PLAT OF SOUTHBRIDGE CROSSINGS EAST 3RD ADDITION, AN
OVER - LENGTH CUL -DE -SAC VARIANCE, AND A SHARED DRIVEWAY
DETERMINATION.
WHEREAS, VanMan Architects and Builders, applicant; and River Valley Church
of Apple Valley and Shakopee Crossings LTD Partnership property owners, made
application for final plat approval of Southbridge Crossings East P Addition on
December 26, 2013; and
WHEREAS, the subject property is legally described as:
Parcel 1:
Those parts of Outlot A and Outlot E, Southbridge Crossings East Second Addition,
according to the recorded plat thereof, Scott County, Minnesota, described as follows:
Beginning at the northwest corner ofsaid Outlot A; thence easterly on an assumed bearing
of South 88 degrees 53 minutes 26 seconds East, along the north line ofsaid Outlot A, a
distance of 403.00 feet; thence South 00 degrees I minutes 19 seconds East a distance of

WHEREAS, the City Council reviewed the final plat, variance request, and
shared driveway request on February 18, 2014.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that the final plat of Southbridge Crossings East 3`d Addition is
hereby APPROVED subject to the following conditions:
The following procedural actions must be addressed prior to release of the Final
Plat for recording:
1. Execution of a Developer's Agreement, which will include provisions for
adequate security and engineering review and inspection fees for all public
improvements associated with the Final Plat.
2. Payment of Trunk Sanitary Sewer Charge needs to be made, as required by the
most current City of Shakopee Fee Schedule and Trunk Sanitary Sewer Charge
Policy.
3. Payments of Trunk Storm Water Charge and Trunk Storm Water Storage and
Treatment Charge need to be made, as required by the most current City of
Shakopee Fee Schedule and Trunk Storm Water Charge Justification Report.
4. Payment of all storm water management plan review charges/fees need to be
made, as required by the most current City of Shakopee Fee Schedule.
5. The applicant will be responsible for all additional traffic control measures
required to manage the traffic generated by their use.
6. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat
to be recorded with datum on the Scott County coordinate system.
7. Payment of park dedication fees based on the net acreage of Lot 1, Block 1 in
accordance with the City's current fee schedule.
The following items must be addressed on the plat drawing prior to release of
the Final Plat for recording:
1. Easements need to be shown on the Final Plat as approved by the City Engineer.
They will include, but are not be limited to, the following:
• Minimum drainage and utility easements for all sanitary sewer and storm
sewer deemed public by the City Engineer will be dedicated per Section 10.1
(A -D) of the City of Shakopee Design Criteria. The easements will be
centered along the public utility alignments.
• Provide a minimum of ten (10) feet of drainage and utility easement adjacent
to the north property line of Outlot B.
• Additional drainage and utility easements will be required as the proposed
sanitary sewer and storm sewer systems are revised to comply with comments
above. These easements will be shown on the Final Plat for recording.
2. The drainage and utility easement shown for the existing watermain shall be a
watermain easement per the existing agreement with Shakopee Crossings when
the watermain was installed.
3. The watermain easement along the northern portion of Outlot A shall include an
area 40' in width immediately adjacent to the south side of the Magellan pipeline
easement from Stagecoach Road to the point of deflection on the western end.
The approved watermain construction plans show the centerline of the watermain
to lay 20' south of the edge of the Magellan pipeline easement.
4. There shall be an additional watermain easement shown on the plat or created by
separate document for the proposed public watermain loop around the church
building on Lot 1, Block 1.
5. A 10' drainage and utility easement must be provided adjacent to the southern
edge of the Magellan pipeline easement across the entirety of Lot 1, Block 1 and
Outlot A for small utility purposes.
The following items must be addressed prior to approval of a grading permit, a
building permit and /or a street and utility plan:
1. The applicant will obtain the necessary MnDOT and Scott County
permits /approvals. Copies of these permits /approvals will be provided to the City
of Shakopee.
2. The applicant will obtain a National Pollutant Discharge Elimination System
(NPDES) construction site permit prior to any land disturbing activity. A copy of
this permit will be provided to the City of Shakopee.
3. The applicant will grade the entire site, as proposed on the approved plans, in one
phase within one (1) year from the date of approval of the grading permit
application. Grading is defined as bringing the site to the proposed finished grade
with materials deemed acceptable by the City of Shakopee engineering
department, providing topsoil per City requirements and applying seed, mulch
and/or sod per City requirements and potentially providing an as-built record
grading plan per Section 2.5 of the City of Shakopee Design Criteria.
4. The applicant will provide pretreatment of runoff prior to entering the proposed
infiltration basin/areas per requirements set forth in Section IV, Subdivision A8 of
the City Shakopee Comprehensive Water Resource Management Plan.
5. The applicant will incorporate adequately established and protected emergency
overflow routes for all storm water basins into the design.
6. The applicant will provide plans for all public improvements as set forth in
Section 11 of the City of Shakopee Design Criteria.
7. The applicant will raise the elevations of the proposed Crossings Boulevard cul-
de -sac in order to route the storm sewer from C135 and C136 to an existing storm
sewer structure in Crossings Boulevard to the south_ This will be a public system.
The remaining storm sewer proposed to accommodate the site will be private and
will be routed in a separate system through Outlot B.
8. The applicant will move the proposed driveway located in the northwest portion
of the cul -de -sac to the west. The driveway needs to be offset from the property
line a minimum of five (5) feet per Section 11.62, Subdivision 3F of the City
Code.
9. The centerline of the proposed common driveway located south of the cul -de -sac
will be aligned with the centerline of the existing access to the transit site, or at a
location approved by the City Engineer.
10. The proposed common driveway located south of the cul -de -sac will intersect
Crossings Boulevard at a ninety (90) degree angle, or at an angle approved by the
City Engineer.
11. The applicant will submit design calculations for the proposed six (6) inch
sanitary sewer service to the site and for one to Outlot A.
12. An adequately sized sanitary sewer service will be added to MH2 to serve Outlot
A. The angle of service connections to MH2 will be such to limit the diameter of
the structure to forty -eight (48) inches.
13. The paved trail on the west side of Crossings Blvd must be extended to the
western edge of the northerly driveway access to Lot 1, Block 1.
14. The sidewalk on the east side of Crossings Blvd must be extended to the eastern
edge of the northerly driveway access to Lot 1, Block 1 at the time of the
development of Outlot A.
15. The applicant must comply with the Stormwater Management Plan review by Ted
Witkowski of WSB Engineering. The comments are provided in an e -mail
message dated January 25, 2014.
16. Record plans will be provided per the City of Shakopee Design Criteria, Section
2.5 and Section 11.2 (A -L). The record plans will be submitted to the engineering
department.
17. Both shared driveways must be 28' in width.
18. The 5 legged intersection west of the northern driveway access shall be reduced to
a 4 -way intersection with a design approved by the City Engineer.
19. The applicant must comply with the MnDOT memorandum dated January 29,
2014.
1) Following approval and recording of the final plat, the following conditions shall
apply:
1. The following trees are not accepted as replacement or landscaping trees:
a) Maple (Acer)
b) Ash (Fraxinus)
c) Spruce (Picea)
2. No more than 1/3 of the landscaping trees may be any one species.
3. 193 landscaping units are required per Sec. 11.60 Subd. 8. of City Code for this
site.
4. Final grading requires the placement of a minimum 6 inches of topsoil meeting
requirements set in MnDOT's "SELECT TOPSOIL BORROW' (spec. 3877.2 B,
Table 3877 -2).
5. Trees shall be planted according to the following conditions:
a) Trees shall be planted a minimum of 4 feet from impervious surfaces.
b) Trees shall be planted a minimum of ten feet from property lines.
c) Trees shall not be planted in easements containing utilities.
d) Trees shall not be planted in City owned right -of -way.
e) Trees shall not be planted below overhead utilities.
1) Trees shall not be planted below high water levels (HWL) in existing or
created ponds or wetlands.
6. `The City of Shakopee, MN Tree Planting Detail' or planting detail displaying
the same specifications shall be placed on the landscaping plan. If the installed
trees do not meet these specifications or trees are determined unhealthy by City of
Shakopee staff they will be removed and replaced at the expense of the applicant.
7. The warranty period will not begin until installed plants are inspected by City
staff and determined acceptable. Call the Shakopee Natural Resources Dept. to
schedule inspection, 952- 233 -9511.
8. Soil compaction for all non - structural landscaped areas (including landscaping
islands) shall be between 75 % -80% of Standard Proctor (maximum dry density)
for a minimum of the top 18" of soil. Compaction samples are to be taken after
final grading of the site is complete. Results of the compaction tests are to be
approved by the Natural Resource Department before installation of landscaping
begins. Please contact Jacob Busiahn at 952- 233 -9511 or
ibusiahnkci.shakopee.mn.us to arrange testing prior to final grade. (This
specification must be placed on the grading and landscaping sheet).
9. Soil compaction testing fee for landscaped areas shall be paid to the City.
10. Significant Trees will likely need to be removed due to installation of the
proposed drainage systems, tree replacement per City Code See. 11.60 Subd. 9 is
required.
11. The proposed storm sewer running along Crossing Boulevard draining to regional
pond EC -9P would require the removal of 6 bur oak trees ranging from 12 -16
diameter inches in size. If City Engineering requirements permit, this storm sewer
shall be moved to the west property line. This site is within a Natural Resources
Corridor and requires no feasible or prudent alternative to removing significant
trees within.
12. Tree protection fencing shall be installed between existing trees and proposed
storm sewer. The fencing shall be no closer than 1.5 feet x inches of DBH for
preserved oak trees or the dripline for all other tree species. Please contact Jacob

inspection.
13. The applicant must receive the necessary permissions / agreements to encroach
into the Magellan pipeline easement with parking areas, any grading,
construction, or installation of utilities.
14. The applicant will be responsible for any additional traffic control measures
required to manage the traffic generated by their use and shall follow methods
described in the traffic study prepared by SIZE Consulting.
15. A property owner's association or maintenance agreement for the driveway must
be executed designating the party responsible for maintaining the driveway, and
granting the party right to assess all properties benefiting from the driveway for
the cost of maintenance. The agreement shall also grant the City the right to enter
and maintain the driveway when it deems necessary to maintain safe access, and
to charge the cost of such maintenance back to the property owners.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA, AS FOLLOWS:
That the application for Variance is hereby APPROVED, based on the following findings
with respect to City Code See. 11.89, Subd. 2, "Criteria for Granting Variances."
Criteria #1: The variance request is in harmony with the purposes and intent of the
ordinance.
Finding #1: The variance request is in harmony with the purpose and intent of the zoning
ordinance to allow commercially zoned land to develop.
Criteria #2: The variance request is consistent with the comprehensive plan.
Finding 42: The variance request is not in conflict with the comprehensive plan.
Depending on the future use of the adjacent Outlot A, a public street may be
extended to Stagecoach Road
Criteria #3: The variance request allows the property to be used in a reasonable
manner.
Finding #3: The variance request allows this property and the adjacent properties to
develop with a public street frontage and allows for an area for vehicles to
turn around.
Criteria #4: There are unique circumstances to the property not created by the
landowner
Finding 44: Crossings Boulevard currently exceeds the 750' cul -de -sac maximum. The
situation was not created by the landowner.
Criteria #5: If granted, the variance request will not alter the essential character of
the locality
Finding #5: The variance request allows for a cul -de -sac to be built less than 200' from
the current dead end of Crossings Boulevard. It is possible that Crossings
Boulevard will be extended to Stagecoach Road in the future.
Criteria #6: The variance is not a use variance.
Finding #6: The proposed variance request for an over- length cul -de -sac is not a use
variance.
