SHAKOPEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Lori Hensen, Deputy City Clerk DATE: 02/18/2014 SUBJECT: Set a hearing for Tuesday, March 18, 2014, at 7:00 p.m. for Tobacco Violation Hearing. (F) Action Sought City Council is asked to set a date to review the actions of tobacco licensee Riverside Liquors. Background Any licensee who furnishes, sells, or attempts to sell tobacco, tobacco products or tobacco related devices to a minor or whose employee furnishes, sells or attempts to sell tobacco, tobacco products or tobacco related devices to a minor shall be charged an administrative fine and shall also have his or her license suspended as outlined in the City Code. Staff is ready to proceed with the setting of a hearing date to consider the tobacco violations that occurred during the compliance check on August 14, 2013. This is the first violation for Riverside Liquors with -in a three year period. Under current ordinance, adopted by City Council on March 2, 2010, the penalties for a first or second incident shall be imposed and administered by the City Administrator upon an admission by the licensee that the licensee furnished or sold tobacco to a minor. Any licensee with a first or second violation with -in a three year period who admits to the violation and does not ask for a hearing will not need to appear before City Council. Notices of the hearing and Admission to Violation forms will be mailed after Council sets the date for the hearing.
