S14A1C ME TO: Mayor and City Council Mark McNeill, City Administrator FROM: Jamie Polley, Parks, Recreation& Natural Resources Director DATE: 01/21/2014 SUBJECT: Authorization to Submit Outdoor Recreation Grant Application for Quarry Lake Park, Resolution No. 7404 (A) Action Sought The City Council is asked to offer Resolution No. 7404, A Resolution of the City of Shakopee, Minnesota Authorizing the City to submit an Outdoor Recreation Grant Program Application for the Quarry Lake Project. Introduction This agenda item requests the City Council to adopt a resolution authorizing the grant submittal to the Minnesota Department of Natural Resources for the Quarry Park project. Background and Discussion Our work with the Shakopee-Prior Lake Water Ski Association on acquiring funding for the Quarry Park project continues with another round of grant applications. As you may recall, we were successful in securing $92,000 in funding in 2005 and $78,000 in funding in 2006. These grants had to be turned back to the Department of Natural Resources in 2011 due to the inability to obtain public access. Public access has now been obtained and the planning of the park can begin.The attached resolution would allow us to submit for additional funding. The Outdoor Recreation Grant does require a 50% local share that can consist of cash or value of materials, labor and equipment usage. Requested Action If City Council concurs, it should, by motion, Adopt Resolution No. 7404, A Resolution of the City of Shakopee, Minnesota Authorizing the City to Submit an Outdoor Recreation Grant Program Application for the Quarry Park Project. Attachments: Resolution No. 7404 RESOLUTION NO. 7404 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA AUTHORIZING THE CITY TO SUBMIT AN OUTDOOR RECREATION GRANT PROGRAM APPLICATION FOR THE QUARRY PARK PROJECT WHEREAS, the City of Shakopee acquired and has plans to develop a reclaimed aggregate quarry in Shakopee for reuse as a park, recreation, and natural resource amenity; and, WHEREAS, such a project will help improve the quality of life in the southwest metropolitan area by providing a truly unique amenity; and, WHEREAS, the City is seeking funding assistance to fulfill the vision set forth in this project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that the City of Shakopee (The City)will act as legal sponsor for the project contained in the Outdoor Recreation grant application to be submitted on March 31, 2014 and that appropriate City staff are hereby authorized to apply to the Department of Natural Resources for funding of the Quarry Park Project on behalf of the City. BE IT FURTHER RESOLVED that the City has the legal authority to apply for financial assistance, and financial capability to meet the match requirement and ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life. BE IT FURTHER RESOLVED that the City has not incurred any development costs related to project work described in the grant application. BE IT FURTHER RESOLVED that the City has acquired fee title over the land described in the site plan included in the application. BE IT FURTHER RESOLVED that upon approval of its application by the state, the City may enter into an agreement with the State of Minnesota for the above-referenced project, and that the City certifies that it will comply with all applicable laws and regulations as stated in the grant agreement including dedicating the park property for uses consistent with the funding grant program into perpetuity. NOW, THEREFORE BE IT RESOLVED that appropriate city officials are hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant following final approval from City Council.
