S rEE TO: Mayor and City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director DATE: 11/06/2013 SUBJECT: Discussion of Winter Parking Restrictions & Snow Emergency Concepts (B) Action Sought Provide direction on Winter Parking Restrictions for 2013-2014 on continuing the current ordinance or to bring back a revised ordinance. Background From the October 15, 2013 City Council meeting, Council directed staff to bring back information on winter parking restrictions and discussion on a snow emergency parking concept. The current parking restrictions were adopted in 2001 and revisited in 2005. Attached are memos on the information and discussion prior to adopting Ordinance No. 614 and the review in 2005. The revision in 2001 changed the City from all calendar parking to calendar parking in the "Old Shakopee" and no parking in the new areas from November 1 to March 31 and from 2:00 AM to 6:00 AM. Those parking restrictions remain in force when there is a snowfall of 2" or more and until the street is plowed curb to curb. The 2" or more snowfall triggers an automatic snow emergency per the ordinance. Once the street is plowed curb to curb, residents can park on the street except as per winter parking restrictions. Staff did investigate nearby cities and attached are the parking restrictions for Chaska, Chanhassen, Savage, Prior Lake, Lakeville and Burnsville. Most cities are similar to our current ordinance with Savage and Burnsville having restrictions year round and only Chaska has calendar parking throughout their City. The main discussion on the current ordinance is whether to allow parking when it is not snowing and to have vehicles comply with the winter parking restrictions ordinance upon a snow emergency (2" or more). From an operation standpoint, vehicles not in the street when plowing, is the most efficient and safest operation for the workers and residents. If residents forget to remove their vehicles in a snow emergency, the towing of vehicles will be necessary to complete snow removal operations. If the vehicles remain, snow removal will be hampered and staff will need to go back the following day to clean up. Typically, snow plowing operating is for all streets to plowed one day and snow removal of the downtown area the next day. Removal of snow by parked vehicles will add to the plowing operation. Another issue raised for discussion was to go with calendar parking for the entire city. Calendar parking works for "Old Shakopee" as the streets are on a grid system. In the new areas, there are several curvilinear streets and cul-de-sacs in which calendar parking can be confusing. Also in Southbridge, the streets are 30 feet in width and parking on one side all year round. Thus the decision in 2001 to not have calendar parking in the new areas and new subdivision lots which typically have 2 or 3 car garages and wide driveways. Another factor to consider is that the equipment purchased today and in past y ears is most effective for when cars are not on the street. In summary, for Public Works perspective, the current ordinance has worked well to be efficient in a snow emergency and is the safest for the operators and residents. Recommendation Staff recommends to leave the ordinance as it currently exists. Budget Impact Could increase cost to plowing operations if cars are allowed on streets where they are not currently. Relationship to Vision This supports Goal E: Deliver effective and efficient public services by staff of well-trained, caring, and professional employees. Requested Action Provide direction on Winter Parking Restrictions for 2013-2014 on continuing the current ordinance or to bring back a revised ordinance. Residences without established driveway exempt. CHASKA DIVISION 2. WINTER PARKING Section 33. Parking so as to impede snow removal prohibited. No vehicle shall be operated or parked in a manner or place that obstructs or impedes the City Street Department in clearing or removing snow from the City streets, alleys or parking lots. (Ord. No. 183,Sec. 1, 116169) Section 34. No parking signs. No vehicle,except emergency vehicles, police cars or vehicles parked temporarily for the delivery of merchandise shall be allowed to park contrary to permanent or temporary snow removal signs placed by the City Police Department or City Street Department. (Ord. No. 183,Sec. 2, 116/69) Section 35. Parking requirements during certain months of the year. During the period of November 1st to April 1st inclusive, parking on the streets of the City of Chaska shall be permitted as follows: Whenever snow accumulates on the City streets to a depth necessitating plowing and removal operations, and/or whenever a snow emergency has been declared to exist by the announcement of same by the Mayor or his designated representative on a local radio station broadcast, parking on all streets except as set forth in Section 36 of this chapter shall be permitted only as follows: (a)On any even-numbered day of the month,on that side of the street adjacent to buildings bearing even-numbered street addresses; (b)On any odd-numbered day of the month,on that side of the street adjacent to buildings bearing odd-numbered street addresses. For purpose of this section,the calendar date before midnight shall apply until 8:00 a.m. of the following morning. (Ord. No. 183, Sec. 3, 116169; Ord. No. 244, Sec. 2, 217177) Section 36. Provisions not applicable to business district. The provisions of Section 35 of this chapter shall not apply to the streets in the business district. (Ord. No. 183, Sec. 4,116169) Section 37. Depositing snow from private property on public property. (a) No snow shall be removed from private property and subsequently deposited on a public street, park or parking area. (b) It shall be the responsibility of the property owner to remove snow from private property. (Ord. No. 183, Sec. 5, 116169) Section 38. Reserved. Section 39.Towing away of vehicles in violation of division. (a) In addition to any fine as set forth in Section 08(a) of Chapter 1, any vehicle which shall be parked or standing in violation of this division may be summarily removed without notice to the owner or operator by officers of the City Police Department or by persons employed or designated by them, and stored in any appropriate place. All necessary costs and expense of towing, removing and storage of such vehicles shall be first paid to the person or persons designated by the Police Department by the Persons claiming the vehicles before release of same. (b)The City, its agent or its employees,shall not be responsible for any damage to such vehicles removed in accordance with the provisions of this division. (Ord. No. 183,Sec. 6, 116169) CHANHASSEN Per Chanhassen City Code,Section 12-16, on-street parking is prohibited between November 1 and April 1 between the hours of 1:00 a.m. and 7:00 a.m. On-street parking is also prohibited when there are two inches or more of snow on a street until the street has been plowed curb to curb. Representatives of the Carver County Sheriffs Department, Minnesota State Patrol, and Community Service Officers shall have the authority to impound vehicles in violation of this section. PRIOR LAKE Winter Parking Restrictions In order to expedite the prompt and efficient removal of snow from City streets, it is unlawful for any person to park any vehicle on any street within the city between 2 a.m.and 6 a.m. from Nov. 1 until March 31. It is also unlawful to park any vehicle at all other times following a continuous or intermittent snowfall with an accumulation of two or more inches,or during a snow emergency, until the snow has been plowed to the full width of the street.Any vehicle parked in violation of this subsection may be towed pursuant to Minnesota Statutes Section 169.041.A violation of this subsection shall be a petty misdemeanor. The city contracts with Allen's Towing Service at(952)894-1000, 7215 W. 128th St. in Savage. SAVAGE Parking on City streets is prohibited between 2 a.m. and 6 a.m, on any day, except as may be allowed specifically by designated signage or by permit. Tickets will be issued for violations. The reasons for these restrictions are aesthetics, public safety and the need for efficient snow removal, street sweeping and street repair. A resident may request a parking variance by contacting the Savage Police Department at 952.882.2600. BURNSVILLE Burnsville Does Not Allow Overnight Parking On City Streets From 2 to 6 a.m. LAKEVILLE The City of Lakeville's winter parking ordinance is designed to help promote public safety and allow for efficient snow removal.The ordinance prohibits on-street parking between 2 a.m. and 6 a.m. daily from November 1 to April 1 each year. On-street parking is also prohibited when it's snowing, until the street has been cleared. The entire ordinance reads: Lakeville Ordinance 6-1-1-3(B) No owner of a motor vehicle, trailer, boat, snowmobile, or seasonal vehicle shall leave, park, or permit the same to stand on a street or alley between the hours of 2 a.m. and 6 a.m. between November 1 and April 1 of each year, or at any other time when the National Weather Service forecast accumulation is two(2)or more inches of snow, until the street or alley has been plowed. Residences without an established driveway,to include new construction, are exempt from winter parking restrictions. BACKGROUND: At the September 18, 2001 City Council meeting, the City Council considered several alternatives in revising the ordinance that regulates parking during snow removal periods in the City of Shakopee. After much discussion, the City Council directed staff to utilize Alternative No. 5, with a combination of Alternative No. 2, so that there would be two areas within the City of Shakopee one having calendar parking restrictions and the other having no parking restrictions during the winter period of November 1 through March 31. City staff and the City Attorney have worked together to revise Ordinance 9.50, which accomplishes the Council direction. In this ordinance, the area defined that would allow calendar parking is described as the area west of Marschall Road, north of 10`x' Avenue and east of C.R. 69 to the Minnesota River. This area would be allowed to have calendar parking based on an odd and even address.and odd and even calendar days. This ordinance provision means that on one side of the street during the winter months, in this area, parking is allowed on one side of the street. Two exceptions in this area that currently exists in the current ordinance is in the Central Business District and along 2nd Avenue, from Sommerville Street and Naumkeag Street. Staff is recommending no change in these regulations at this time. In the other areas of City, outside of the area described previously, parking restrictions between the period of November 1 and March 31 would be that no parking would be allowed on City streets between 2:00 A.M. and 6:00 A.M. In addition to these parking restrictions, during November 1 to March 31, a snow emergency which is defined as a following streets in the Central Business District between 2:00 A.M. and 6:00 A.M. on any day of thy.year to-wit: Second Avenue, First Avenue and Levee Drive between Sommerville and Fuller Streets, and Lewis Street, Holmes Street and Fuller Street between Second Avenue and Levee Drive. It should be pointed out to City Council that this revised parking restriction has not been publicized in the local newspaper, thus these changes that City Council has been considering may not be widely known to the public. The Council can consider adopting this ordinance at the October 2, 2001 meeting or delay this adoption until October 16, 2001 after a news article has be published on the proposed changes. ALTERNATIVES: 1. Adopt Ordinance No. 614, an ordinance pertaining to vehicle parking restrictions and amending Section 9.50 of the City Code. 2. Delay the adoption of this ordinance to the October 16, 2001 Council meeting until the public has had a chance to respond. 3. Table for additional information. RECOMMENDATION: Staff recommends Alternative No. 1, to adopt Ordinance No. 614 and publish this ordinance so that the public can be informed of the new restrictions to this coming snow season. BACKGROUND: At the September 18th City Council meeting,the Council first heard proposals from staff to restrict on-street parking during snow removal periods in the City. Enactment of these changes was delayed twice, so as to allow sufficient time to publish a story in the local newspaper, and give residents an opportunity to comment before enactment. However,publication did not take place, and in order for the ordinance changes to be enacted in time to provide a transitional"warninf period before the normal first snowfall,the Council did enact this on October 17 . Beginning November I",the Police Department began issuing"warning"notices to vehicles that were parked in violation of this ordinance. Judging from the number of warning tickets issued,there was still a sizeable portion of the community that had not been aware of the changes,which ultimately were described in a newspaper story published after enactment. Note that advisory signing has been delivered,and installed in most locations. Since the warning tickets have been issued, City staff,especially the Police Department, and some Council members have received calls from residents who are upset with the changes. Several have noted an inability to comply,owing to the lack of available off street parking options at their particular residences. Several have requested an opportunity to speak before the City Council about these changes. For this reason,an agenda item has been placed on the November 2&City Council meeting to allow for an opportunity to discuss. ACTION REQUIRED: The Council should hear concerns of the affected residents,and give direction to staff as to what,if any,changes it wishes to make to Section 9.5 of the City Code. Council reviewed 6 alternatives on the ordinance change and then directed staff to prepare a draft ordinance using Alternative No.2 and No. 5. Ordinance was drafted and reviewed on October 2, 2001 and final changes made for an ordinance adoption on October 16,2001. Several residents wanted to discuss the changes in the ordinance on November 20,2001 and this meeting was held and concerns heard from several residents. DH:pm 2 CITY OF SHAKOPEE Police Department Memorandum TO: Honorable Mayor and City Council Mark McNeill, City Administrator FROM: Jeff Tate, Chief of Police/Emergency Management Director SUBJECT: Winter Parking Enforcement DATE: November 6, 2013 BACKGROUND The police department has been educating and enforcing the winter parking ordinance since its adoption in 2001. Since then,there have been multiple discussions with council on the effectiveness of this particular ordinance. Despite this ordinance being over a decade old, the police department has always taken the approach that education is more important than enforcement. The city has used every communication tool at our disposal to inform residents of the winter parking regulations. Additionally,the police department places warning tickets on violators' vehicles before any ticket is written. Since its inception,the police department has always issued more warnings than tickets. We've found this to be effective in reducing violations prior to major snow fall, and it is our current plan to continue with that practice again this year. Despite all of our warnings and education efforts, we still see violators when snow accumulates. For multiple reasons, those few violations are problematic to deal with when the snow plows go out. First,when it snows, officers are often responding to other calls for service and accidents associated with weather. This takes them away from enforcement and towing violators. Secondly,this ordinance takes effect between 2:00 a.m. and 6:00 a.m. Our staffing minimums are at our lowest for the day during these times (three officers). Lastly,patrol officers cannot ticket and tow faster than the plows go by. If there are numerous traffic accidents, it may be more than a day before an officer can get to a violation. The result is several "snow birds",which requires the public works department to go back and redo the street on a later date. This highlights the importance of obtaining voluntary compliance prior to any snowfall accumulating. The police department does feel strongly that without the education efforts and the current language in the ordinance,we would have many more vehicles in violation if we only waited for snow fall to trigger enforcement. 1
