Action Sought
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing work to start at 8:00
AM on Saturday's for the remainder of 2013 and directing staff to publish notice of the suspension
terms with the conditions as recommended by staff.
Background
Ryland Homes, Inc., the contractor for the Dakota Crossing Subdivision Project, has requested
that City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions
on Certain Operations, be suspended for certain work hours.
The above named section of the City Code restricts the hours of operations from 7:00 AM to
10:00 PM on weekdays, and from 9:00 AM to 9:00 PM on weekends and holidays.
Ryland Homes, Inc., is requesting a suspension on the hours to allow for work from 9:00 AM to
7:00 AM on Saturday's.
This request is being made to help expedite the work and meet the schedule for the project. Staff
would recommend a starting time of 8:00 AM as this site is near residents and a 8:00 AM start
time has been approved in past years near residential property.
Staff would recommend that if the suspension of hours is granted, that the approval is subject to
the following conditions:
1. Approval is contingent upon minimizing noise exposure near residents.
2. If property owner complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements and
notice such as a news release would be placed in the Shakopee Valley News.
Recommendation
Staff recommends approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, allowing work to start at 8:00
AM on Saturday's for the remainder of 2013 and direct staff to publish notice of the suspension
terms with the conditions as recommended by staff.

RE: Dakota Crossing—Request for Earlier Work Hours
Dear Mr. Loney:
As we have discussed, it is Ryland's goal to complete the Dakota Crossing development
this fall. We have been working the development schedule with our contractors, adding
additional man-power and overtime, and as of today we feel we have a reasonably good
chance to complete streets in early to mid-November. To help insure improvements are
completed this fall, Saturday work has been scheduled. Ryland understands city
ordinance states Saturday start time is 9:00 AM, with this letter Ryland requests a 7:00
AM start time to help out with our schedule.
Ryland appreciates the city considering this request for an earlier start time on Saturdays.
