No. 6588 CITY OF SHAKOPEE '1. 8- Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Public Hearing for the 2007 Bituminous Overlay, Project No. 2007-5 DATE: March 6, 2007 INTRODUCTION: As per Resolution No. 6567, a resolution receiving a report and calling for a public hearing on the 2007 Bituminous Overlay, Project No. 2007-5, a public hearing is scheduled for March 6, 2007. This agenda item is to conduct the public hearing for the proposed improvements associated with the 2007 Bituminous Overlay Project. BACKGROUND: On November 21,2006 the City Council ordered the preparation of a feasibility report to analyze a bituminous overlay of 1ih Avenue, from approximately 300 feet east ofCSAH 83 to Valley Park Drive; and Valley Park Drive, from 12th Avenue to the railroad tracks. These two streets have been combined into the 2007 Bituminous Overlay. On February 8, 2007, staff sent a notice of the public hearing to the property owners being affected by the proposed project. PROJECT COSTS: The total estimated project cost for this project is $642,044.02 30% of the street improvements ($241,697.41) will be assessed to the benefiting properties. The remaining costs ($400,346.61) associated with the improvements will be paid from State Aid Funds. ALTERNATIVES: 1. Adopt Resolution No. 6588, a resolution ordering the improvement and the preparation of plans and specifications for the 2007 Bituminous Overlay, Project No. 2007-5. '. 2. Deny Resolution No. 6588. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Table Resolution No. 6588, to allow time for staff to prepare additional information and/or revise the feasibility report as directed by City Council. 4. Modify Resolution No. 6588, to reduce the scope of the project area, as determined by City Council. RECOMMENDATION: If Council desires to proceed with this project, at this time, then Resolution No. 6588 needs to be adopted, a resolution ordering the improvement and the preparation of plans and specifications. If City Council does not wish to pursue this proj ect, then the appropriate action would be to move the approval of Resolution No. 6588 and vote against the motion. If City Council wants more information on the project and/or to amend the feasibility report, then Alternative No.3 is recommended. ACTION REQUESTED: Offer Resolution No. 6588, A Resolution Ordering an Improvement and Preparation of Plans and Specifications for the 2007 Bituminous Overlay, Project No. 2007-5, and move its adoption. ~e~ Public Works Director BUpmp ENGR/2007PROJECT/20070VERLA YIWORD/MEM6588 RESOLUTION NO. 6588 A Resolution Ordering An Improvement And Preparation Of Plans And Specifications For The 2007 Bituminous Overlay Project No. 2007-5 WHEREAS, Resolution No. 6567 adopted on February 6,2007, fixed a date for Council hearing on the proposed improvement of the 2007 Bituminous Overlay Project and all appurtenant work; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 6th day of March, 2007, at which all persons desiring to be heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: 2007 Bituminous Overlay Project and all appurtenant work. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2007-5 Public Improvement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution.
