Project No. 2007-2

INTRODUCTION:
This agenda item is to conduct the public hearing for the proposed improvements
associated with the 2007 Street Reconstruction Project.
BACKGROUND:
On October 3, 2006, City Council ordered the preparation of a feasibility report for the
2007 Street Reconstruction Project. The report was completed and accepted by City
Council on February 6, 2007. This proposed project includes reconstructing the
following streets:
. Main Street, from 6th A venue to 10th Avenue
. 6th A venue, from Spencer Street to Main Street
. 7th A venue, from Spencer Street to Market Street
. 8th A venue, from Spencer Street to Market Street
. Dakota Street, from 3rd Avenue to Milwaukee Road
On February 22,2007, staff conducted an informational meeting for the property owners
being affected by the proposed project. Approximately 22 residents attended the meeting.
The residents in attendance at the informational meeting had some general questions
regarding the design, construction schedule and assessment payments. After the meeting,
only a few residents had additional questions regarding drainage in their property. All of
the residents in attendance, with the exception of one, seemed in favor of narrowing the
street in an effort to create more green space and lower costs.
PROJECT COSTS:
The total estimated project cost for the 2007 Reconstruction Project is $2,065,897.89.
30% of the street improvements ($390,308.60) will be assessed to the benefitting
properties. The remaining costs ($910,718.80) associated with the street improvements
will be paid from General Tax Levy Funds.
Storm sewer improvements ($149,947.13) will be paid from the Storm Sewer Fund.
Watermain improvements ($331,610.78) will be funded by Shakopee Public Utilities.
Sanitary sewer improvements ($283,312.58) will be paid from the Sanitary Sewer Fund.
Prior to closing the public hearing, Council should discuss and consider the corner lot
assessment question made on credits to corner lots that have been assessed within the last
15 years, and was discussed at the February 20,2007 Council meeting. Staffhas prepared
a memo with recommendations on this issue.
ALTERNATIVES:
1. Adopt Resolution No. 6587, a resolution ordering the improvement and the
preparation of plans and specifications for the 2007 Street Reconstruction, Project
No. 2007-2.
2. Deny Resolution No. 6587. This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 6587, to allow time for staff to prepare additional
information.
RECOMMENDATION:
If Council desires to proceed with this project, at this time, then Resolution No. 6587
needs to be adopted, a resolution ordering the improvement and the preparation of plans
and specifications. If City Council does not wish to pursue this project, then the
appropriate action would be to move the approval of Resolution No. 6587 and vote
against the motion.

A Resolution
Ordering An Improvement And Preparation Of
Plans And Specifications For The
2007 Street Reconstruction
Project No. 2007-2
WHEREAS, Resolution No. 6568 adopted on February 6,2007, fixed a date for Council
hearing on the proposed improvement of the 2007 Street Reconstruction Project and all
appurtenant work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 6th day of March, 2007, at which all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
2007 Street Reconstruction Project and all appurtenant work.
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2007-2 Public Improvement
Program.
4. The City Council shall let the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041, no later than three years from the date of adoption of this
resolution.
