Cox, City Clerk SUBJECT: Setting Date for Alcohol Violation Hearing DATE: February 28, 2007 INTRODUCTION: City Council is asked to set a date to review the actions of a certain alcohol licensee. BACKGROUND: The City Code prohibits any person to sell, barter, furnish, or give alcoholic beverages to a minor unless such person is the parent or guardian of the minor, and then only for consumption in the household of such parent or guardian. Licensees are subject to a fme that may be imposed by the City or by the State of up to $2,000 and revocation or suspension of the license of up to 60 days. Staff is ready to proceed with the setting of a hearing date to consider an alcohol violation that occurred during the alcohol sales compliance check on May 18, 2006. This is the first violation for the Bounkong Yabandith, dba Thailand View Restaurant, 1135 East 1st Avenue, within a three-year period. Under the current ordinance, adopted by City Council on July 2, 2002, the penalties for a first or second incident shall be imposed and administered by the City Administrator upon an admission by the licensee that the licensee furnished or sold an alcoholic beverage to a minor. Any licensee with a first or second violation within a three-year period who admits to the violation and does not ask for a hearing will not need to appear before City Council. (During the compliance check on May 18th, there were two additional violations that occurred. They were Shakopee K wik Mart, Inc., 234 West 1 st A venue and Raul Alvarado dba EI N opal, 815 West 1 st Avenue. Both of these businesses have changed hands.) RECOMMENDED ACTION: Set a hearing for Tuesday, April 3, 2007, at 7:00 p.m., or thereafter, to review the actions of Bounkong Yabandith, dba Thailand View Restaurant, 1135 East 1 st Avenue.
