Action Sought
Offer a motion to approve Resolution No. 7365, a resolution approving the Final Plat of Valley
Park Business Center 2nd Addition, and move its adoption.
Discussion
Opus Development Company, LLC has submitted an application for final plat approval of Valley
Park Business Center 2nd Addition. The plat proposes the subdivision of Outlot A, Valley Park
Business Center 1 st Addition, and would create one lot and two (2) outlots. The subject property
is located south of County Road 101, east of Valley Park Drive, and north of Innovation
Boulevard (see Exhibit A for location). The subject property (Outlot A, Valley Park Business
Center 1 st Addition) is approximately 41.4 acres in size. The new lot would be approx. 11.8
acres, with the new Outlot A having an area of 28.4 acres, and the new Outlot B consisting of 1.2
acres.
The applicant is proposing the creation of this lot to accommodate the construction of a building
that will be utilized for offices and warehouse use. The facility is proposed to be approximately
198,000 square feet in size, with the potential to be utilized for 1-6 tenants.
Because of these previous platting activities, many of the typical actions associated with platting
have already been addressed. Staff did receive comments from City Engineering, Parks &
Recreation, and Natural Resources. Their comments have been incorporated into the draft
Resolution for the Council's consideration. The conditions include references to drainage and
utility easement requirements, Woodland Management regulations, and payment of park
dedication fees.
Long Term Goal
This action supports:
Goal B: Positively manage the challenges and opportunities present by growth, development and
changes.
Alternatives
1. Approve Resolution No. 7365, approving the Final Plat for Valley Park Business Center 2nd
Addition, subject to the conditions presented.
2. Approve Resolution No. 7365, approving the Final Plat for Valley Park Business Center 2nd
Addition, subject to revised conditions.
3. Do not approve the final plat and direct staff to prepare a resolution consistent with the
direction of the Council.
4. Table the matter and request additional information from staff and/or the applicant.

The application indicates a request for a Final Plat review of an industrially zoned development
(1-2) located southeast of the intersection of County Road 101 and Valley Park Drive.
This review is preliminary, as more comments will follow with additional submittals. However,
the engineering department offers the following comments at this time for the applicant and
for the planning department:
General Conditions
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Payments of Trunk Storm Water Charges need to be made, as required by the most
current City of Shakopee Fee Schedule.
2. Provide electronic files (AutoCAD and Adobe Acrobat formats) of the Final Plat to be
recorded with datum on the Scott County coordinate system.
The following items need to be addressed/completed prior to approval of a grading permit
and/or a street and utility plan:
1. The applicant submitted a petition to initiate a public improvement project to construct
public streets, utilities and various other improvements associated with Innovation
Boulevard and Innovation Drive. Please refer to the petition for specifics. Engineering

staff, the City's consultant and the developer will work together to ensure all streets,
utilities and appurtenances comply with the City's requirements.
Final Plat Conditions
The following items need to be addressed/completed prior to release of the Final Plat for
recording:
1. Easements will be shown on the Final Plat as approved by the City Engineer. They
include, but are not be limited to, the following:
• Minimum drainage and utility easements for public storm sewer need to be
dedicated per the City of Shakopee Design Criteria, Section 10.1 (A-D). The
easements need to be centered on the public utility alignments.
• Provide adequate drainage and utility easements to encompass the final storm
public sewer system along the northern property line of Lot 1, Block 1 and east
through Outlot A to Innovation Drive.
• Provide adequate drainage and utility easements to encompass the final storm
public sewer system along the northern property line of Outlot A.
• Provide adequate drainage and utility easements to encompass the high water level
of the public storm water basin in the southernmost portion of Outlot A.
Storm Water Management Plan Review
The applicant submitted a petition to initiate a public improvement project to construct the
public streets, utilities and various other improvements associated with Innovation Boulevard
and Innovation Drive. Engineering staff, the City's consultant and the developer will work
together to ensure the storm drainage system complies with City requirements.
Recommendation
Engineering staff recommends approval of the Final Plat application subject to the conditions
above being addressed/completed by the applicant.

INTRODUCTION
Staff recommends approval of the requested final plat application for the Valley Park
Business Center 2nd Addition with the following conditions:
1. The applicant must meet the requirements in the City's Tree Management
Regulations (Section 11.60 Subdivision 9).
2. The following trees are not accepted as replacement or landscaping trees*:
1. Maple (Acer)
2. Ash (Fraxinus)
3. Spruce (Picea)
4. Apple (Malus)
*Due to genus making up a high percentage of Shakopee's urban forest or the threat
of insect/disease.
3. Final grading requires the placement of a minimum 6 inches of topsoil meeting
requirements set in MnDOT's "SELECT TOPSOIL BORROW" (spec. 3877.2 B,
Table 3877-2).
4. Irrigation systems require rain sensors.
5. Tree Protection Fence shall be in place before grading permit is issued and shall
remain in place for the duration of the land disturbing activities. Removal of the silt
fence and tree protection fence for mass grading will be the responsibility of the
developer.
6. Replacement trees shall be planted according to the following conditions:
1. Trees shall be planted a minimum of 4 feet from impervious surfaces.
2. Trees shall be planted a minimum of ten feet from property lines.
3. Trees shall not be planted in easements containing utilities.
4. Trees shall not be planted in City owned right-of-way.
5. Trees shall not be planted below overhead utilities.
6. Trees shall not be planted below high water levels (HWL) in existing or
created ponds or wetlands.
7. No more than 1/3 of the Replacement Trees may be any one species.
8. No more than 1/3 of the trees shading the parking lot may be of one species.
9. The tree planting information found on the City of Shakopee Natural Resources
webpage: http://www.ci.shakopee.mn.us/nr®trees-woodlands.cfm (or information
showing the same planting specifications) shall be displayed on the landscaping
plan. If the installed trees do not meet these specifications or trees are determined
unhealthy by City of Shakopee staff they will be removed and replaced at the
expense of the applicant.
10. Bare root is an acceptable planting stock for meeting the Landscaping
Requirements. Trees still must meet size requirements. All bare root trees shall be
planted during the spring or fall planting season. Spring planting season is considered
April to early June and fall planting season is considered late September through
November.
11. Soil compaction for all non-structural landscaped areas (including landscaping
islands) shall be between 75%-80% of Standard Proctor(maximum dry density) for a
minimum of the top 18" of soil. Compaction samples are to be taken after final
grading of the site is complete. They are to be submitted and approved by the City of
Shakopee before installation of landscaping begins. A reasonable number of
samples must be taken with even coverage of all landscaped areas. Submit sample
results to the Shakopee Natural Resources Dept.
12. The warranty period will not begin until installed plants are inspected by City staff
and determined acceptable. Call the Shakopee Natural Resources Dept. to schedule
inspection, 952-233-9511.
13. The financial security amount for replacement trees will be determined per the City's
Tree Management Regulations. (#of replacement trees*$200*1.5=Amount of
financial security required.

Introduction
Based on a review of the application materials provided to staff, staff recommends
approval of the requested Final Plat Application for Valley Park Business Center Second
Addition with the following conditions:
1. Park Dedication-Applicant must meet park dedication requirements by
providing cash in lieu of land.
a. Park dedication fees in the amount required by the City Code and
adopted City fee schedule shall be paid at the time of recording of the
final plat.
b. Preliminary park dedication calculations (to be confirmed at time of final
plat) are as follows:
L 11.8 acres minus Easements (an exact calculation of the
easements to be provided to the City prior to recording final plat) X
$6,930/acre ($81,774.00— easement calculation)

2. The applicant shall provide and install park, open space, and trail boundary j
signage as determined to be needed by the city.
3. All trails and sidewalks must be constructed to meet ADA requirements or
guidelines.
4. The applicant must meet the City's Woodland Management Ordinance
requirements.

RESOLUTION NO. 7365
A RESOLUTION OF THE CITY OF SHAKOPEE,NIINNESOTA APPROVING
THE FINAL PLAT OF VALLEY PARK BUSINESS CENTER SECOND
ADDITION
WHEREAS,Opus Development Company, LLC,applicant and property owner,
has made application for final plat approval of Valley Park Business Center 2nd Addition;
and
WHEREAS,the subject property is legally described as:
Outlot A, Valley Park Business Center First Addition, Scott County; and
WHEREAS,the City Council reviewed the final plat on October 1, 2013.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee,Minnesota that the final plat of Valley Park Business Center 2nd Addition is
hereby approved subject to the following conditions:
1) The following procedural actions must be completed prior to the recording of
the Final Plat:
a) Approval of title by the City Attorney.
b) Payments of Trunk Storm Water Charges need to be made, as required by the
most current City of Shakopee Fee Schedule.
c) Provide electronic files (Auto CAD and Adobe Acrobat formats of the Final Plat
to be recorded with datum on the Scott County coordinate system.
d) Payment of park dedication fees in the amount required by the City Code and
adopted Cite fee schedule. That amount equals the area of the dedicated lot minus
easements, calculated at $6,930/acre. Park dedication fees will be required for the
two (2)remaining outlots at time of Final Platting of those lots.
e) Easements will be shown on the Final Plat as approved by the City Engineer.
They include, but are not be limited to,the following:

the developer.
3) The following procedural actions must be completed prior to the issuance of a
building permit:
a) Record plans need to be provided per the City of Shakopee Design Criteria,
Section 2.5 and Section 11.2 (A-L). The record plans need to be submitted to the
engineering department.
4) Following approval and recording of the final plat, the following conditions shall
apply:
a) The applicant must meet the City's Tree Management Ordinance regulations
(Section 11.60 Subdivision 9).
b) Irrigation systems require rain sensors.
c) Final grading requires the placement of a minimum 6 inches of topsoil meeting
