No. 875 (B) Action Sought Adopt Ordinance No. 875, an Ordinance approving the rezoning of the property from I-1, Light Industrial to B-1, Highway Business. Background Introduction: Steve Soltau has made application to request rezoning of property from Light Industrial (I-1) Zone to Highway Business (B-1) Zone. The property is located west of Stagecoach Road, north of Hansen Avenue and the Southbridge Transit Station, and east of County Road 21. The subject site is approximately 40 acres in size. The attached exhibits show the property location, as well as dimensions. Discussion: The request for rezoning to Highway Business (B-1) Zone is consistent with City's Comprehensive Plan. The attached map of the 2030 Land Use Plan depicts the guiding for development in the area of this property. The applicant has stated in their application that there are multiple potential uses for the site including, but not limited to entertainment and retail uses. Currently the applicant leases a portion of the land for farming purposes and states in the application that he may intend to potentially expand the farming operation on the site. Agricultural uses are not a permitted use in the Highway Business zone. The applicant may continue to farm the existing agricultural areas on the site as a legal non-conforming use if the City Council approves this rezoning request. An expansion of agricultural uses would not be permitted once the property is zoned Highway Business. The City's Comprehensive Plan sets basic policies to guide the development of the City. The purpose of designating different areas for residential, commercial, and industrial land uses is to promote the location of compatible land uses, as well as to prevent incompatible land uses from being located in close proximity to one another. The Zoning Ordinance is one of the legal means by which the City implements the Comprehensive Plan. Under Minnesota statute, zoning is to conform to a city's comprehensive plan. The 2030 Comprehensive Plan guides this property for Commercial Use. The Planning Commission has unanimously recommended that the City Council approve this request. There was no opposition to this request from at the public hearing or from adjacent property owners that received the public hearing notice prior to the Planning Commission's review. Recommendation Staff recommends that the City Council offer a motion to approve Ordinance No. 875 and move its adoption. Budget Impact The rezoning of the property allows the property to be developed as the Comprehensive Plan intended, which will provide additional tax base from the improvements to the site. Relationship to Vision By rezoning this property, the City Council would be following the comprehensive plan, which guides this area for commercial development. There are several commercial and industrial projects in the City currently in the construction phase as well as the planning phase. Rezoning of this property allows for this area to develop as the comprehensive plan intended, which complies with the City's visioning goal of positively managing growth. Requested Action Offer a motion to approve Ordinance No. 875, an ordinance approving the rezoning of approximately 40-acres of land from Light Industrial (I-1) zoning to Highway Business (B-1) zoning, and move its adoption. ORDINANCE NO. 875 AN ORDINANCE OF THE CITY OF SHAKOPEE APPROVING A REQUEST TO REZONE PROPERTY FROM LIGHT INDUSTRY (I-1)ZONE TO HIGHWAY BUSINESS (B-1) ZONE WHEREAS, Steve Soltau, applicant, and Shakopee Crossings Limited Partnership,propert y owner, have requested the zoning of property from Light Industry (I-1) Zone to Highway Business (B-1)Zone; and WHEREAS,the subject property is legally described as follows: Outlot A, Southbridge Crossings East First Addition, except those parts of said Outlot A depicted as Parcels IA, 113, and 1C Scott County Right-of-Way Plat No. 39 filed 8/17/2006, as document 748574; and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on June 6, 2013 at which time all persons present were given an opportunity to be heard; and WHEREAS, the Planning Commission recommended that the property be rezoned from Light Industry (I-1)Zone to Highway Business (B-1)Zone; and WHEREAS,the City Council heard the matter at its meeting on October 1, 2013; and NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Shakopee hereby adopts the following findings of facts relative to the above-named request: Finding#1 The original zoning ordinance is not in error. However, the original zoning ordinance established a zoning boundary that was compatible with several existing zones in this area at the time. The adjacent properties have since been rezoned and reguided and developed for commercial uses. Finding#2 Significant changes in community goals and policies that concern this property have taken place, as the comprehensive plan guides this property for commercial development. Finding#3 Significant changes in development patterns have occurred for the subject property. Adjacent uses include the development of US Highway 169 and the major service and retail area known as Southbridge Crossings. Finding 44 The Comprehensive Plan, as adopted by the Shakopee City Council, guides this property for commercial use. The Highway Business Zoning District is a zoning district that allows commercial retail and service uses as intended by the Comprehensive Plan. 1 BE IT FURTHER RESOLVED,that the request to rezone the property from Light Industry(I-1)Zone to Highway Business (B-1)Zone is hereby approved.
