Action Sought
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing work and directing
staff to publish notice of the suspension terms with the conditions as recommended by staff
Background
S.M. Hentges & Sons, Inc., the contractor for the County Project on County Road 17 has
requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly
Restrictions on Certain Operations, be suspended for certain work hours.
Currently, the Saturday work hours are from 9:00 A.M. to 5:00 P.M. for this construction project.
S.M. Hentges Sons, Inc. is requested Saturday work hours for the project be changed to 7:30
A.M. to 5:30 P.M. for the construction duration of the project.
This request is being made to help expedite the work and meet the schedule for the County Road
17 Project.
Staff would recommend that if the suspension of hours is granted, that the approval is subject to
the following conditions:
1. Approval is contingent upon minimizing noise exposure near residents.
2. If property owner complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements and
notice such as a news release would be placed in the Shakopee Valley News.
Recommendation
Approve the suspension of City Code Sec. 10.60,Noise Elimination and Noise Prevention, Subd.
3, Hourly Restrictions on Certain Operations, per this memo, and direct staff to publish notice of
the suspension terms with the conditions as recommended by staff.

Dear Mr. Weyandt,
Due to the tight time frame for completing the construction activities of the above referenced
project,S.M. Hentges&Sons Inc. is submitting a request to modify the Saturday working hours.
Currently the Saturday working hours are from 8:00 AM to 5:00 PM for the construction
duration of the said project. S.M. Hentges&Sons Inc. requests that the Saturday working
hours for the project be changed to 7:30 AM to 5:30 PM for the construction duration of the
project.
