Action Sought
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, allowing work and directing
staff to publish notice of the suspension terms with the conditions as recommended by staff.
Background
Northwest Asphalt, Inc., the contractor for the Valley Park Business Center Project, has requested
that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd. 3, Hourly Restrictions
on Certain Operations, be suspended for certain work hours.
The above named section of the City Code restricts the hours of operation from 7:00 A.M. to
10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and holidays.
Northwest Asphalt, Inc. is requesting a suspension on the hours to allow for work from 6:00 am to
10:00 pm - Monday thru Friday and 7:00 am to 6:00 pm on weekends.
This request is being made to help expedite the work and meet the schedule for the Valley Park
Business Center Project and to provide a paved road to Emerson by October 15, 2013. It is noted
that this work is within the industrial park and should not affect any residents.
Staff would recommend that if the suspension of hours is granted, that th approval is subject to
the following conditions:
1. Approval is contingent upon minimizing noise exposure near residents.
2. If property owner complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements and
notice such as a news release would be placed in the Shakopee Valley News.
Recommendation
Staff recommends Approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, per this memo, and direct
staff to publish notice of the suspension terms with the conditions as recommended by staff.

Northwest Asphalt,Inc.formally requests extended working hours on the above referenced project.
This project has an accelerated completion date and will require extra time and effort to complete this
project within the specified completion date. Due to the location of this site and lack of residential
housing nearby, I would ask that we be permitted to work from 6:OOam to 10:OOpm weekdays.On
weekends, I would ask we be permitted to worl<from 7:OOam to 6:OOpm.
Again,this project has a very aggressive and tight completion, it is necessary for us to work every
possibte hour on this project.
