Action Sought
Gulbrandson Real Estate, LLLP is requesting that the City Council review and approve their
request to vacate public drainage and utility easements.
Introduction
Gulbrandson Real Estate, LLLP has submitted an application for vacation of public drainage and
utility easements on property located at 1624 Weston Court (Apple Ford Shakopee site) and 1684
Weston Court (site on which the Apple Ford Shakopee dealership is proposing an expansion on to
- see Exhibit A for location).
Discussion
The easements referenced in this request (see attached plans) are located under the existing
building, would be located under the proposed expansion area, along with other locations where
they no longer are needed. As part of the minor subdivision application which was recently
submitted and is currently being reviewed by staff, the applicant will be providing new drainage
and utility easements ars requested by city and SPUC staff.
Considerations
The required ten-day notice of the public hearing was provided by publication in the Shakopee
Valley New. Comments from staff inembers and utilities, as well as a recommendation for
approval of the vacation from the Planning Commission, will be presented to the City Council for
consideration.
City departments, Scott County and other outside agencies were given the opportunity to review
and provide comments regarding this application. Planning did receive comments from
Centerpoint Energy, Xcel Energy, SPUC and City Engineering staff. The relevant conditions
have been incorparated into the draft resolution approving the proposed vacation. Centerpoint
Energy referenced a gas service in the easement located between the two lots, the need to relocate
the service line, and reservation of suitable easement rights for Centerpoint. Xcel Energy
originally voiced opposition to the request; however, due to revisions to the proposed vacation and
clarification on which easements are part of this request, they have withdrawn their objection.
City Engineering commented that the majority of easements proposed for vacation were never
utilized, and that the City of Shakopee would retain all other easements on the property. SPUC
referenced which easements may be vacated, the need for a looping connection, and options
available to them for the existing water stub into Lot l, Block 1 from Weston Court. They also
have received an Underground Distribution Agreement between them and the property owner to
provide an underground electric distribution system.
The applicant/property owner has recently revised the site plan by eliminating the car wash
proposed on the southerly portion of the lot, and have scaled back their proposed expansion such
that there is no encroachment over the drainage and utility easements between Lot 1 & Lot 2,
Block 1, Shakopee Valley Marketplace West, and have withdrawn that segment of their request.
Alternatives
1. Approve the vacation request, subject to retaining drainage and utility easements over portions
of the subject area, as described in the City of Shakopee Engineering Department memorandum,
dated 07/25/13, and providing the required watermain looping, per SPUC's requirements.
2. Approve the vacation request, subject to revised conditions.
3. Do not approve the vacation request.
4. Table the decision to allow staff or the applicant time to provide additional information.
Planning Commission Recommendation
The Planning Commission considered the request at its August 8, 2013 meeting, and by a 6 - 0
vote, they recommended Alternative No. 1; recommend to the City Council the approval of the
vacation, subject to retaining drainage and utility easements over portions of the subject area, as
described in the City of Shakopee Engineering Department memarandum dated 07/25/13, and
accepting the withdrawal of the request for vacation of easements between Lot 1 & Lot 2, Block
1, Shakopee Valley Marketplace West.
Action Requested
Approve Resolution No. 7341, a resolution approving a vacation of public drainage and utility
easements on property located at 1624 Weston Court (Apple Ford Shakopee site) and 1684
Weston Court (site on which the Apple Fard Shakopee dealership is proposing an expansion),
and move its adoption.

EASEMENT VACATION
All drainage and utility easements dedicated in SHAKOPEE VALLEY MARKETPLACE WEST, according
to the recorded plat thereof, Scott County, Minnesota, which lies within Lot 1, Block 1, said SHAKOPEE
VALLEY MARKETPLACE WEST, except that part of said easements lying within the West 10.00 feet,the
South 15.00 feet,the Southeasterly 10.00 feet and the East 10.00 feet thereof��+�-�-^0'"�4��s°o fe.`--�.
Together with the 20 foot drainage and utility easement dedicated in said SHAKOPEE VALLEY
MARKETPLACE WEST, which lies within Lot 2, Block 1, said SHAKOPEE VALLEY MARKETPLACE
WEST,the centerline of said 20 foot easement is described as follows:
Commencing at the southwest corner of said Lot 2; thence on a bearing of East, along the south
line of said Lot 2, a distance of 82.05 feet to the point of beginning of centerline to be described;
thence on a bearing of North a distance of 57.99 feet to a point hereinafter known as Point "A";
thence continuing on a bearing of North a distance of 134.01 feet; thence North 67 degrees 30
minutes 00 seconds East a distance of 230.64 feet to a point hereinafter known as Point "B";
thence continuing North 67 degrees 30 minutes 00 seconds East a distance of 13.60 feet;thence

centerline terminates.
Together with a 10 foot drainage and utility easement dedicated in said SHAKOPEE VALLEY
MARKETPLACE WEST,which lies within said Lot 2,the centerline of said 10 foot easement is described
as follows:
Beginning at the aforementioned Point"B";thence South 22 degrees 30 minutes 00 seconds East

As you are aware, this firm represents Gulbrandson Real Estate, LLLP, the owner of the.
above referenced property, and has filed an Application to Vacate Easements with respect to said

Pursuant to our discussion earlier today, we would like to formally withdraw that }�ortion
of the Application to Vacate Easements seeking to vacate the 10 foot drainage and utility
easement dedicated in the plat of SHAKOPEE VALLEY MARKETPLACE WEST, which lies

I have received your email and letter regarding the vacation of utility easements in
Shakopee Marketplace West. I have reviewed your letter and maps and compared them to
the file I received from the City of Shakopee.
I can tell you that I raised an objection because of the following reasons:
1) Northern States Power, d/b/a"Xcel Energy" has reserved an easement on the north side
of Lot 2. Overhead 345 and 230 kv lines span the entire width of the property.
2) The request made by the City indicated that all drainage and utility easements within
Lots 1 & 2 were in question.
3) Additionally,the maps provided by the city made no reference to specific sites within
either Lot 1 or 2.
4) Based on the information provided to me, I understood that our easement was included
in the request.
In light of your letter and attached maps, I am comfortable with withdrawing my objection to
the requested vacation of utility easements within Block 1, Lots 1 & 2 of Shakopee
Marketplace West.

This firm represents Gulbrandson Real Estate, LLLP, the owner of the above referenced
property. Your letter to Tami Vidmar of July 25,2013,has been forwarded to us for response.
I have attached for your reference the diagrams that were submitted to the City of
Shakopee in connection with the Application to Vacate Easements. As you will note, the
easement in favor of Northern States Power d/b/a Excel Energy is not among the easements
sought to be vacated pursuant to the Application. Accordingly, this easement will remain in
place and be unaffected by this process.
In addition, all proposed improvements to the site are to be constructed south of the
existing building located on Lot 2. Therefore, no structures or additional improvements will be
constructed under the transmission lines as a part of the planned improvements.
Based on the foregoing, we would request that you withdraw the objection to the
proposed easement vacation at your earliest convenience.

You have proposed the vacation of utility easements within Block 1, Lots 1 &2 of
Shakopee Marketplace West.
Northern States Power, d/b/a Xcel Energy ("Xcel") objects to this request. On the
north side of Block 1, Lot 2,just south of Hwy 169 and spanning the entire width of the Lot is
an easement which we have reserved. Within this easement are 345 and 230 kv
transmission lines, as well as a 16" gas main.
Additionally, it is important to mention that satellite photos show that the land owner
has developed the area under our transmission lines and built a parking lot. It is important to
clarify that no structures are to be built up under these transmission lines as part of the

The engineering department has completed its review of the vacation request and offers the following

1. It appears the applicant is proposing to vacate drainage and utility easements originally
dedicated for watermain, but never utilized, and the drainage and utility easements

1. The original platted easement on Lot 2,Block l, Shakopee Marketplace West
may be vacated as requested because the watermain was installed in anothei-
location. However, it doesn't appear the intended easement over the
watermain was ever created. So, as a condition of the vacation the City must
require a replacement easement 20 feet wide over the existing watermain on
Lot 2,Block 1, Shakopee Valley Marketplace West.
2. The easement shown on Lot l, Block 1, Shakopee Valley Marketplace West
may be vacated since the planned watermain has never been installed.
However,the property owner shall be required to complete the��vatermain
looping connection shown in the northwest cornei-of Lot 1,Block 1,
Shakopee Valley Marketplace West, froin the end of the existing watermain
near the southwest corner of Lot 2, Block 1, Shakopee Valley Marketplace
West through Lot 1, Block 1, Shakopee Valley Marketplace West to the
watermain stub located on the Pi•ovidence Point property line; with a 20 foot
watermain easement required over the connecting watermain.
3. The existing water stub into Lot 1,Block 1, Shakopee Valley Marketplace
West, from Weston Court shall be:
a. removed if not used per SPUC policy, or
b. used as a service line, or

RESOLUTION NO. 7341
A RESOLUTION APPROVING A VACATION OF PUBLIC DRAINAGE AND UTILTIY
EASEMENTS
WHEREAS, it has been made to appear to the Shakopee City Council that public of drainage
and utility easements adjacent to on property located at 1624 Weston Court (Apple Ford Shakopee
site) and 1684 Weston Court (site on which the Apple Ford Shakopee dealership is proposing an
expansion) is no longer of public use or interest; and
WHEREAS, the public drainage and utility easements to be vacated are legally described
within attached Exhibit (Easement Vacation); and
WHEREAS, the Shakopee Planning Commission considered the request at its meeting of
August 8, 2013, and unanimously recommended approval with conditions to the City Council; and
WHEREAS, a public hearing to consider the action to vacate the public easement was held in
the Council Chambers of the City Hall in the City of Shakopee at 7:00 P.M. on the 20th day of August,
2013; and
WHEREAS, ten days published notice was provided by publication of the notice in the
SHAKOPEE VALLEY NEWS and posted notice was provided by posting such notice on the bulletin
board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the
bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, THAT:
1. It finds and determines that the vacation of the City's interest in public drainage and utility
easements on property located at 1624 Weston Court (Apple Ford Shakopee site) and 1684 Weston
Court (site on which the Apple Ford Shakopee dealership is proposing an expansion) hereinafter
described is in the public interest.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA,THAT:
1. Drainage and Utility easements over portions of the subject area, as described in the City of
Shakopee Engineering Department memorandum, dated 07/25/13, and provide the required watermain
looping, per SPUC's requirements will be maintained and/ar provided in favor of the City and SPUC.
After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County
Auditor and County Recorder of Scott County.
Adopted in session of the City Council of the City of Shakopee, Minnesota, held the
