Action Sought
The Council is asked to adopt Ordinance No. 871, an ordinance of the City of Shakopee
amending Shakopee City Code Section 2.41 dealing with criminal history background checks.
Background
The City routinely conducts criminal history background checks on all prospective employees
prior to hire. During the 2013 session, the Legislature amended the statue regarding this process.
While these statutory amendments will not require us to alter how we actually conduct
background checks, the City Attorney's office is recommending a change to the current language
in our City Code in order to better conform to the new statutory language. The recommended
changes are represented in Ordinance No. 871, which was prepared by Kennedy & Graven.

Requested Action
The Council is asked to, by motion, adopt the attached Ordinance No. 871, an ordinance of the
City of Shakopee amending Shakopee City Code Section 2.41 dealing with criminal history
background checks.

SHAKOPEE CITY CODE SECTION 2.41 DEALING WITH CRIMINAL
HISTORY BACKGROUND CHECKS
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. Section 2.41, subd. 1, of the Shakopee City Code is amended to read as follows:
SEC. 2.41. CRIMINAL HISTORY BACKGROUND CHECKS.
Subd. 1. Criminal Historv Background Checks Authorized. The Police Department is
authorized to conduct a criminal history background investigation on applicants far paid and
volunteer positions with the City, as provided by this Section. For paid employment positions, �

t�e-C� who are selected for interviews or receive conditional offers of emplo�ent., �����
�. The Police Deparhnent may not perform a background investigation unless the applicant
consents in writing to the investigation and to the release of the investigation information to the
City Administrator and other City staff as is appropriate. An applicant's failure to provide consent
may disqualify the applicant for the position sought. This Section does not applv to back.r�
checks related to applicants for�eace officer or firefi h�ter positions.
Section 2. Effective Date. This ordinance becomes effective from and after its passage and
publication.
