No. 7343 (D,E) Action Sought Adopt Resolution No.7343, a resolution which awards a contract to Northwest Asphalt, Inc., and approve a 5% contingency amount on the project for use by the City Engineer in authorizing change orders or quantity adjustments and authorize the appropriate City Officials to execute an extension agreement with WSB & Associates, Inc. to perform construction engineering services. Background Council adopted Resolution No 7330 which approved the plans and advertisement for bids for the Valley Park Business Center Improvement Project No. 2013-6. Previously, a petition was received on June 18, 2013 to initiate the project. On August 16, 2013 a bid opening was held for the Project, in which there were 6 bids opened for this improvement project. The bids are summarized in the attached resolution. From the bid opening, the low bidder is Northwest Asphalt, Inc., with a bid of$3,203,436.83. The Engineer's estimate for the project is $3,700,000.00 which includes the work for the development, off site storm water improvements and park road crossing to Quarry Lake Park. Most of the cost of the project is assessed to OPUS and Emerson who are the developers of Valley Park Business Center. Also, included in the project are Park Reserve items such as bituminous trail, and park road crossing to Quarry Lake Park as well as trunk storm water items. If Council awards a contract, staff is requesting a 5% contingency amount of the construction to cover minor change orders and quantity adjustments. Also to approve an extension agreement with WSB & Associates, Inc. for construction engineering services will be needed as staff is not available to inspect this work. Recommendation To adopt Resolution No. 7343 in order to meet the agreement deadline with Emerson and Opus. Budget Impact This project will be funded through assessments, storm water trunk funds and park reserve funds. Relationship to Vision This supports Goal D: Maintain, improve and create strong partnerships with other public and private sector entities, and Goal E: Deliver effective and efficient public services by a staff of well-trained, caring, and professional employees. We are proposing to complete the wark as detailed in the attached Scope of Construction Administration/Inspection Services, Exhibit A. WSB &Associates, Inc. (WSB)understands the significance of the project,to not only the City of Shakopee,but also its fellow stakeholders. WSB has identified Donald Sterna to be the project manager, and he will assign a project specific design team whose sole purpose is to deliver this project within the timeline specified. The attached work plan describes the tasks proposed to be completed by WSB far street and utility, construction administration, and inspection for the Opus—Valley Park Business Center. WSB's original design/survey contract already covers the construction survey and as-built plan preparation. Therefore, this extension agreement only covers construction administration and inspection services. Project Management WSB will provide a project manager to oversee the construction team. This will ensure that the City of Shakopee receives a quality product and provides a contact person for the City to express any questions or concerns about the project if necessary. WSB will also provide contract administration under the direct supervision of a registered professional engineer and will keep the City informed on the status of construction at weekly job meetings. Technically competent inspection staff with appropriate MnDOT certifications will be provided by WSB. This task also includes coordination with the Union Pacific Railroad for the pipe crossing under the tracks. 2. Construction Administration This task will involve documentation set for in the City and MnDOT's specifications. These items include,but are not limited to: • Change in Construction • Quality Control • Contractor's Schedule • Erosion Control Plan, SWPPP Monitoring • Conformance with Permits • Daily and Weekly Diaries • Supplemental Agreements • Partial and Final Payment Vouchers • Bituminous Testing Results • Conformance with Plans and Specifications • Concrete Testing Results • Coordination of Testing Agencies • Documentation of Prevailing Wages • SWPPP Inspection and Documentation 3. Construction Surveys WSB will be responsible for all construction staking required in accordance with MnDOT's Survey Manual. The fees for these construction survey and record drawings are contained in the original design document and are not included with this proposal for services except as noted in task 9 below. 4. Materials Testing Coordination WSB will coordinate and review the material testing required for the project to ensure that the testing be performed in accordance with City requirements. The material testing will be performed by a geotechnical engineering firm. 5. Construction Inspection Services WSB will provide one full-time construction observation inspector for the duration of the project. Our representative will maintain daily construction activity logs, quantities, and monitor daily construction activities for conformance to the specifications, as well as perform duties as listed in Work Plan Tasks 2-9 in the Scope of Services. If additional construction inspection is needed, the City will provide these services. If the City wants WSB to provide extra construction inspection,these services will be considered additional services. Exhibit A 1 6. Pre-Construction Conference/Weekly Meetings Our project team will set up the pre-construction conference for the project. Weekly construction meetings will also be held with meeting minutes distributed to all project team members. 7. Estimates Partial pay estimates will be completed monthly and provided to the City for approval. A final pay voucher will also be provided to the City for approval. 8. Final Documentation Documentation to final the project will be provided to the City relative to contract administration and materials inspection. This will be in accordance with MnDOT delegated contract process. 9. Record Drawings Changes to the construction plans will be recorded by our construction observers, along with final quantities and drainage items, for final records. The survey work for recording the final as-built conditions and final record drawing plan preparation is not included in this proposal and is in included in our original design document estimated fees.
