INTRODUCTION
The City has received an application from David W. Jansen, owner of Valley Sports,
requesting loan approval as part of the Downtown Fayade Improvement Program. This is a
deferred loan program in which the loan is forgiven on a sliding scale over a 5 year period.
Loans are available for up to 50% of the project costs, to a maximum of $25,000 per
property. Eligible properties are commercial properties in the historic downtown area,
including the south side of 1 st A venue from Fuller Street to Sommerville Street, and
Holmes, Lewis and Sommerville Streets between 1 st A venue and 2nd Avenue.
The building which is presently occupied by Valley Sports, located at 102 1 st Avenue
West, is listed in the County records as being built in 1898. It has been determined that
the building has historic value inside and out. Mr. Jansen has requested a $7,953.00 loan
to help fund a project totaling $15,906.00 ($1,488.00 for sign rewiring, $12,501.00 for
installation of 7 new storefront windows, and $1,917.00 for new sign installation). The
intended work includes the replacement of windows on the east and north elevations, and
the renovation of the existing wall sign(s) on the north elevation.
DISCUSSION
A committee has been established that reviews these application requests, consisting of
representatives from the Economic Development Advisory Corrunittee (EDAC), the
Historic Preservation Advisory Commission (HP AC), and the Shakopee Downtown
Partnership. The committee representatives reviewed the application and toured the site.
Based on their review, they recommend funding 50% of the costs of the project, not to
exceed $7,953.00, with two conditions:
. That the new windows and frames match the existing number and sizes of window
panels.
. That the new sign( s) either match the size of the existing sign( s), or be smaller.
ALTERNATIVES
Program guidelines state that in order to be eligible, an improvement must be to a street-
facing fayade and would have to be a restoration or enhancement project; not regular
maintenance. The recommended funding would support work on 2 facades (north and east
elevations) of the building that are adjacent to I st Avenue West and Holmes Street South.
ACTION REQUESTED
Based on the Committee's review and approval of this application, staff requests that the
City Council authorize the appropriate staff to enter into an agreement with the owner of the
property at 102 1st Avenue West for a deferred loan from the Downtown F~ade
Improvement program to fund 50 percent of the cost of the proposed windows, frames and
sign restoration, up to a maximum of $7,953.00.

We propose to provide all material and labor to complete the project as described by the accompanying estimate.
All material and workmanship shall meet or exceed local and state building codes. All workmanship shall be
performed in a professional and timely manner. In addition to manufacturer's material warranty, the workmanship
shall carry a one year warranty from the date of completion. Building permit fees, taxes, and site clean-up are
included in this proposal. Any problem discovered after demolition that was unforeseen, such as rotted wood or
code violations, which require labor and/or material to correct, shall constitute a change order. Change order
labor shall be $50.00 per man hour and material shall be cost plus 20%. A change order shall require signatures by
all parties.
The payment terms, unless otherwise stated:
1. A down payment to be one-third of the contract total due at the time the contract is signed.
2. A material drop payment to be one-third of the contract total due at the time of the material delivery.
3. A final payment to be one-third of the contract total due upon project completion.
4. Unpaid balances shall be subject to a late fee of 1.5% per month.
Note: In the event that the project cannot be completed due to material that is not available or warranty matters
related to material, final payment will be due less 10% of the contract total. The 10% amount will be withheld until
the matrerial matter is resolved.
Pre-Lien Notice
(a) Any person or company supplying labor or material for this improvement to your property may file a lien
against your property if that person or company is not paid for the contributions.
(b) Under Minnesota law, you have the right to pay persons who supplied labor or materials for this improvement
directly and deduct this amount from our contract price, or withhold the amounts due them from us until 120 days
after completion of the improvement unless we give you a lien waiver signed by persons who supplied any labor
or material for the improvement and who gave you timely notice.
