DISCUSSION
Lloyd's Construction Services has submitted an application for final plat approval of Lloyd's
Properties, LLC at 1431 and 1449 Maras Street, located South ofthe intersection of 13th Avenue
and on the East side of Maras Street.
Engineering Staff has submitted their comments in a memorandum in which they recommend
approval of the final plat subject to the conditions listed.
Shakopee Public Utilities Commission (SPUC) has submitted their comments in a memorandum in
which they recommend approval ofthe project subject to the conditions listed.
The Natural Resource Specialist recommends approval of the project and has provided comments in
relation to the approved grading permit for the site, which is attached.
All other city departments and outside agencies that have reviewed the request and have returned
review forms recommend approval of the request.
ALTERNATIVES
1. Approve Resolution Numbers 6423, resolution approving the Pinal Plat for Lloyd's Properties,
LLC.
2. Approve Resolution Numbers 6423, resolution approving the Pinal Plat for Lloyd's Properties,
LLC with revisions.
3. Direct staff to prepare a resolution of denial of the Pinal Plat for action at the Council's next
meeting.
4. Table a decision and request additional information from staff and/or the applicant.

RESOLUTION NO. 6423
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL
PLAT OF LLOYD'S PROPERTIES, LLC
WHEREAS, Lloyd Properties LLC, applicant and property owner, have made application for
fmal plat approval of Lloyd's Properties, LLC; and
WHEREAS, the subject properties are legally described as:
See attached legal, Attachment #1
WHEREAS, the Shakopee Planning Commission conducted public healings on the
preliminary plat on March 9, 2006; and
WHEREAS, all required public notices regarding the public hearing were posted and sent; alld
WHEREAS, the Shakopee Planning Commission has recommended approval ofthe requested
preliminary plat; and
WHEREAS, the City Council reviewed the preliminary plat request at its meeting of March
21,2006.
NOW, THEREFORE, BE IT RESOLVED BY THECITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA, THAT THE FINAL ,PLAT FOR LLOYD'S PROPERTIES,
LLC IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
I. The following procedural actions must he completed prior to the recording of the
Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developer's Agreement, which shall include provisions for
security for public improvements within the plat and the engineering review fees,
and any other fees as required by the City's adopted fee schedule.
1. The developer shall be responsible for payment of Trunk Storm Water
Charges and Trunk Storm Water Storage and Treatment Charges by the
City's most recent adopted Fee Schedule prior to issuance of a building
permit.
2. No public improvements shall be constructed until the City Engineer and
the Shakopee Public Utility Commission approve the Final Construction
Plans and' Specifications.
3. The applicant shall obtain an NPDES permit prior to any land disturbing
activity. A copy of this permit shall be forwarded to the City. The
applicant shall adhere to all MPCA NPDES requirements.
4. In areas where storm sewer is to be installed the applicant must raise
elevations to provide sufficient free-board from the approved High Water
Level (HWL) of the existing storm water basin to the East.

5. The applicant shall adhere to the minimum slope in non-paved surface
areas of two (2) percent.
6. The applicant shall perform the grading operations to accommodate
existing drainage patterns.
7. m order to provide access to the existing storm sewer along the
southernmost property line, no fencing or exterior storage shall be
allowed within the drainage and utility easement.
8. All berming shall be located outside of drainage and utility easements.
C. Easements shall be shown on the Final Plat as approved by the City Engineer.
They shall include, but not be limited to, the following:
1. Provide adequate drainage and utility easements to encompass the approved
High Water Level (HWL) of the existing storm water basin to the East.
D. Simultaneous to the recording of the plat, a deed restriction shall be recorded on
the South property line as designated by the City.
The Deed Restriction shall appear as the following:
This conveyance is made conditioned upon and subject to the following restriction.
The Grantee, heirs, successors and assigns, are restricted from erecting any fence
or other structure within the utility and drainage easements dedicated by plat over
the above-describedproperty, except with the prior written consent of the City of
Shako pee. This restriction shall run in favor of and be enforceable by the City of
Shako pee.
E. The survey data (length and bearings) shall be shown for each lot.
F. The applicant shall obtain a grading permit prior to any land disturbing activity.
G. The soils on site shall be subject to sampling and testing at the City's discretion.
The cost associated with the testing, and if necessary, the removal of any material
deemed unacceptable by the City shall be the applicant'sresponsibility.
J. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
K. The developer and/or their assigns shall be responsible for any required or
desired noise or dust mitigation measures.
L. Shall provide electronic (Auto CAD) files ofthe Final Plat to the Engineering
Department.
M. The applicant shall meet the screening, woodland and tree management, and
landscaping ordinance requirements of the City Code.
N. The applicant is approved to remove 23 trees on site and is required to plant 8
replacement trees. The replacement tree species are to beof an approved species
as determined by the Natural Resource Specialist.
O. The applicant is responsible for preserving all trees indicated as saved on the
plans. If, as a result of this project, any ofthese trees are determined to be
wounded sufficiently to be considered dead or dying by the City, the applicant
will be required to replace the tree(s) according to the Woodland and Tree
Management Ordinance.
P. Tree protection fence for grading is to remain in place the duration of the land
disturbing activities, including construction of any buildings.

Q. Silt fence and/or tree protection fence is to be removed following establishment
of vegetation as determined by an inspection completed by City Staff.
R. Installation of Municipal Water Service, Street Lighting, or Underground
Electrical service by Shakopee Public Utilities Commission is available to the
site, however would be subject to Shakopee Public Utilities fees, conditions, and
policies since water service is currently unavailable and the site is served by
overhead electric lines.
S. The applicant should contact Shakopee Public Utilities directly for specific
requirements related to their project.

Based on a review of the application materials provided, the following are required

The application indicates a request for Final Plat approval of a light industrial (I-I) development
in the eastern portion of the City. It is located along the East side of Maras Street between 13th
A venue and Hansen Avenue.
This review should be considered preliminary, as more comments are to follow with additional
submittals. However, I offer the following comments at this time for the applicant and for the
planning department:
General Comments
The follow items shall be completed prior to release of the Final Platfor recording:
1. Execution of a Developer's Agreement, which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
2. Payment of Trunk SanitarySewer Charges shall be made, as required by the most current
City of Shakopee Fee Schedule. '
3. Payment of Trunk Storm Water Charges and Trunk Storm Water Storage and Treatment
Charges shall be made, as required by the most current City of Shakopee Fee Schedule.
4. Provide electronic (Auto CAD) files of the Final Plat and all record drawings to the
engineering department.

1. No public improvements shall be constructed until the City Engineer and the Shakopee

the storm water basin. Elevations shall be raised to provide sufficient free-board from the

4. The applicant shall remove all proposed berming from within the drainage and utility
easements in order to eliminate impacts to the approved high water level of the adjacent
storm water basin.
5. The applicant shall perform all grading operations to accommodate existing drainage
patterns.
6. In order to provide access to the existing public storm sewer along the southernmost
property line, no fencing or exterior storage shall be allowed within the drainage and
utility easement.
Preliminary Plat
The following items shall be completed prior to release of the Final Plat for recording:
1. Easements shall be shown on the Final Plat as approved by the City Engineer. They shall
include, but not be limited to, the following:
. Provide adequate drainage and utility easements to encompass the approved high
water level of the adjacent storm water basin.
The following items shall be completed simultaneous to the recording of theplat:
1. Deed restrictions shall be recorded on all easements as designated by the City of
Shakopee.
Recommendation

COMMENTS:
Municipal water service is available subject to our standard tenns and conditions. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge.
Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution,
Agreement, granting any necessary easements) and paying the associated,fees.
Street Lighting installation is available subject to our standard tenns and conditions.
These are contained in the current City of Shakopee Street Lighting Policy. Applicant
, must pay the associated fees.
Applicant should contact Shakopee Public Utilities directly for specific requirements
relating to their project.
Note: Municipal water service is currently unavailable to this area (13th Avenue,
Maras Street and Hansen Avenue). There is an existing overhead electric
service to the site.
