INTRODUCTION:
Attached is Resolution No. 6414, a resolution receiving areport and calling for a hearing
on the 2006 Bituminous Overlay Project, Project No. 2006,.5.
BACKGROUND:
On January 16, 2001 the City Council ordered the preparation of a feasibility report to
analyze a bituminous overlay of Holmes Street, from 3rd A venue to 10th A venue by
Resolution No. 5472. This project has been put on hold to allow for the completion of
the new Scott County Jail on Holmes Street, between 3rd Avenue and 4th Avenue. On
November 1, 2005, the City Council ordered the preparation of a feasibility report to
analyze a bituminous overlay of 10th A venue, from Marschall Road to Harrison Street by
Resolution No. 6321. These two projects have been combined into the 2006 Bituminous
Overlay.
The purpose of the feasibility report is to evaluate the existing infrastructure (streets,
utilities, drainage) and make recommendations for any improvements that are needed.
The feasibility report also addresses the estimated costs for the. improvements and the
proposed assessments that result from the project being constructed. The attached
resolution sets a public hearing for this project on June 6, 2006. The approval of
Resolution No. 6414 does not order the project nor does it commit the Council to
constructing any improvements. The intent of this resolution is to accept the feasibility
report and set the public hearing date. The public hearing will allow the property owners
adjacent to the project area and the general public the opportunity to address the City
Council on this project.
Staffwill make a full presentation at the June 6, 2006 public hearing on the feasibility
report to the public and the City Council.
The 2006 Capital Improvement Program budgeted $770,000.00 of State Aid money to
pay for the proposed improvements. Due to escalating gas prices, the feasibility study
estimates that $962,000.00 of State Aid money will be needed to complete the project.
The City does have the additional funds in its State Aid account to fund this project.
ALTERNATIVES:
1. Adopt Resolution No. 6414. This action will receive the feasibility report and set
the date for the public hearing for June 6, 2006.
2. Deny Resolution No. 6414. This action will halt the project until such time that
City Council reconsiders the resolution.
3. Move to receive the feasibility report but do not set a date for the public hearing at
this time. This action will place the project on hold until such time as the City
Council sets a date for the public hearing.
4. Table Resolution No. 6414 to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by the City Council.
RECOMMENDATION:
1. If the City Council wishes to pursue this proj ect. for the 2006 construction season,
staff recommends Alternative No.1, to adopt Resolution No. 6414.
2. If the City Council does not wish to pursue this project then the appropriate action
would be to move the approval of Resolution No. 6414, and vote against the
motion.
3. If City Council provides additional direction and modifications to the report, then
Alternative No. 3 may be appropriate to table this action and have staff modify
the report.
ACTION REQUESTED:
Offer Resolution No. 6414, A Resolution Receiving a Report and Calling a Hearing for
the 2006 Bituminous Overlay, Project No. 2006-5 and move its adoption.

And Calling A Hearing For The
2006 Bituminous Overlay Project
Project No. 2006-5
WHEREAS, pursuant to Resolution No. 5472 and No. 6321 of the City Council adopted
January 16, 2001 and November 1, 2005, a report has been prepared by the City Engineer, with
reference to the 2006 Bituminous Overlay Project, Project No. 2006-5, and this report was received
by the Council on May 2, 2006.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. The Council will consider the 2006 Bituminous Overlay Project and all appurtenant
work in accordance with the report and the assessment of abutting and benefited property for all or
a portion of the . cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an
estimated total cost of the improvement for the 2006 Bituminous Overlay of$1,222,889.30.
2. A public hearing shall be held on such proposed improvements on the 6th day of June,
2006, at 7:00 P.M. or thereafter, in the Council Chambers of City Hall, at 129 South Holmes Street,
Shakopee,Minnesota, and the Clerk shall give mailed and published notice of such hearing and
improvement as required by law.
3. The work of this project is hereby designated as part of the 2006-5 Public Improvement
Project.

1. INTRODUCTION

report to analyze a bituminous overlay of Holmes Street, from.3rd Avenue to 10th
Avenue by Resolution No. 5472. This project has been put on hold to allow for
the completion of the new Scott County Jail on Holmes Street, between 3rd
Avenue and 4th Avenue. On November 1, 2005, the City Council ordered the
preparation of a feasibility report to analyze a bituminous overlay of 10th Avenue,
from Marschall Road to Harrison Street by Resolution No. 6321. These two
projects have been combined into the 2006 Bituminous Overlay.
This project is included in the City's 2006 Capitalhnprovement Program.
2. SCOPE
This report will determine the feasibility of a bituminous overlay, and any
necessary. improvements to existing utilities on 10th Avenue, between Marschall
Road and Harrison Street and on Holmes Street, between 10th Avenue and 3rd
Avenue.
The report will also determine the. cost effectiveness of the proposed
improvements, provide a cost apportionment,. preliminary cost estimate and a
preliminary assessment roll.
3. BACKGROUND
Holmes Street was reconstructed in 1980. Until the. min-bypassand the Lewis
Street bridge were constructed in 1993, Holmes Street. was the most used
north/south collector street in Shakopee. 10th Avenue was last overlayed in 1988.
Due to a combination of traffic wear and age, the bituminous surface on both
roadways has deteriorated and is in need of resurfacing.
4. PROPOSED IMPROVEMENTS
4.1 Street
The proposed street improvements are identified inDrawingNo. 1 in the
Appendix.

The proposed street improvements consist .of patching areas of sub grade
instability, milling 2-inches of the existing pavement, replacing curb in
isolated areas and the application of a 2-inch bituminous overlay.
10th Avenue is a flat street with a number of drainage problems and a
number of areas with damaged curb and gutter. The purposed of this
project is to resurface the roadway to extend its life and to reduce yearly
maintenance costs by reducing the amount of patching and. cra.ck sealing
that is needed on a yearly basis.
This project is not intended to fix all of the drainage problems and replace
all of the damaged curb. In the future when these streets ... are
reconstructed, the curb will be replaced and grades will be adjusted to
eliminate the drainage problems.
The total estimated project cost for the proposed street improvements is
$1,120,517.45. An itemized cost estimate is included in the Appendix.
4.2 Sanitary Sewer
The sanitary sewer was televised and evaluated prior to writing this report
and there are no proposed improvements to the existing sanitary sewer.
4.3 Storm Sewer
The.proposed storm sewer improvements are identified in Drawing No.2
in the Appendix.
The proposed storm sewer improvements consist of replacing (4)
structures on 10th Avenue near Market Street and adding catch basins. at
the intersections of 10th A venue and Dakota Street and 10th Avenue and
Prairie Street.
The total estimated project cost for the proposed storm . sewer
improvements is $102,371.85. An itemized cost estimate is included in the
Appendix.
4.4 Watermain
Shakopee Public Utilities will evaluate the water system and will make
necessary repairs prior to the overlay.

4.5 Easements
It is not anticipated that easement acquisition will be required for this
proj ect.
5. SPECIAL ASSESSMENTS
25% of the project costs for the street improvements to a standard 45-foot wide
roadway are proposed to be assessed on a per lot basis to the benefiting properties
with comer lots being assessed one-half that of the. interior lots. A comer .lot is
defined as a lot with two .sides adjacent to existing. City streets. Non. residential
property will be assessed based on equivalent residential lots with an equivalent
residential lot being equal to 60 feet of front footage. The remaining costs
associated with the proposed street improvements, including 100% of the
oversizing costs associated with 10th A venue, will be paid with State Aid Funds.
100% of the storm sewer improvements will be funded by the General Storm
Sewer Fund.
The estimated assessment rate, per equivalent residential Jot, is $774.29.. A
preliminary assessment roll is included in the Appendix. Actual assessments will
be based on the final project costs.
6. ESTIMATED COSTS
Anitemized cost estimate is inclhded in the Appendix. The following costs were
prepared using 2005 construction costs and are subject to change, depending on
the final design of the project, bids received and actual work performed. A
summary of the estimated construction costs plus a 5% contingency and
engineering and administration costs for the project are as follows:

8. CONCLUSION
From an engineering standpoint, the proposed improvements are feasible, cost
effective and necessary for the preservation of the existing infrastructure.
