SUBJECT: Request from Brian & Michele Thompson for Waiver of Subdivision
Criteria
MEETING DATE: May 2, 2006
INTRODUCTION:
Brian & Michele Thompson have submitted an application requesting approval of a waiver of
subdivision criteria for property located at 1127 Vista Ridge Lane (Exhibit A).
The Thompsons have submitted a request for waiver ofthe lot frontage criteria to allow the
creation of a lot without frontage on a public street. This property would be utilized for a second
residential structure on property zoned Rural Residential (RR) Zone (see attached letter and
plans from the applicant). This property presently consists of one parcel that is owned by the
Thompsons. Frontage and access currently exist to Vista Ridge Lane, with additional frontage
existing on County Road 14. . If the Waiver request is approved, the applicant will continue to
work with staff on the Minor Subdivision application. If approved, this property would be split
into two (2) parcels, with each parcel being 10 acres in size. The applicant would also prepare
and record a driveway easement for the shared driveway.
DISCUSSION:
The subject property was recently rezoned to Rural Residential (RR) Zone, which has a
requirement that lots shall have 150 feet of frontage on a public street. This property presently
does not comply with the lot frontage requirement (presently 60 feet of frontage on Vista Ridge
Lane and 66 feet of frontage on County Road 14), nor will the proposed lot split comply with
this requirement. As.a result, the Thompsons are requesting that the Council waive the lot
frontage requirement for the proposed lots. If approved, the Thompsons would then proceed
with the review of a minor subdivision application.
The Council should note that the applicant has offered to dedicate a roadway easement on the
proposed survey. The purpose of the roadway easement is to allow for future access from both
Vista Ridge Lane and from County Road 14 to the property located directly to the east, should
development ofthat property require future connections to those streets. Additionally, the issues
that were noted by the adjacent property owner at the time of the rezoning request have been
addressed, and that property owner no longer has any objections to this request.
ALTERNATIVES:
1. Offer and approve a motion approving the request for waiver of subdivision criteria
regarding the City's lot frontage requirement, as proposed (including the dedication of a
roadway easement).
2. Offer and approve a motion approving the request for waiver of subdivision criteria
regarding the City's lot frontage requirement, with revisions.
3. Offer and approve a motion denying the request for waiver of subdivision criteria
regarding the City's lot frontage requirement.
4. Table the matter and request additional information.
REQUESTED ACTION:

Please accept this letter along with our "Application for Minor Subdivision" as our formal
request to subdivide our current property located at 1127 Vista Ridge Lane, Shakopee,
MN 55379.
Along with our submitted application we are requesting that you consider granting us a
waiver to the minor subdivision criteria as it pertains to lot frontage. It is our desire to
subdivide the existing property into two(2) 10 acre parcels. One lot would make use of
the existing 60' ollot frontage and the second lot would gain access to our current home
via an existing driveway which would be a dedicated driveway easement.
Our existing lot is a legal, non-conforming "Rural Residential" lot and currently has 60' of
lot frontage and meets all additional requirements of the minor subdivision criteria. If our
request is granted we will continue to work with the Shakopee City Planners to finalize
our submitted application for minor subdivision.

Please accept this cover letter as "Item #4" "additional information" as requested by the
planning department.
In consideration of our. application for Minor Subdivision I have provided copies from our
surveyor providing both the existing legal description as well as the proposed legal
descriptions of the proposed Minor Subdivision. As you will see, listed on the survey we
are presenting.two (2) Minor Subdivision alternative for the.City of Shakopee's
consideration:
Minor Subdivision #1: . Divide the existing 20+ acre Rural Residential parcel
into two (2) separate legal parcels with a shared driveway.
Minor Subdivision #2: Divide the existing 20+ acre Rural Residential property
into two (2) separate legal parcels and in consideration provide the city a road
easement as detailed on the survey, therefore allowing Vista Ridge Lane to
continue through the proposed parcel "B" without interruption for future
development.
