POLICE DEPARTMENT Memorandum TO: Mayor and City Council COOf~lSEBT Mark McNeill, City Administrator FROM: Dan Hughes, Chief of Police SUBJECT: Authorization to fill Police Captain position DATE: April 04, 2006 INTRODUCTION: The Police Department is requesting Council approval to appoint a police captain. BACKGROUND: The Police Department has one vacant police captain position, created by the City Council's approval on November 29,2005. The Police Civil Service Commission has conducted the necessary testing and established the police captain eligible register. The following names are the top candidates, listed in alphabetical order, on the eligible register established by the Police Civil Service Commission. Craig Robson Jeff Tate I recommend the appointment of Jeff Tate to Police Captain. Although, the Civil Service Rules require the Commission to adopt rules for certification of three names to the appointing authority (City Council), an opinion from the city attorney allows the appointment with Council approval. In previous action (December 1999), the City Council authorized the Deputy Chief position the ability to receive pay for performance according to the police sergeants contract and the chief of police position. If all aspects of performance pay are attained by Jeff Tate, it could mean another $3,960 annual impact on the police budget. Mr. McNeill and I recommend that the captain position be afforded the same opportunity. If council approves the appointment, the new captain will be moving from a non-exempt position (eligible for overtime) to an exempt position (salaried). Sergeant Jeff Tate has 188.50 accrued hours of comp time that he received according to union contracts. Both Mr. McNeill and I recommend that these hours be paid to Sergeant Tate at his current sergeant's salary. The cost of this buy-back is $6,701.74. BUDGET IMPACT: Funds exist in the Police Department budget for these expenses. VISIONING RELATIONSHIP: This action supports: Goal B - High Quality of life. Strategy 6: Provide high quality services ALTERNATIVES 1. Authorize the appointment and approve pay for performance compensation and buy back of comp time. 2. Do not ,authorize the appointment. 3. Table RECOMMENDATION: Alternative # 1. Staff recommends Council authorize the appointment of Jeff Tate as a probationary Police Captain. ACTION REQUESTED: The City Council, if they concur, should by motion authorize the appointment of probationary Police Captain Jeff Tate, at Step B, grade 10, of the non-union pay plan at an annual salary of $78,291; and authorize pay for perfonnance according to the police sergeants existing labor agreement; and buy back existing comp time hours at the current rate of pay of Sergeant Tate.
