DISCUSSION
Lloyd's Construction Services has submitted an application for preliminary plat approval of Lloyd's
Properties, LLC at 1431 and 1449 Maras Street. Additionally, the applicant has requested a
conditional use permit for exterior storage, a landscape service or contractor, and an over-height
fence. The application has been reviewed by city departments and other agencies, their comments
are attached to the planning commission report and are listed as conditionals of approval for the
resolutions of the preliminary plat and the conditional use permit.
PLANNING COMMISSION RECOMMENDATION
At its March 9, 2006 meeting, the Planning Commission recommended approval of the Preliminary
Plat to the City Council by a 7-0 vote, subject to the conditions listed in the draft resolution. A copy of
the report to the Planning Commission has been attached for the Council's reference.
ALTERNATIVES
1. Approve Resolutions Numbers 6388 and 6390, resolutions approving the Preliminary Plat for
Lloyd's Properties, LLC and a Conditional Use Permit for an over-height fence, landscape
service or contractor, and exterior storage.

RESOLUTION NO. 6388
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY PLAT OF LLOYD'S PROPERTIES, LLC
WHEREAS, Lloyd's Construction Services, applicant and property owner, have made
application for preliminary plat approval of Lloyd's Properties, LLC; and
WHEREAS, the subject properties are legally described as:

WHEREAS, the Shakopee Planning Commission conducted public hearings on the
preliminary plat on March 9, 2006; and
WHEREAS, all required public notices regarding the public hearing were posted and sent; and
WHEREAS, the Shakopee Planning Commission has recommended approval of the requested
preliminary plat; and
WHEREAS, the City Council reviewed the preliminary plat request at its meeting of March
21,2006.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA, THAT THE PRELIMINARY PLAT FOR LLOYD'S
PROPERTIES, LLC IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
I. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval of title by the City Attorney.
B. The applicant must have Scott County inspect whether the signature block for
Scott County is acceptable.
C. Execution of a Developer's Agreement, which shall include provisions for
security for public improvements within the plat and the engineering review fees,
and any other fees as required by the City's adopted fee schedule.
1. The developer shall be responsible for payment of Trunk Storm Water
Charges and Trunk Storm Water Storage and Treatment Charges by the
City's most recent adopted Fee Schedule.
2. No public improvements shall be constructed until the City Engineer and
the Shakopee Public Utility Commission approve the Final Construction
Plans and Specifications.
3. The applicant shall obtain an NPDES permit prior to any land disturbing
activity. A copy ofthis permit shall be forwarded to the City. The
applicant shall adhere to all MPCA NPDES requirements.
4. In areas where storm sewer is to be installed the applicant must raise
elevations to provide sufficient free-board from the approved High Water
Level (HWL) of the existing storm water basin to the East.
5. The applicant shall adhere to the minimum slope in non-paved surface
areasoftNo(2)percent.

6. The applicant shall perform the grading operations to accommodate
existing drainage patterns.
D. Easements shall be shown on the Final Plat as approved by the City Engineer.
They shall include, but not be limited to, the following:
1. Provide adequate drainage and utility easements to encompass the approved
High Water Level (HWL) of the existing storm water basin to the East.
E. Simultaneous to the recording of the plat, a deed restriction shall be recorded on
the South property line as designated by the City.
The Deed Restriction shall appear as the following:
This conveyance is made conditioned upon and subject to the following restriction.
The Grantee, heirs, successors and assigns, are restricted from erecting any fence
or other structure within the utility and drainage easements dedicated by plat over
the above-described property, except with the prior written consent of the City of
Shako pee. This restriction shall run infavor of and be enforceable by the City of
Shako pee.
F. The survey data (length and bearings) shall be shown for each lot.
G. The applicant shall obtain a grading permit prior to any land disturbing activity.
H, The soils on site shall be subject to sampling and testing at the City's discretion.
The cost associated with the testing, and if necessary, the removal of any material
deemed unacceptable by the City shall be the applicant's responsibility.
J. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
K. The developer and/or their assigns shall be responsible for any required or
desired noise or dust mitigation measures.
L. Shall provide electronic (Auto CAD) files ofthe Final Plat to the Engineering
Department.
M. The applicant shall meet the screening and landscaping ordinance requirements
ofthe City Code.

A RESOLUTION OF THE CITY OF SHAKOPEE
APPROVING A CONDITIONAL USE PERMIT TO ALLOW EXTERIOR STORAGE,
LANDSCAPE SERVICES AND CONTRACTORS, AND AN OVERHEIGHT FENCE AT
1431 AND 1449 MARAS STREET
WHEREAS, the City of Shakopee received an application from John Lloyd, applicant
and property owner, for a Conditional Use Permit to allow exterior storage, landscape services
and contractors, and an overheight fence.
WHEREAS, the property for which the application was made is legally described as
follows: Lot 1, Block 1 Lloyds Properties, LLC.
WHEREAS, proper public hearing notices were sent, published and posted, and on
March 21,2006 a public hearing was held on the requested Conditional Use Permit before the
City Council.
NOW, THEREFORE BE IT RESOLVED BY CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, that it adopts the following findings relative to the request for
Conditional Use Permit.
CUP Criteria and Proposed Findings:
Criteria #1 The use will not be injurious to the use and enjoyment of other property in the
immediate vicinity for the purposes already permitted, nor substantially
diminish and impair property values within the immediate vicinity;
Finding #1: The City Council has not received any evidence that the use will be injurious to the
use and enjoyment of other property in the vicinity, if conducted in accordance with
proposed conditions.
Criteria #2 The establishment of the conditional use will not impede the normal and
orderly development and improvement of surrounding vacant property for
uses allowed in the area;
Finding #2: The City Council finds that the establishment of the conditional use will not impede
the normal and orderly development and improvement of surrounding property.
Criteria #3 Adequate utilities, access roads, drainage, and other necessary facilities have
been or will be provided;
Finding#3: The City Council finds that adequate utilities, access, drainage and other necessary
facilities have been or will be provided for the site.
Criteria #4 The use is consistent with the purposes of the zone in which the applicant
intends to locate the proposed use; and
Finding #4 The City Council finds that this use is consistent with the purposes of the Light
Industrial Zone.
Criteria #5 The use is.not in conflict with the Comprehensive Plan.
Finding #5 The City Council finds that the use is not in conflict with the Comprehensive Plan.
BE IT FURTHER RESOLVED, that the Conditional Use Permit to allow an over-
height fence, exterior storage, and landscape service or contractor is approved subject to the
following conditions:
1. Diseased or dead plant materials must be disposed of in a sanitary manner.
2. All landscaping or contractor equipment must be stored at least 100 feet from a
residential zone.
3. All landscaping or contractor equipment must be screened from any residential zone.
4. All exterior storage shall be screened from all public right-of-way and residentially zoned
land, with an opaque fence, wall, or berm not to exceed 8-feet in height, all screening
materials must be constructed of new materials and maintained in good condition.
5. The total exterior storage area shall not exceed 12,000 square feet.
6. The exterior storage area shall not be located closer than 300 feet to any residential zone.
7. All exterior storage areas shall be surfaced entirely with asphalt, concrete, or class five
(5) aggregate.
8. All fencing or berms may not be greater than eight (8) feet in height.
9. All fencing shall be constructed of wood and no taller than eight (8) feet in height.
10. All fencing over six (6) feet in height requires a building permit.
11. Fencing may not be constructed in the 20' easement on the southernmost side of the
property or in the 50' gas pipeline easement on the north side of the property.
12. The applicant provides a landscape plan and work with the City to determine appropriate
number of trees to be planted and tree locations.
13. Erosion control silt fence be removed following establishment of permanent vegetation.
14. The applicant shall comply with noise standards in City Code.

Discussion
Lloyd Properties, LLC have submitted an application for preliminary plat approval of
property located at 1431 and 1449 Maras Street (Exhibit A). The applicant owns two
adj acent lots and is proposing to combine them and use them as one. One of the existing
lots is un-platted and the other is part of the Valley Rich Addition, in total area the
properties are approximately 3.32 acres. The applicant is also proposing to have exterior
storage (Exhibit C), a landscape service or contractor, and an over-height fence (Exhibit
G); these uses require Conditional Use Permit (CUP) approval in the Light Industrial
Zone.
The applicant has proposed to use an 8' chain link fence with a black windscreen as
screening material, City staff are recommending that a wood fence or approved berms be
utilized for screening purposes and note that as a condition of approval on the CUP
resolution.
The Engineering Department has reviewed the application and provided comments
(Exhibit D). These comments have been attached for the Commission's review. The
conditions have been included in the list of recommended conditions of approval.
Scott County Environmental Health has reviewed the application and has provided their
comments on the attached memorandum (Exhibit E). Those conditions have been
incorporated into the list of recommended conditions of approval.
Ryan Hughes, Natural Resources Specialist, has provided a memorandum (Exhibit F) that
lists several conditions. Those conditions have been incorporated into the list of
recommended conditions of approval.
STAFF RECOMMENDATION
Staff recommends that the Planning Commission recommend to the City Council the
approval ofthe Preliminary Plat of Lloyd Properties, LLC subject to the following
conditions:

A. The applicant shall submit a landscaping plan for review and approval
by the City of Shakopee Natural Resource Specialist.
B. The applicant shall replace all trees that are to be cut down with the
appropriate number and species to be determined by the Natural
Resources Specialist and the Woodland Management Ordinance.
C. The applicant shall provide six (6) inches of topsoil below areas to be
sodded. The soil composition should be similar to the MnDOT topsoil
borrow requirements.
D. The applicant shall provide rain sensors for any irrigation system.
E. The applicant shall provide storm water computations for the proposed
site to insure the downstream system can accommodate the runoff.
F. The applicant shall provide inlet protection to the storm sewer catch
basin consistent with City standards.
G. The applicant must provide floating silt curtain protection at the
discharging end of the 18" RCP pipe consistent with City standards.
H. The applicant shall implement the use of Best Management Practices
for erosion control and stormwater management during construction.
1. The applicant shall utilize the MPCA Protecting Water Quality in
Urban Areas as a technical reference for erosion control.
1. Silt fence and/or tree protection fence is to be removed following
establishment of vegetation as determined by an inspection by City
staff.
III.
A. If floor drains exist or are to be utilized in the building they must
conform to Class V Inj ection Well standards by having water flow
from drains to holding tanks and not day lighted or to the Individual
Sewage Treatment System (ISTS).
B. The ISTS must meet State and County rules and ordinances
concerning the ability of the ISTS to treat the potential amount of
sewage per the number of employees in the building.
ALTERNATIVES
1. Offer a motion to recommend to the City Council the approval of the
Preliminary Plat subject to the conditions as presented by staff.
2. Offer a motion to recommend to the City Council the approval of the
Preliminary Plat subject to revised conditions.
3. Offer a motion to continue the public hearing to request additional

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF ADJUSTMENT
AND APPEALS OF THE CITY OF SHAKOPEE, MINNESOTA, that it adopts the

The application indicates a request for Preliminary Plat approval of a light industrial (I-I)
development in the eastern portion of the City. It is located along the East side of Maras Street
between 13th Avenue and Hansen Avenue. The application.. also indicates a request for two
Conditional Use Permits, one for an overheight fence and the other for exterior storage.
This review should be considered preliminary, as more comments are to follow with additional
submittals. However, I offer the following conmlents at this time for the applicant and for the
planning department:
General Comments
1. Execution of a Developer's Agreement, which shall include provisions for security for
public improvements within the Final Plat and the engineering review fees.
2. Payment of Trunk Sanitary Sewer Charges shall be made, as required by the most current
City of Shakopee Fee Schedule.
3. Payment of Trunk Stonn Water Charges and Trunk Storm Water Storage and Treatment
Charges shall be made, as required by the most current City of Shakopee Fee Schedule.
4. No public improvements shall be constructed until the City Engineer and the Shakopee
Public Utilities Commission (SPUC) approves the Final Construction Plans and
Specifications.

5. The applicant shall obtain a NPDES pennit prior to any land disturbing activity. A copy
of this permit shall be provided to the City.
6. The applicant proposes to grade portions of the site and to install storm sewer. In these
areas, the elevations shall be raised to provide sufficient free-board from the approved
High Water Level (HWL) of the existing storm water basin to the East.
7. The applicant shall adhere to the minimum allowable slope in non-paved areas of two (2)
percent.
8. The applicant shall perform the grading operations to accommodate existing drainage
pattems.
9. In order to provide access to the existing storm sewer pipe along the southernmost
propeliy line, no fencing shall be allowed within the drainage and utility easement.
10. Provide electronic (Auto CAD) files of the Final Plat and all record drawings to the
engineering. department.
Preliminary Plat
1. Easements shall be shown on the Final Plat as. approved by the City Engineer. They shall
include, but not be limited to, the following:
. Provide adequate drainage and utility easements to encompass the approved High
Water Level (HWL) of the existing storm water basin to the East.
2. Simultaneous to the recording of the Final Plat, a deed restriction shall be recorded on the
southenunost drainage and utility easement.
Recommendation
Engineering staff recommends approval ofthe Preliminary Plat, the Conditional Use Permit for
an overheight fence and the Conditional Use Permit for exterior storage subject to the conditions
. above being addressed by the applicant prior to Final Plat approval.

Based on a review of the application materials provided, the following are required
conditions for approval for the Lloyd Properties Preliminary Plat and CUP application:
1. The applicant provide a landscaping plan and work with the City to.determine
appropriate trees to be planted and tree locations.
2. . The applicant provide inlet protection to the storm sewer catch basin consistent with
City standards.
3. The applicant provide floating silt curtain protection at the discharging end of the 18"
RCP pipe consistent with City standards.
4. The applicant provide 6 inches of topsoil below areas to be sodded. The soil
composition should be similar to the MnDOT topsoil borrow requirements.
The following are recommended conditions for approval of the above mentioned Lloyd
Properties Preliminary Plat and CUP application:
1. The applicant provide rain sensors for any irrigation systems.
2. Erosion control silt fence be removed following establishment of permanent .
vegetation.
3. Recommended deciduous tree species to utilize in this area are (Contact the City for
additional recommended species):
a. Hackberry (Celtis occidentalis)
b. Northern Catalpa (Catalpa speciosa)
c. Bur oak (Quercus macrocarpa)
d. Red oak (Quercus rubra)
4. The applicant implement the use of Best Management Practices for erosion control
and stormwater management during construction.
