SUBJECT: Amendment to City Code Section 11.62, Driveway Setback
MEETING DATE: March 21, 2006
INTRODUCTION:
The Board of Adjustment and Appeals have recently directed staff to review the current
ordinance regarding driveway setbacks in response to variance requests at 1195 and 1197
Tyler Street. Upon review of the current ordinance, city staff is proposing a text
amendment to City Code Section 11.62 that would reduce the required setback of certain,
driveways in the Old Shakopee (R1C) Zone. The proposed text amendment reduces the
required setback of driveways on lots of record previous to May 3rd 1977 in the R1 C
Zone that do not have underlying side easements from 5-feet to 3-feet.
ALTERNATIVES:
1. Offer and pass Ordinance No. 753, an amendment to City Code Sec. 11.62 regarding
driveway setback.
2. Offer and pass Ordinance No. 753, an amendment to City Code Sec. 11.62 regarding
driveway setback with revisions.
3. Do not approve Ordinance No. 753.
4. Table the item for additional information.
PLANNING COMMISSION RECOMMENDATION:
On March 9,2006, the Planning Commission held a public hearing on the proposed text
amendment, and unanimously recommended approval of the text amendment without
revising any of the original conditions.
VISIONING RELATIONSHIP:
The proposed text amendment supports adopted Goal D: Vibrant, Resilient, and Stable.
ACTION REQUESTED:
Offer Ordinance No. 753, Fourth Series, An Ordinance ofthe City of Shako pee, Minnesota,
Amending City Code Section 11.62 Regarding Driveway Setback, and move its adoption.
ORDINANCE NO. 753, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING CITY CODE SECTION 11.62 REGARDING DRIVEWAY
SETBACK
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA,
ORDAINS:
Section 1 - That City Code Section 11.62, DRIVEWAY SETBACK, Subd. 3,
Standards for Driveway Setback, is hereby amended by adding the language, which is
underlined, and deleting the language thatis struck through.
F. Driveway Setback:
Driveways shall be setback a minimum of five (5) feet from any
side or rear lot line, Except in the low density residential (R If..)
zone, and e:xccpt directly in front ofa garage door no driveway
shall be closer than 3 feet to any single or two (2) family d',velling,
nor closer than fiye (5) feet to any multiple family or business
building. except in the Old Shakopee Residential (R-IC) Zone
driveways may be set back three (3) feet from a side property line
if the property was a lot of record prior to May 3. 1977. and there
are no underlying easements in the location ofthe driveway.
Section 2 - - Effective Date. This ordinance becomes effective from and after its
passage and publication.
Adopted in session of the City Council of the City of Shako pee,
Minnesota held the day of , 2006.
