DISCUSSION
Shakopee Development, LLC, has submitted an application for preliminary and final plat
approval of property located north of Highway 169, south of Vierling Drive, and west of
Calvary Church (Exhibit A). The plat, as currently revised, contemplates the creation of
seven (7) multi-family residential structures, totaling 23 units, on approximately 3.63
acres ofland. The proposed lots will have access off Vierling Drive via a 28 foot wide
circular drive. The structures would consist of two, three and four unit buildings,
comprised of two story and rambler type structures, and front loading garages (see
attached elevation and floor plans). The development would also provide eight (8)
additional parking spaces available besides the garages and driveways, which exceeds the
minimum requirement of2.25 spaces per residential unit.
Other elements of this project include a stormwater detention pond and an eight foot tall
screen fence.and extensive landscaping along the property line adjacent to Hwy. 169.
There may be an opportunity for the applicant to provide some type of play area/tot lot
south.ofthe pond area, with the stipulation that there are barriers/security measures
provided to ensure the safety of the residents. The applicant has submitted a traffic noise
assessment prepared by David Braslau Associates, Inc. Although this study was
completed for the development proposed by this applicant for property east of Calvary
Church, several aspects ofthe study are relevant to this property as a numberof
conditions found on site and the adjacent roadway are consistent. The Council should
analyze this information and determine whether the screen fence, and landscaping
provide a sufficient noise buffer for the future residents of these structures.
The conditions initially drafted by staff and supported by the Commission resulted in
several modifications to the plat layout. The applicant has recently submitted revised
plans that address a number of the conditions. Those revised plans have been attached to
this report for the Councils review. Since staff have not had adequate time to thoroughly
review the resubmitted plans, the resolution that is attached for the Council's action does
not address all the changes made in the revised plat; however, there are conditions in

place to adequately address staffs issues/concerns. If approved, staff will thoroughly
review the plat plans prior to recording to ensure that all conditions have been complied
with, consistent with the Council's actions. In reviewing the residential project scoring
guide, this application received 60% ofthe applicable points. This percentage may be
increased, provided the applicant's revised information addresses staffs concerns.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the preliminary plat at its February 9, 2006 meeting,
and by a 4-0 vote, they recommended approval of the preliminary plat application, with
revisions. Specifically, the Commission discussed reconfiguring the lot layout in order to
provide greater setbacks along the west and east property lines and between the road and
structures, and to widen the road to 28 feet. Those revisions have been incorporated into
the draft resolution attached to this report.

ALTERNATIVES
1. Approve Resolution No. 6380, approving the Preliminary and Final Plat for
Vierling Estates II, subject to the conditions presented.
2. Approve Resolution No. 6380, approving the Preliminary and Final Plat for
Vierling Estates II, subject to revised conditions.
3. Do not approve the preliminary and final plat and direct staff to prepare a
resolution consistent with the direction of the Council.
4. Table the matter and request additional information from staff and/or the
applicant.
ACTION REQUESTED
Offer a motion to approve Resolution No. 6380, a resolution approving the Preliminary
and Final Plat of Vierling Estates II, subject to the conditions as presented by staff, and
move its adoption.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE PRELIMINARY AND FINAL PLAT OF VIERLING ESTATES II
WHEREAS, Shakopee Development, LLC, applicant and property owner, has
made application for preliminary and final plat approval of Vierling Estates II; and
WHEREAS, the subject property is legally described as:
That part ofthe Northwest y,. of the Southeast y,. of Section 8, Township 115, Range 22,
Scott County, Minnesota lying Southerly of Hauer's 4th Addition and Northerly of
Minnesota Department of Transportation Right of Way Plat No. 70-7, and Easterly ofthe
following described line: commencing at the Southwest corner of said Hauer's 4th Addition;
thence North 81 degrees 54 minutes 58 seconds East, assumed basis for bearings, along the
Southerly line of said Hauer's 4th Addition, 871.50 feet to the point of beginning of said line;
thence South 0 degrees, 25 minutes 22 seconds East 362.61 feet to the Northerly line of said
Minnesota Department of Transportation Right of Way Plat No. 70-7 and there terminating.
WHEREAS, the Planning Commission reviewed the preliminary plat on
February 9,2006, and recommended approval of the plat with conditions; and
WHEREAS, the City Council reviewed the proposed preliminary and final plat
on March 6, 2006.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that the preliminary and final plat of Vierling Estates II is hereby
approved subject to the following conditions:
I. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval oftitle by the City Attorney.
B. Execution of a Developer's Agreement, which shall include provisions
for security for public improvements within the plat and the
engineering review fees, and any other fees as required by the City's
adopted fee schedule.
1. Shakopee Public Utilities Commission shall be contacted if the
applicant wishes to contract with them for security lighting.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
4. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, Trunk Storm
Water Storage and Treatment Charges, security for the public
improvements, engineering review fees, and other fees as
required by the City's most recent adopted Fee Schedule.
5. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve
the Final Construction Plans and Specifications.
6. The applicant shall obtain an NPDES permit prior to any land
disturbing activity. A copy of this permit shall be provided to
the City. The applicant shall adhere to all MPCA NPDES
requirements.
7. Verify the exact location of the high-pressure natural gas
transmission pipeline prior to the removal of the tree on the
northeast corner of the property.
8. Verify the exact location ofthe transmission pipeline prior to
the installation of the storm sewer crossing the transmission
pipeline on the northwest corner.
C. Easements shall be shown on the Final Plat as approved by the City
Engineer.
D. Shakopee Public Utilities Commission requires the dedication of a ten
(10) foot wide drainage and utility easement around the perimeter of
the property and on either side of and including the private drive.
E. Easements shall be shown on the Final Plat as approved by the City
Engineer. They shall include, but not be limited to, providing a
minimum often (10) feet of trail easement for the bituminous trail
adjacent to the Vierling Drive right-of-way.
F. The storm water management plan shall be approved by City
Engineering.
G. The survey data (length and bearings) shall be shown for each lot.
H. Park dedication requirements. shall be met through a cash contribution
in an amount in accordance with the adopted fee schedule in place at
the time of final plat approval. The required park dedication fees shall
be paid at the time of the recording of the final plat. If any portion of
the property is being platted as outlots to accommodate a phased
development, the park dedication fees for each future phase shall be
based on the fees in effect at the time of final plat approval for those
outlots and shall be paid before the final plat for those outlots is
recorded.
I. The applicant shall install an eight (8) foot bituminous trail along the
property line adjacent to Vierling Drive right-of-way, with
construction to be coordinated by the City Engineering Department.
The trail shall be located outside the public right-of-way.
J. All trails shall be ADA compliant.
K. The applicant shall only install benches and/or tables in common green
space where the proximity of ponding areas and slopes do not
constitute a safety hazard.
L. The applicant provide enhanced screening for "private" patio areas to
the rear of all units via installation of fencing and/or use of vegetation.
M. Screening elements shall not be allowed within drainage and utility
easements.
N. The applicant shall obtain a grading permit prior to any additional land
disturbing activity.
O. The applicant shall comply with MnDOT's recommendations
concerning storm sewer drainage/outlets and permit requirements for
any work within or affecting their right-of-way.
P. The applicant shall obtain the necessary permission, right-of-way
and/or easements to perform all proposed work offsite or within
existing easements.
Q. The applicant shall obtain both a right-of-way permit prior to work
within the City of Shakopee's right-of-way and a grading permit prior
to any land disturbing activity.
R. The applicant shall work with City of Shakopee staff to eliminate all
proposed retaining walls from within drainage and utility easements.
S. No final graded slopes in non-paved areas shall exceed three (3) feet
horizontal to one (1) foot vertical (3: l), nor shall they be less than two
(2) percent.
T. All proposed driveways, sanitary sewer and storm sewer shall be
considered private.
U. The applicant shall provide an outlet control structure for the proposed
storm water basin as per City of Shakopee requirements.
V. The applicant shall work with City of Shako pee staff to provide the
most desirable connection point to the existing storm sewer system.
W. The applicant shall work with City of Shakopee staffto eliminate all
proposed curb drain openings and replace with storm sewer structures.
X. The applicant shall provide an ultimate Emergency Overflow (EOF)
for the site's storm sewer system. The location and elevation shall be
approved by the City of Shakopee.
y. The applicant shall work with City of Shakopee staff to realign the
proposed sanitary sewer for a more desirable angle of connection to
the existing sanitary sewer system.
Z. The proposed entrance shall be aligned directly across from Limestone
Drive.
AA. The entrance to Vierling Drive shall be thirty-seven (37) feet wide
(measured from back of curb to back of curb). The proposed concrete
curb and gutter matching into the existing curb and gutter in Vierling
Drive shall have radii measuring twenty-five (25) feet. All curb and
gutter within the right-of-way shall be B618.
BB. The applicant shall install a cross-pan, if necessary, as perthe most
recent edition ofthe City of Shakopee' s General Specifications and
Standard Detail Plates for Street and Utility Construction.
II. Following approval and recording of the final plat, the following
conditions shall apply;
A. Building construction, sewer, water service, fire protection and access
will be reviewed for code compliance at the time of building permit
application(s).
B. The developer and/or their assigns shall be responsible for any
required or desired noise or dust mitigation measures.
C. Shall provide electronic (Auto CAD) files of the Final Plat to the
Engineering Department.
D. The applicant shall meet the screening and landscaping ordinance
requirements of the City Code.
E. The applicant shall provide six (6) inches oftopsoil below areas to be
sodded. The soil composition should be similar to the MnDOT topsoil
borrow requirements.
F. The applicant shall provide rain sensors for any irrigation system.
G. The applicant shall implement the use of Best Management Practices
for erosion control and stormwater management during construction.
H. The applicant shall utilize the MPCA Protecting Water Quality in
Urban Areas as a technical reference for erosion control.
I. Silt fence and/or tree protection fence is to be removed following
establishment of vegetation as determined by an inspection by City
staff.
J. Provide a play area/tot lot for residents of this development.
K. Relocate the northerly trash enclosure. Provide screening of any
proposed trash enclosure areas consistent with the City Requirements.
L. Install an eight foot high sound wall along the south property line,
consistent with the traffic noise assessment report.
M. The developer should implement the use of Best Management
Practices for erosion control and stormwater management during
construction.
N. The applicant must meet the City's Woodland and Tree Management
Ordinance requirements.
O. There shall be the placement of at least one overstory shade deciduous
tree in the front yard.
P. There shall be the placement of 6 inches of topsoil. The soil
composition should be similar to the MnDOT topsoil borrow
requirements.
Q. There shall be sod placement in front yards and seed or sod placed in
side and rear yards.
R. Rain sensors for any irrigation system shall be installed.
S. The applicant shall adhere to the NPDES Phase II permit requirements
for erosion control before, during, and after earth moving activities.
T. The applicant shall plant a diversity of tree. species along the boulevard
to reduce the impacts of potential tree diseases or epidemics that may
occur in the future. The applicant must plant different species adjacent
to each other along the boulevard and may not plant more than 15 trees
of the same species. Recommended tree species to utilize in this area
are:
a. Hackberry (Celtis occidentalis)
b. Northern Catalpa (Catalpa speciosa)
c. Bur oak (Quercus macrocarpa)
d. White cedar (Thuja occidentalis)
e. Eastern white pine (Pinus strobes)
Adopted in regular session of the City Council of the City of Shakopee, Minnesota,

DISCUSSION

letter with conditions of approval that address the gas pipeline (Exhibit G).
The Minnesota Department of Transportation (MnDOT) has provided a letter concerning
several items with this application (Exhibit H). The applicant should be in contact with
MnDOT to address their questions.
The conditions drafted by staff may result in a significant modification to the plat layout.
Staff and the applicant have reviewed the majority of the comments and the applicant will
be working to address the conditions noted in the report and be prepared to discuss the
issues with the Commission. In reviewing the residential proj ect scoring guide, this
application received 60%. of the applicable points. This percentage may be increased,
provided the applicant submit additional or revised information that addresses staffs
concerns.
STAFF RECOMMENDATION
Staff recommends that the Planning Commission recommend to the City Council the
approval ofthe Preliminary Plat of Vierling Estates II, subject to the following
conditions:

curb and gutter matching into the existing curb and gutter in Vierling
Drive shall have radii measuring twenty-five (25) feet. All curb and
gutter within the right-of-way shall be B618.
DD. The applicant shall install a cross-pan, if necessary, as per the most
recent edition of the City of Shakopee's General Specifications and
Standard Detail Plates for Street and Utility Construction.
II. Following approval and recording of the final plat, the following
conditions shall apply;
A. Building construction, sewer, water service, fire protection and access
will be reviewed for code compliance at the time ofbuilding permit
application(s).
B. The developer and/or their assigns shall be responsible for any

INTRODUCTION
I am writing to provide you park related comments for the Vierling Estates Preliminary
and Final Plat 2nd Addition, proposed by Don Willenbring of Shakopee Development
LLC,. and the Parks and Recreation Advisory Board's recommendation.
DISCUSSION
The Parks and Recreation Advisory Board (PRAB) reviewed the proposed Vierling
Estates 2nd Addition preliminary and final plat at their January 23 meeting, at which time
they recommended general approval of the plat with specific conditions. Their discussion
included park dedication, trails and private .green space amenities. Mr. Willenbring was
not in attendance at the meeting.
Park Dedication
Given the proximity to. the Emerard Lane Tot Lot and Scenic Heights Park, which are
both within the desired maximum walking distance of % mile, cash in lieu of land is
recommended. Park dedication calculations based on the 2006 fee schedule, are as
follows:
25 units X $4,450/unit = $111,250.
Trails and Sidewalks
The PRAB's recommendations included a condition that the applicant provide an 8'wide
bituminous trail along the south side of Vierling Drive, as shown on the drawings and
described in the application narrarative. Construction of this trail is included in the
conditions for approval. There was no discussion of the developer receiving any credit
for this trail construction.
There are no proposed sidewalks within the development. The Advisory board did not
make any comments or recommendations on this.
Private green Space Amenities
The application narrative described the intent to utilize common private green space to
locate benches and tables, specifically mentioning the placing them near the pond. Staff
expressed a concern with the safety of locating these amenities near the pond due to the
grading and space available near the pond was fairly small. The advisory boar Jag reed
with staff that if these amenities are added that the developer evaluate their location with
safety and usability in mind. Staff is. willing to review these further if the developer
desires specific input on this.

Staff also commented on the small depth of the back patio spaces especially at the side
property lines and suggested enhanced screening for these spaces to benefit their
usability. The advisory Board chose to defer from commenting on this item.
PARKS AND RECREAT(ON ADVrSORY BOARD PARK DEDICATION
RECOMMENDA TrON
The Parks and Recreation Advisory Board recommended approval of the proposed
preliminary plat, with the folloWing conditions:
1. The applicant shall meet park dedication requirements by providing cash in lieu of
land dedication..
2. Park dedication fees in the amount required by the City Code and adopted City fee
schedule shall be paid prior to the recording of the final plat. .If any portion of the
property is being platted as outlots to accommodate a phased development, the park
dedication fees for each future phase shall be based on the fees in effect at the time
of final plat approval for those outlots and shall be paid before the final plat for those
outlots is recorded.
3. An 8' bituminous trail shall be constructed by the developer along VierIi0g Drive.
4. All trails shall be ADA compliant.
STAFF COMMENTS AND RECOMMENDATIONS
Finally, I would note the following additional requirements should be added as conditions
of approval for the preliminary plat:

My comments relating to the preliminary and final plat for Vierling Estates 2nd are as follows:
1. At a minimum, please require some ber~ng for noise mitigation, similar to that required
to the east and west of the property. The City has received complaints from residents to
the north of this property and they were informed that the City could not address noise
problems until the property actually developed.
2. Park dedication should be required. .

3. Is there suffiCient off street parking for visitors? .
4. I assume that the gas pipeline easement tp the east does not continue across'this parcel.
5. Address sidewalks along the south side of Vierling Drive. The City has money in escrow
for sidewalks from the developers of the properties to the east and to the west.
6. Homeowners declarations should address maintenance of the pr~vate drive and of any,
noise maintenance provisions (if necessary).
7. If public utilities within the private drive, the city needs an easement.

With reference to the proposed plat of Vierling Este$ ~md the development plans you
sent recently, CenterPoint Energy herein approves' the plans dated December 28,
2005 conditional on the following:
1. Verify the exact location of the high-pressure natural gas transmission pipeline
prior to the removal of thetree on the northeast corner.
2. Similarly, verify the exact location the transmission pipeline prior the installation
of the Storm Sewer crossing the transmission pipeline .on the northwest c'orner.
This approval is based on the exiting plans referenced 'above. This approval is
intended as an isolated exception. Any future situations or encroachments must be
evaluated on ari individual basis.
Should maintenance of this pipeline ever require excavation, CenterPoint Energy may
need to gain access quickly, depending on the urgency. CenterPoint Energy would
not be responsible for replacement of anything removed.

Drainage
Drainage and storm sewer calculations show that storm water drains to the north into a
storm sewer and that there is no additIonal water draining directly to Mn/DOT Right of Way.
. However, It is not clear who owns this storm sewer and where it outlets. Confirmation is
needed that this storm sewer does. not outlet back to Mn/DOT Right of Way. Please contact

determine if a drainage permit is necessary.
Traffic Noise
Mn/DOT's policy is to assist local governments in promoting compatibility between land use
and highways. Residential uses located adjacent to highy.,rays often result in complaints
about traffic noise. Traffic noise from this highway could exceed noise standards
established by the Minnesota Pollution Control Agency (MPCA), the U.S. Department of
Housing and Urban Development, and the U.S. Department of Transportation. Minnesota
Rule 7030.0030 states that municipalities are responsible for taking all reasonable measures
to prevent land use activities listed in the MPCA's Noise Area Classification (NAC) where the
establishment of the land use would result in violations of established noise standards.
Mn/DOT policy regarding development adjacent to exIsting highways prohibits the
expenditure of highway funds for noise mitigation measures in such areas. The project
proposer should assess the noise situation and take the action deemed necessary to
minimize the impact of any highway noise. If you have any questions regarding Mn/DOT's

This preliminary memorandum transmits our fmdings and recommendations for the proposed
Vierling Estates residential development in Shakopee, Minnesota.
Noise monitorinp;
Traffic noise levels were monitored on Wednesday afternoon, 27 July 2005. One monitor was
~ocated at the east edge of the property at the TH 169 ROW. The other was located at the highest
terrain near the west edge ofthe property. Traffic noise levels were also predicted at these sites
based upon expected traffic during the 4-5 pm afternoon period, during which monitored sound
levels were highest. Results of this comparison are shown in the table below.

The table suggests a 2 dBA contribution from higher than average pavement noise not reflected
in the MinnNoise traffic model. This was also observed for the earlier Evergreen Heights noise
study competed in 1998.
Noise modeling
As noted above, noise modeling was performed for existing conditions (2005). Noise
predictions, assuming some traffic growth, was predicted for the year 2010 to determine
compliance with state noise standards and need for mitigation. A revised site and grading plan
was used for this analysis that reflected recommendations for a smaH berm near the TII 169
ROW to support a sound wall. The table below show the amount the predicted Ll 0 is above the
daytime LIO 65 dBA standard at a receptor on the fIrst (ground) floor, assuming a 6' high fence
on top of the small berm. I

From the table above,. it can be seen that the L 1 0 is predicted to be slightly above the 65 dBA
level for the buildings closest to TH 169 on the west, while levels are below the standard for the
. buildings on the east that are further from the roadway. If some increase in sound level is
assumed due to unusual pavement roughness, the westerly three buildings will be exposed to
levels 3 to 4 dBA over the standard, while the remaining buildings will be below the standard.
Therefore, it is recommended that a fence height of 8 feet be erected along the westerly portion
of the property that is closest to TH 169. All of the buildings facing TH 169 would then be
below the daytime L 1 0 65 dBA standard. :
Building Consfrnction
The 2nd story levels are not effectively shielded by the proposed berm and fence. Therefore,
under conditions contained in Minnesota rules, the exterior-interior sound attenuation provided
by building construction must be sufficient to provided 40 dBA of reduction, since predicted
levels at the 2nd story are higher than 70 dBA during the critical 6 - 7 am period.
The building exteriors facing TH 169 generally contain a bedroom window, which accounts for a
relatively large percentage of the exterior bedroom wall. An evaluation of the composite
transmission loss or noise reduction of the bedroom wall for traffic noise indicates that the
proposed windows should have an STC rating of 40. This level of attenuation can be provided
by insulating glass with one of the panels of laminated glass.
Since windows on exterior walls perpendicular to TH 169 will be shieI.ding by the building itself,
predicted exterior levels for these facades are generally less than 70 dBA: Therefore, only a 30
dBA noise attenuation is required, which can normally be provided by standard high-quality.
insulating glass windows.

The EAC recommended conditions of approval for the Vierling Estates 2nd Addition preliminary and final plat are the following:
1. The developer should implement the use of Best Management Practices for erosion control and stormwater
management during construction.
2. The applicant must meet the City's Woodland and Tree Management Ordinance requirements.
3. Placement of at least one overstory shade deciduous tree in the front yard.
4. Placement of 6 inches of topsoil. The soil composition should be similar to the MnDOT topsoil borrow
requirements.
5. Sod placement in front yards and seed or sod placed in side and rear yards.
6. Rain sensor for any irrigation system.
7. The applicant adhere to the NPDES Phase II permit requirements for erosion control before, during, and after
earth moving activities.
8. The applicant plant a diversity of tree species along the boulevard to reduce the impacts of potential tree
diseases or epidemics that may occur in the future. The applicant must plant different species adjacent to each
other along the boulevard and may not plant more than 15 trees of the same species. Recommended tree
species to utilize in this area are:
a. Hackberry (Celtis occidentalis)
b. Northern Catalpa (Catalpa speciosa)
c. Buroak (Quercus macrocarpa)
d. White cedar (Thuja occidentalis)
e. Eastern white pine (Pinus strobes)
All the above are standards conditions except #8. The EAC had concerns regarding the noise and that the noise mitigation
requirements contained in the Noise Assessment Report would be required but did not make a condition of approval regarding
this issue. Please provide or discuss the EAC recommended conditions of approval with the Planning Commission when this
project is discussed.

RESOLUTION NO. 6380
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE PRELIMINARY AND FINAL PLAT OF VIERLING ESTATESn
WHEREAS, Shakopee Development, LLC, applicant and property owner, has
made application for preliminary and final plat approval of Vierling Estates II; and
WHEREAS, the subject property is legally described as:
That part of the Northwest y,. of the Southeast ~ of Section 8, Township 115, Range 22,
Scott County, Minnesota lying Southerly of Hauer' s4th Addition and Northerly of
Minnesota Department of Transportation Right of Way Plat No. 70-7, and Easterly of the
following described line: commencing at the Southwest comer of said Hauer's 4th Addition;
thence North 81 degrees 54 minutes 58 seconds East, assumed basis for bearings, along the
Southerly line of said Hauer's 4th Addition, 871.50 feet to the point ofbeginning of said line;
thence South 0 degrees, 25 minutes 22 seconds East 362.61 feet to the Northerly line of said
Minnesota Department of Transportation Right of Way Plat No. 70-7 and there terminating.
WHEREAS, the Planning Commission reviewed the preliminary plat on
February 9,2006, and recommended approval of the plat with conditions; and
WHEREAS, the City Council reviewed the proposed preiiminary and final plat
on March 6, 2006.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that the preliminary and final plat of Vierling Estates II is hereby
approved subject to the following conditions:
1. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval oftitIe by the City Attorney.
B. Execution of a Developer's Agreement, which shall include provisions
for security for public improvements within the plat and the
engineering review fees, and any other fees as required by the City's
adopted fee schedule.
1. Shakopee Public Utilities Commission shall be contacted if the
applicant wishes to contract with them for security lighting.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
4. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, Trunk Storm
Water Storage and Treatment Charges, security for the public
improvements, engineering review fees, and other fees as
required by the City's most recent adopted Fee Schedule.
5. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve
the Final Construction Plans and Specifications.
6. The applicant shall obtain an NPDES permit prior to any land
disturbing activity. A copy of this permit shall be provided to
the City. The applicant shall adhere to all MPCA NPDES
requirements.
7. Verify the exact location of the high-pressure natural gas
transmission pipeline prior to the removal of the tree on the
northeast corner of the property.
8. Verify the exact location of the transmission pipeline prior to
the installation of the storm sewer crossing the.transmission
pipeline on the northwest comer.
C. Easements shall be shown on the Final Plat as approved by the City
Engineer.
D. Shakopee Public Utilities Commission requires the dedication of a ten
(10) foot wide drainage and utility easement around the perimeter of
the property and on either side of and including the private drive.
E. Easements shall be shown on the Final Plat as approved by the City
Engineer. They shall include, but not be limited to, providing a
minimum often (10) feet of trail easement for the bituminous trail
adjacent to the Vierling Drive right-of-way.
F. The storm water management plan shall be approved by City
. Engineering.
G. The survey data (length and bearings) shall be shown for each lot.
H. Park dedication requirements shall be met through a cash contribution
in an amount in accordance with the adopted fee schedule in place at
the time of final plat approval. The required park dedication fees shall
be paid at the time of the recording of the final plat. If any portion of
the property is being platted as outlots to accommodate a phased .
development, the park dedication fees for each future phase shall be
based on the fees in effect at the time of final plat approval for those
outlots and shall be paid before the fmal plat for those. outlots is
recorded.
I. The applicant shall install an eight (8) foot bituminous trail along the
property line adjacent to Vierling Drive right-of-way, with
construction to be coordinated by the City Engineering Department.
The trail shall be located outside the public right-of-way.
J. All trails shall be ADA compliant.
K. The applicant shall only install benches and/or tables in common green
space where the proximity ofponding areas. and slopes do not
constitute a safety hazard.
L. The applicant provide enhanced screening for "private" patio areas to
the rear of all units via installation of fencing and/or use of vegetation.
M. Screening elements shall not be allowed within drainage and utility
easements.
N. The applicant shall obtain a grading permit prior to any additional land
disturbing activity.
O. The applicant shall comply with MnDOT's recommendations
concerning storm sewer drainage/outlets and permit requirements for
any work within or affecting their right-of-way.
P. The applicant shall obtain the necessary permission, right-of-way
and/or easements to perform all proposed work offsite or within.
existing easements.
Q. The applicant shall obtain both a right-of-way permit prior to work
within the City of Shakopee's right-of-wayand a grading permit prior
. to any land disturbing activity.
R. The applicant shall work with City of Shakopee staff to eliminate all
proposed retaining walls from within drainage and utility easements.
S. No final graded slopes in non-paved areas shall exceed three (3) feet
horizontal to one (1) foot vertical (3:1), nor shall they be less than two
(2) percent.
T. All proposed driveways, sanitary sewer and storm sewer shall be
considered private.
U. The applicant shall provide an outlet control structure for the proposed
storm water basin as per City of Shakopee requirements.
V. The applicant shall work with City of Shakopee staff to provide the
most desirable connection point to the existing storm sewer system.
W. The applicant shall work with City of Shakopee staff to eliminate all
proposed curb drain openings and replace with storm sewer structures.
X. The applicant shall provide an ultimate Emergency Overflow (EOF)
for the site's storm sewer system. The location and elevation shall be
approved by the City of Shakopee.
Y. The applicant shall work with City of Shakopee staff to realign the
proposed sanitary sewer for a more desirable angle of connection to
the existing sanitary sewer system.
Z. The proposed entrance shall be aligned directly across from Limestone
Drive.
AA. The entrance to Vierling Drive shall be thirty-seven (37) feet wide
(measured from back of curb to back of curb). The proposed concrete
curb and gutter matching into the existing curb and gutter in Vierling
Drive shall have radii measuring twenty-five (25) feet. All curb. and
gutter within the right-of-way shall be B618.
BB. The applicant shall install a cross-pan, if necessary, as per the most
recent edition of the City of Shako pee's General Specifications and
Standard Detail Plates for Street and Utility Construction.
II. Following approval and recording of the final plat, the following
conditions shall apply;
A. Building construction, sewer, water service, fIre protection and access
will be reviewed for code compliance at the time of building permit
application(s).
B. The developer and/or their assigns shall be responsible for any
required or desired noise or dust mitigation measures.
C. Shall provide electronic (Auto CAD) files ofthe Final Plat to the
Engineering Department.
D. The applicant shall meet the screening and landscaping ordinance
requirements of the City Code.
E. The applicant shall provide six (6) inches of topsoil below areas to be
sodded. The soil composition should be similar to the MnDOT topsoil
borrow requirements.
F. The applicant shall provide rain sensors for any irrigation system.
G. The applicant shall implement the use of Best ManagementPractices
for erosion control and stormwater management during construction.
H. The applicant shall utilize the MPCA Protecting Water Quality in
Urban Areas as a teclmical reference for erosion control.
1. Silt fence and/or tree protection fence is to be removed following
establishment of vegetation as determined by an inspection by City
staff.
J. Provide a play area/tot lot for residents of this development.
K. Relocate the northerly trash enclosure. Provide screening of any
.proposed trash enclosure areas consistent with the City Requirements.
L. Install an eight foot high sound wall along the south property line,
consistent with the traffic noise assessment report.
M. The applicant must meet the City's Woodland and Tree Management
Ordinance requirements.
N. There shall be the placement of at least one overstory shade deciduous
tree in the front yard.
O. There shall be sod placement in front yards and seed or sod placed in
side and rear yards.
P. The applicant shall adhere to the NPDES Phase IT permit requirements
for erosion control before, during, and after earth moving activities.
Q. The applicant shall plant a diversity of tree species along the boulevard
to reduce the impacts of potential tree diseases or epidemics that may
occur in the future. The applicant must plant different species adjacent
to each other along the boulevard and may not plant more than 15 trees
of the same species. Recommended tree species to utilize in this area
are:
a. Hackberry (Celtis occidentalis)
b. Northern Catalpa (Catalpa speciosa) .
c. Bur oak (Quercus macrocarpa)
d. White cedar (Thuja occidentalis)
e. Eastern white pine (Pinus strobes)
