SUBJECT: Public Hearing for Trunk Sanitary Sewer Extension along CSAH 83 from
Church Addition to Valley View Road, Project No. 2006-6

INTRODUCTION:
Attached is Resolution No. 6382, a resolution which orders the preparation of plans and
specifications for the Trunk Sanitary Sewer Extension from Church Addition to Valley
View Road, Project No. 2006-6.
BACKGROUND:
At the February 7, 2006 meeting, Council accepted a feasibility report for extending
sanitary sewer along CSAH 83 to eliminate a lift station in River Valley Estates. On
February 21, 2006, City council considered an option to install this. sewer extension on
the east side of CSAH 83 by obtaining a temporary easement from the Shakopee
Mdewakanton Sioux Community (SMSC). City Council was in agreement in proceeding
with a public hearing scheduled for March 6, 2006 for this project by adopting Resolution
No. 6377.
Another issue for this project to proceed is to obtain a MPCA extension permit without
an EA W required. If an EA W is required, the timelines are such that completion of the
sewer extension may not meet the Pulte Homes timeline. Pulte Homes has committed
$90,000 to this project if a lift station is eliminated. Pulte's schedule has building permits
being issued in August and occupancy permits in October.
Stan Ellison of the SMSC has verbally told staff that a temporary easement for 5.3 acres
would be granted by the SMSC at a cost of $50,000 for a one year term. The MPCA has
contacted John Powell of WSB & Associates, Inc. and it has been determined that an
EA W is required at this time. The MPCA would be responsible for issuing the EA W and
the Responsible Government Unit (RGU) in making the decision whether or not an EIS is
necessary. Due to the unknown timing of the MPCA and the uncertain future decision of
the EA W, staff believes that the sewer could not be extended in time to receive Pulte's
contribution of $90,000 to eliminate the lift station previously approved for River Valley
Estates.
In review of the sewer extension options, the east side is definitely less expensive for
right of way costs and may be slightly cheaper to construct than the west side option.
Staffhas not started any right of way acquisition on the west side due to the possibility of
obtaining an easement from the SMSC. The east side option is the better option from a
cost standpoint and a timing standpoint if the easement is given by the SMSC and an
extension permit is granted by the MPCA.
In regards to the lateral sewer benefit for this trunk extension, staff is proposing to
develop a lateral sewer connection charge by the unit so that developing properties north
of River Valley Estates would pay a charge at the time of development. Staff will work
with the city attorney to prepare the ordinance necessary for this charge to be enacted and
would be done at a later date. The reason for this method being selected is that the
properties west of CSAH 83 do not have to develop in order to pay an assessment and the
SMSC property will more than likely not connect to the sewer and have no benefit. If the
SMSC does connect to this sewer line, then they would pay the connection charges.
As mentioned earlier in the memo, due to an EAW being required by the MPCA, staff
recommends that this project not move forward at this time as the timelines cannot be
accomplished in time to receive the $90,000 contribution fromPulte Homes. John
Powell of WSB & Associates, Inc. will be at the meeting to discuss the project and
provide a timeline on completing the EA W and project completion if Council is still
interested in this project.
ALTERNATIVES:
1. Adopt Resolution No. 6382, a resolution ordering the improvement and the
preparation of plans and specifications for the CSAH 83 Trunk Sanitary Sewer
Extension, from Church Addition to Valley View Road, Project No. 2006-6.
2. Approve a motion not ordering the project and directing staff not to proceed with
the project.
3. Table Resolution No. 6382, to allow time for staff to prepare additional
information and/or revise the feasibility report as directed by City Council.
4. Approve a motion for WSB & Associates, Inc. to prepare plans and specifications
for the CSAH 83 sewer extension as per the previous approved extension
agreement.
5. Do not approve a motion for WSB and Associates, Inc. to proceed with design at
this time.
6. Authorize an extension agreement with WSB & Associates, Inc. for preparation
of information for an EA W with this project.
7. Do not authorize an extension agreement for EA W information.
8. Table for additional information.
RELATIONSHIP TO VISIONING:
This item relates to Goal D - Vibrant, resilient and stable.
RECOMMENDATION:
Staff recommends Alternative No.2 which would deny the project from moving forward
for reasons as stated in the memo. The timelines in completing an EA W and for
completing the project to meet the developer's timeline will be presented to Council. If
the Council desires to proc'eed with this project, the Alternatives 1, 4, and 6 would be
required.

Ordering An Improvement And Preparation Of
Plans And Specifications For The
CSAH 83 Trunk Sanitary Sewer Extension,

WHEREAS, Resolution No. 6377 adopted on February 21,2006, fixed a date for COlmcil
hearing on the proposed improvement of the CSAH 83 Trunk Sanitary Sewer Extension, from the
Church Addition to Valley View Road, and all appurtenant work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 6th day of March, 2006, at which all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
CSAH 83 Trunk Sanitary Sewer Extension, from Church Addition to Valley View Road,
and all appurtenant work.
2. Bruce Lon~y, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work of this project is hereby designated as part of the 2006-6 Public Improvement
Program.
4. The City Council shall let the contract for all or part of the improvements as authorized
by Minnesota Statutes 429.041 and Minnesota Statutes 444.075, no later than three years from the
date of adoption of this resolution.

On February 16, 2006 the Shakopee Mdewakanton Sioux Community (SMSC) Business
Council approved atemporary construction easement request by the City of Shakopee for
the purposes of installing a sanitary sewer main, The proposed easement is approximately
80 feet in width and encompasses 5,3 acres in area, This letter is written confirmation of
the action of the SMSC Business Council. It is the understanding that the appropriate
easement documents will.be drafted at a later date if the project proceeds,
