No. 7335 (F) Introduction ACTION SOUGHT: To adopt a resolution accepting the resignation of Pamela Schurman from the Shakopee City Council, effective August 31, 2013. BACKGROUND: Pamela Schurman has provided the City with a letter of resignation from her position on the Shakopee City Council. Her intended last day on the Council is August 31st. Ms. Schurman's term on the Council would otherwise expire on the first Monday in January, 2014. The Council is, therefore, tasked with appointing an interim replacement to fill the balance of Councilor Schurman's term. This appointment cannot be made until after the vacancy exists. According to the City Attorney, because her resignation is effective at a future date, the Council should adopt a resolution accepting it. Because there is less than two years remaining on the term, no special election is needed to fill the balance of the term. Council may begin to discuss the appointment process at any time, now that her resignation has been announced. However, the appointment itself cannot take place until the position is vacant, which would mean on or after September lt. The Council may choose to discuss the interim appointment process at the July 29th meeting, or just accept the resignation, and make a decision on how to fill the vacancy at a future meeting. There are no set criteria for replacement, other than it will be up to the four members who remain — Councilor Schurman may not participate in the decision. Possible alternatives include: • Post notice of the vacancy, and seek interested parties. If this is the choice, an "application" might be used to gather information. I have attached a sample that the City of Plymouth recently used in a similar situation. • Don't formally seek candidates, but instead appoint an individual who is mutually agreeable to the majority of the Council. • Appoint a previous Council candidate, or individuals who have previously served in an elected capacity for the City. • Select from current advisory board or commissioners. If this is used, note that the appointed individual would have to resign their volunteer position, so as not to create a conflict of interest. If a majority of the four members of the Council cannot agree on whom to appoint any votes result in a tie, by State law, the Mayor breaks the tie and makes the appointment. RECOMMENDATION: I recommend that the Council adopt the following resolution, accepting, with regret, the resignation of Pamela Schurman from her role as a member of the Shakopee City Council, effective 11:59 p.m. August 31, 2013. If the Council chooses to set forth criteria for the replacement, it should so indicate. Otherwise, this can be revisited at a future City Council meeting; however, the process should be determined so that the appointment can be made as soon after August 31st as possible. RELATIONSHIP TO VISIONING: This supports Goal F, "Housekeeping ". ACTION REQUIRED: The Council should, by motion, adopt the following resolution: A resolution accepting the resignation of Pamela J. My last day on the council will be August 31, 2013. Our family's pending arrival of twins in November is taking priority over fulfilling the final four months of my term on the Council. I feel it is best for me to make room for someone with the energy to devote to the job in that timeframe. I appreciate the trust the voting public instilled in me when I was elected in November 2009. I have been honored to serve the citizens of Shakopee in this capacity and I wish nothing but success for the future of the city. Sincerely, Pamela J. Schurman Cc: Mr. Brad Tabke, Mayor RESOLUTION NO. 7335 A RESOLUTION ACCEPTING THE RESIGNATION OF PAMELA J. SCHURMAN FROM THE SHAKOPEE CITY COUNCIL WHEREAS, in 2009 Pamela J. Schurman, was elected by Shakopee voters to a four - year term on the Shakopee, Minnesota City Council; and, WHEREAS, Pamela J. Schurman has served in that capacity since January 1, 2010; and, WHEREAS, Pamela J. Schurman has submitted a letter of resignation from her position on the Shakopee City Council, with her last day on the Council to be August 31, 2013. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL FOR THE CITY OF SHAKOPEE, MINNESOTA, that it hereby accepts, with regret, the resignation of Pamela J. Schurman as member of the Shakopee City Council, effective 11:59 p.m. August 31, 2013.
